Terms of Use

The following terms of service (“Terms”) constitute an agreement between you and KD Turner Game company, (together with all its affiliates, “Company,” or “we,” “us,” “our”). These Terms govern your access, and/or use of all (A) software programs distributed, published or otherwise made available by the Company including, but not limited to (i) mobile Games (as defined below), (ii) downloadable/installable Games for personal computers, mobile devices, tablets, or any other device (iii) Games accessed by means of a browser or other online communication method, (iv) Games accessed by means of third party platforms, websites and social media sites, including Facebook, (v) your use of the Company's website, (vi) all updates and upgrades to the foregoing (each a "Game" and collectively the “Games”); and (B) services made available by the Company, including but not limited to any services available on the Company's website and services accessed through or provided in relation to the Games (the “Services”).

If you access or use the Services from within a jurisdiction for which there are separate supplemental terms, you also hereby agree to the supplemental terms applicable to users in each jurisdiction as outlined in the relevant “Supplemental Terms – Jurisdiction-Specific” section below, and in the event of a conflict between the provisions of the Supplemental Terms – Jurisdiction-Specific that are relevant to your jurisdiction from which you access or use the Services, and the rest of these Terms, the relevant jurisdictions’ Supplemental Terms – Jurisdiction-Specific will supersede and control. Access to the Services from jurisdictions where the contents or practices of the Services are illegal, unauthorized or penalized is strictly prohibited. If you do not agree to these Terms, you must not access or use our Services.

1. Personal Information

To use the App, you may be asked to provide certain personal information (the “Personal Information”), including information about your 【weight, age and gender】, to optimize your use of the App. If you choose to provide such Personal Information, you agree to provide accurate and current information about yourself, and KD Turner will not be responsible for any injury related to any Personal Information you submit to the App or omit. The use or disclosure of any Personal Information you supply will be governed by our Privacy Policy.

1.1. What Information We May Collect

1.1.1. Information your directly and voluntarily provide to us

we may collect information that you provide to us. The information includes but is not limited to: your email address, the content of feedback, and the content of the questionnaire answered by you.

1.1.2. Information automatically collected when you use our Service

We will collect information including, but not limited to: your mobile device’s brand, model, operating system, resolution, screen size, system version, Bluetooth settings, internet connection, RAM, history, the apps you have installed, the apps you have running in the background, mobile device’s Android Advertising ID, along with your account activation time, content displayed to you and whether you clicked on it, advertisements displayed to you and whether you clicked on them, URLs you have visited, notifications that have appeared on your mobile device, your IP address, your mobile country code, and your identity. We will also request access to your photos, media and files, your device’s camera and microphone, your Wi-Fi connection information and your device ID and call information.

1.1.3. Information collected by our Third-Party Advertising Partners.

We work with third party advertising partners to provide personalized ads for you.

Our partners may collect hardware and software information such as IP address, device ID and type, advertising IDs (such as Google's AAID and Apple's IDFA, both of which are randomly generated numbers that you can reset by going into your device' settings), device language, operating system, time zones, and identifiers associated with cookies or other technologies that may uniquely identify your device.

1.1.4. Information collected by Third Parties Analytics Services

We may work with third party analytics services to help us provide you with better service. Information might be analyzed such as how often you use the application and the events that occur within the application. We collect this type of analysis information and use it in conjunction with the analytical information collected from other users so that such information could not be used to identify any specific individual user.

If you give us personal information of somebody else, we will assume that you have their permission to do so. Transmissions to and from   KD Turner Team or the Site may not be confidential and consequently, may be read or intercepted by others.

   1.2. How We May Use Collected Information

     1.2.1. To improve customer service

Information you provide helps us respond to your customer service requests and support needs more efficiently.

     1.2.2. To personalize user experience

We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site.

     1.2.3. To improve our Site

We may use feedback you provide to improve our products and services.

     1.2.4. To process payments

We may use the information Users provide about themselves when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.

     1.2.5. To run a promotion, contest, survey or other Site feature

To send Users information they agreed to receive about topics we think will be of interest to them.

     1.2.6. To send periodic emails

We may use the email address to send User information and updates pertaining to their order. It may also be used to respond to their inquiries, questions, usage tips, website news and/or other requests, promotions. If at any time the User would like to unsubscribe from receiving future emails, they must delete their account in settings page under profile.

     1.2.7. To collect information of applications

in order to provide a safe mobile usage environment, we build the Anti-Virus system through Quick Scan, Full Scan, Real Time Protect, False Positives Mark, Virus Database Updates and Virus Sample functions; When you start Quick Scan, Full Scan and enable Real Time Protect, we’ll read and collect information of applications you installed both in phone and SD card and file information or file storage information of installed applications. Then we can kill viruses with our cloud antivirus engine and local antivirus engine.

In order to modify malicious application information marked with no false positives, we’ll read and collect information including application information, application file information you installed both in phone and SD card and virus information as well as input content, and upload them to the server.

In order to build up a virus database, we’ll collect virus database sample file information and upload it to the server.

In order to upgrade the virus database manually or automatically for latest virus killing, we’ll read your WIFI status and current virus database information and then compare different versions.

1.3. Disclosure of Your Personal Information

We may disclose your personal information to our business partners, including advertisers, publishers, and data tracking companies. These business partners may use your personal information to show you advertisements, measure your ad/site interaction, and better understand the site and app traffic usage or user behavior in order to improve their services. Such partners’ use of the information that we disclose to them will be governed by their privacy policies.

We may disclose your personal information to our trusted agents and service providers so that they can perform requested services on our behalf. For example, we may share payment information with a third-party service provider in order to assist us with processing credit card payments. These entities are prohibited from using User’s information for any purposes other than providing us with requested services. We may also share aggregate or anonymous information with other third parties in accordance with the terms of this Policy.

Our affiliates may also have access to your personal information collected through KD Turner for the purposes set out in this Privacy Policy.

We may share your personal information as required or permitted by law to comply with a subpoena or similar legal process or government request, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our rights and property, or the rights, property or safety of others, including to advisers, law enforcement agencies, judicial and regulatory authorities. We may also transfer your personal information to a third party that acquires all or part of our assets or shares, or that succeeds us in carrying on all or a part of our business, whether by merger, acquisition, reorganization or otherwise.

1.4. Security of Your Personal Information

The security of your information is our utmost priority, and we take strict measures in order to protect our data from unauthorized access, use, disclosure or destruction of data. We have implemented physical, technical and administrative security measures for KD Turner Services that comply with applicable laws and industry standards. For example, we use firewalls, encryption technology and other automated software designed to protect against fraud and identity theft; our data is only stored in centers that provide high-level security for your information. We strictly prohibit any user unreasonably using the privacy of others obtained during the use of the software.

2. Account

To access or use some of our Services, you must create an account with us. When you create this account, you must provide accurate and up-to-date information. It is important that you maintain and promptly update your details and any other information you provide to us, to keep such information current and complete.

It is important that you keep your account password confidential and that you do not disclose it to any third party. If you know or suspect that any third party knows your password or has accessed your account, you must promptly notify us at KD Turner

We will not publicly disclose any personal or sensitive user data related to your account, Paypal, activities e-mail address. We will Comply with all relevant privacy, data security and data protection laws, decrees, regulations and provisions shall be applicable.

3. Your Access to and Use of Our Services

Your access to and use of the Services is subject to these Terms and all applicable laws and regulations. You may not:

3.1. access or use the Services if you are not fully able and legally competent to agree to these Terms;

3.2. modify, adapt, translate, reverse engineer, disassemble, decompile or create any derivative works based on the Services, including any files, tables or documentation (or any portion thereof) or determine or attempt to determine any source code, algorithms, methods or techniques embodied the Platform or any derivative works thereof;

3.3. distribute, license, transfer or sell, in whole or in part, any of the Services or any derivative works thereof;

 3.4. market, rent or lease the Services for a fee or charge, or use the Platform to advertise or perform any commercial solicitation;

3.5. interfere with or attempt to interfere with the proper working of the Services, disrupt our website or any networks connected to the Services, or bypass any measures we may use to prevent or restrict access to the Services;

3.6. incorporate the Platform or any portion thereof into any other program or product. We reserve the right to refuse service, terminate accounts or limit access to the Services in our sole discretion;

3.7. use automated scripts to collect information from or otherwise interact with the Services;

3.8. impersonate any person or entity, or falsely state or otherwise misrepresent you or your affiliation with any person or entity, including giving the impression that any content you upload, post, transmit, distribute or otherwise make available emanates from the Services;

3.9. intimidate or harass another, or promote sexually explicit material, violence or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

3.10. use or attempt to use another’s account, service or system without authorization from Platform, or create a false identity on the Services;

3.11. use the Services in a manner that may create a conflict of interest or undermine the purposes of the Services, such as trading reviews with other users or writing or soliciting shill reviews;

3.12. use the Services to upload, transmit, distribute, store or otherwise make available in any way (including for the purposes of creating and/or streaming content):

3.12.1 files that contain viruses, worms, logic bombs or other material that is malicious or technologically harmful;

3.12.2 any unsolicited or unauthorized advertising, solicitations, promotional materials, “junk mail”, “spam”, “chain letters”, “pyramid schemes”, or any other prohibited form of solicitation;

3.12.3 any private information of any third party, including addresses, phone numbers, email addresses, number and feature in the personal identity document (e.g., National Insurance numbers, passport numbers) or credit card numbers;

3.12.4 any content which does or may infringe any copyright, trademark or other intellectual property or privacy rights of any other person;

3.12.5 any content which is defamatory of any person, obscene, offensive, hateful or inflammatory;

3.12.6 any content that would constitute, encourage or provide instructions for a criminal offence, dangerous activities or self-harm;

3.12.7 any content that is deliberately designed to provoke or antagonize people, especially trolling, or is intended to harass, scare, distress, embarrass or upset people;

3.12.8 any content that contains a threat of any kind, including threats of physical violence;

3.12.9 any content that is racist or discriminatory, including discrimination on the basis of someone’s race, religion, age, gender, disability or sexuality;

3.12.10 any answers, responses, comments, opinions, analysis or recommendations that you are not properly licensed or otherwise qualified to provide; or

3.12.11 content that, in the sole judgment of Platform, is objectionable or which restricts or inhibits any other person from using the Services, or which may expose Platform, the Services or its users to any harm or liability of any type.

 We reserve the right, at any time and without prior notice, to remove or disable access to content at our discretion for any reason. Some of the reasons we may remove or disable access to content may include finding the content objectionable, in violation of these Terms, or otherwise harmful to the Services or our users.

 4. Intellectual Property Rights

 We respect intellectual property rights and ask you to do the same. As a condition of your access to and use of the Services, you agree not to use the Services to infringe any intellectual property rights. We reserve the right, with or without notice, at any time and in our sole discretion to block access to and/or terminate the accounts of any user who infringes or is alleged to infringe any copyrights or other intellectual property rights.

 5. Privacy

 6. Cash Coupon

 Cash Coupons are a form of virtual currency in the Game. Cash Coupons are not real money, and do not have monetary value. You acknowledge that Cash Coupons are not real currency. We make no guarantee as to the nature, quality or value of the features of any third-party goods or services that will be accessible through the use of Cash Coupon, or the availability or supply of Cash Coupon. Cash Coupons obtained via the Game are provided to you under a limited, personal, revocable, non-transferable, non-sub-licensee license solely to use within the App. Cash Coupons may not be transferred or resold in any manner, including, without limitation, by means of any direct sale or auction service. You have no property interest, right or title in or to any such Cash Coupon. Any Cash Coupon balance shown in your account does not constitute a real-world balance or reflect any stored value, but instead constitutes a measurement of the extent of your license. We may, at any time, expire free or promotional Cash Coupons given to you. You agree that under no circumstances are we liable to you for any damages or claims that may arise from the loss or use of your Cash Coupon regardless of the circumstances. You absolve us of any responsibility to maintain or update your Cash Coupon account. However, if there is a loss of Cash Coupon in your account due to technical or operational problems with the Services, we will replace the lost Cash Coupon once the loss has been verified. Without limiting any of the foregoing, our maximum liability or responsibility to you is to replace the Cash Coupon lost. Emails or messages will be sent to the email address or other contact information assigned to your account. Once a Cash Coupon has been lost or spent, they will be subtracted from your account and cannot be refunded or returned, except at our sole discretion. No Cash Coupon will be re-credited to your account in the event of a return or exchange of a Prize, or any problem.

 7. Severability

 If any provision in these User Agreement is held invalid, the remainder of these User Agreement shall continue to be enforceable. If any provision in these User Agreement is deemed unlawful, void or unenforceable, then that provision is deemed severable from these User Agreement and the remaining provisions are still valid and enforceable.

 8. Termination

 You agree that we have the right to suspend or deactivate your account or your access to certain parts of the app at any time and without notice or liability to you. Upon such termination we might delete your account and other information related to your account.

Reason for such termination could be violations of this agreement, requests from law enforcement or other government agency requests, but it is not limited to any of these.
