TERMS OF SERVICE, END USER LICENSE AGREEMENT, AND PRIVACY POLICY

PART 1: TERMS OF SERVICE AND END USER LICENSE AGREEMENT

1. Agreement to Terms By downloading, installing, or using the Konkan mobile application ("App"), you agree to be bound by these Terms of Service and End User License Agreement ("Terms") and our Privacy Policy. If you do not agree, do not use the App. We grant you a personal, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial entertainment purposes.

2. Eligibility You must be at least 13 years of age to use Konkan. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.

3. Account Creation and Security Konkan utilizes Supabase for authentication and database management. When you create an account:

• You must provide accurate information.

• You are entirely responsible for maintaining the confidentiality of your login credentials.

• You may not create multiple accounts to manipulate rankings, evade bans, or otherwise disrupt the game.

• We reserve the right to suspend or terminate your account at any time for violating these Terms.

4. Prohibited Activities You agree not to engage in any of the following:

• Using the App to advertise or offer to sell goods and services.

• Selling, trading, or otherwise transferring your Konkan account or profile to another person.

• Using cheats, exploits, automation software, bots, or any unauthorized third-party software designed to modify or interfere with the Konkan experience.

• Harassing, threatening, or defrauding other players.

5. User-Generated Content Konkan may allow you to post content, such as profile pictures, usernames, and chat messages ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, royalty-free license to host, display, and distribute it within the App. We are not responsible for User Content and reserve the right to remove any content that violates these Terms or is deemed inappropriate at our sole discretion.

6. Virtual Items and Service Interruptions Any virtual currency, points, or achievements earned or purchased within Konkan have no real-world value and cannot be exchanged for cash or items of value outside the App. We reserve the right to manage, regulate, and modify virtual items at our discretion. Konkan is provided "as is." While we strive for a seamless experience, we are not liable for any loss of game progress, virtual items, or rankings resulting from server downtime, software bugs, or internet connectivity issues on the user's end. We reserve the right to reset game data or roll back the server in the event of a critical system error.

7. Copyright Infringement We respect the intellectual property rights of others. If you believe any content in Konkan infringes upon your copyright, please contact us at hamaadil007@gmail.com with a detailed description of the alleged infringement. We will investigate and remove violating content as necessary.

8. Third-Party Links The App may contain links to third-party websites or services (such as app stores or social media platforms). We do not own or control these third-party sites and are not responsible for their content, privacy policies, or practices.

9. Dispute Resolution Any dispute arising from these Terms will first be addressed through informal negotiations for a period of 30 days. If the dispute cannot be resolved informally, it shall be resolved through binding arbitration in Erbil, Iraq, rather than in court.

10. Limitation of Liability To the maximum extent permitted by law, our liability to you for any claims arising out of or related to these Terms or your use of Konkan shall be limited to the lesser of: (a) the amount you paid to us for the App or in-app purchases in the 12 months preceding the claim, or (b) $50.

11. Account Deletion You may request the deletion of your account and associated personal data directly within the App settings or by contacting us. Once processed, this action is permanent.

PART 2: PRIVACY POLICY

This Privacy Policy explains how we collect, use, and protect your information when you play Konkan. By using the App, you consent to the data practices described below.

1. Information We Collect

• Account Information: When you register, we collect information necessary to create your account, such as your email address, username, and password.

• User-Generated Content: We store the content you create or upload, including profile pictures and in-game chat messages.

• Gameplay Data: We collect data related to your game progress, scores, rankings, and virtual item inventory.

• Device and Usage Information: We may automatically collect information about your device, including your device model, operating system, IP address, and app usage data (e.g., crash reports and feature interactions) to help us maintain and improve the game.

2. How We Use Your Information We use the collected information to:

• Provide, operate, and maintain the Konkan game.

• Authenticate your identity and secure your account.

• Save your game progress and manage leaderboards.

• Facilitate in-game communication (e.g., chat).

• Provide customer support and respond to your inquiries.

• Monitor and analyze usage trends to improve the App's performance and fix bugs.

3. Third-Party Services We do not sell your personal data to third parties. However, we use trusted third-party services to operate the App:

• Supabase: We use Supabase for secure backend database management and user authentication. Your account credentials and game data are processed and stored securely through their infrastructure.

• App Stores: Platforms like the Apple App Store or Google Play Store may collect their own data (such as payment information for in-app purchases). We do not have access to your raw payment details.

4. Data Security We implement reasonable security measures to protect your personal information from unauthorized access, alteration, or destruction. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

5. Data Retention and Your Rights We retain your data for as long as your account is active or as needed to provide the game services. You have the right to:

• Access the personal data we hold about you.

• Update or correct inaccuracies in your information.

• Request the permanent deletion of your account and associated data (as outlined in Section 11 of the Terms of Service).

6. Children's Privacy Konkan is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided us with personal information, we will delete such data immediately.

7. Changes to This Privacy Policy We may update this Privacy Policy from time to time. We will notify you of any significant changes by updating the "Last Updated" date at the top of this document or via an in-app notification.
