The Act provides that all employers must issue workers’ compensation insurance for all employees. This includes full-time employees, part-time employees, and seasonal employees (but not contractors). Employers should be careful when determining employee classification. The Act covers injuries that occur on the job as well as illnesses that occur from exposure to certain materials, such as asbestos or benzenes. Under the Workers’ Compensation Act, work-loss benefits and medical benefits may be covered. Death benefits are usually paid to the dependent survivors if the death occurred from a work-related injury or illness.

Determining How Much Money You Can Collect Under Workers’ Compensation

In order to file a successful claim for workers’ compensation benefits within the three-year statute of limitations, you must be able to prove that you sustained an injury or illness in the course of your job duties. If your application is accepted, then the amount of your benefits will be determined by what your average weekly wage is. Most of the time, it amounts to about 2/3 of your weekly wage. However if your injury leads to a specific loss or disfigurement, you might be entitled to a lump sum equivalent to a certain amount of weeks’ worth of wages.
