1. Acceptance of Terms
By accessing or using the services of KC Smart Services ("KC Smart," "we," "us," or "our"), including our website, booking page, and payment system, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use our services.
2. Services
KC Smart provides a variety of handyman, smart home automation, security camera installation, drywall repair, and other related services ("Services"). The specific Services to be provided will be outlined in the Service Agreement between KC Smart and the Client.
3. Booking and Scheduling
* Clients can book Services through our website or by contacting us directly.
* KC Smart will make reasonable efforts to accommodate Client's scheduling requests but cannot guarantee specific appointment times.
* KC Smart reserves the right to reschedule or cancel appointments due to unforeseen circumstances, with reasonable notice provided to the Client.
4. Payment
* Payment terms are outlined in the Service Agreement and may include a deposit and final payment upon completion of Services.
* Clients can make payments through our secure online payment system or by other agreed-upon methods.
* Late payments may be subject to late fees as described in the Service Agreement.
5. Client Responsibilities
* Client is responsible for providing clear instructions and necessary information to KC Smart regarding the Services.
* Client must ensure a safe and accessible work environment for KC Smart personnel.
* Client is responsible for backing up any important data before KC Smart begins work, as we are not liable for data loss.
6. Cancellations and Rescheduling
* Clients may cancel or reschedule appointments with reasonable notice to KC Smart.
* Failure to provide adequate notice may result in a cancellation fee as outlined in the Service Agreement.
7. Warranty
* Warranty information for products and labor is detailed in the Service Agreement and Disclaimer.
* KC Smart's warranty does not cover issues caused by misuse, abuse, normal wear and tear, or modifications made by the Client.
8. Limitation of Liability
* KC Smart is not liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to the Services provided.
* KC Smart's total liability to the Client for any and all claims is limited to the amount paid by the Client for the Services.
9. Intellectual Property
* All content on KC Smart's website and marketing materials, including logos, images, and text, is the intellectual property of KC Smart and protected by copyright laws.
10. Modifications to Terms
* KC Smart reserves the right to modify these Terms at any time. Updated Terms will be posted on our website.
11. Governing Law
* These Terms are governed by and construed in accordance with the laws of the State of Utah.
12. Dispute Resolution
* Any dispute arising out of or relating to these Terms shall be settled amicably between the parties. If an amicable resolution cannot be reached, either party may pursue legal remedies, including small claims court.
13. Entire Agreement
* These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications.
14. Severability
* If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
