Agreement to Terms
By downloading, installing, accessing, or using KalFit AI ("KalFit", the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the App.
Description of Service
KalFit is a nutrition and meal tracking application that helps users scan meals from the camera or photo library, estimate nutrition, log meals, review analysis, receive personalized diet recommendations, manage progress, and optionally use account, subscription, and notification features.
Eligibility
You must be at least 13 years old to use this App.
If you are under 18, you must have permission from a parent or legal guardian.
You must have the legal capacity to enter into these Terms.
You must comply with all applicable laws and regulations while using the App.
Account Registration
KalFit can be used in guest mode without creating an account, subject to feature limits and product rules shown in the App.
If you choose to sign in or create an account, you agree to provide accurate and current information.
Subscriptions and purchases are associated with your Apple ID.
You are responsible for maintaining the security of your device, Apple ID, and any account credentials used with the App.
You are responsible for all activity that occurs through your use of the App.
Health and Nutrition Disclaimer
KalFit provides meal estimates, calorie tracking, dietary insights, and AI-assisted recommendations for informational purposes only.
KalFit is not a medical provider and does not provide medical, diagnostic, or treatment advice.
Nutrition estimates, scan results, and recommendations may not always be complete, precise, or suitable for your personal health needs.
Always consult a qualified healthcare professional before making significant diet, fitness, or medical decisions, especially if you have allergies, medical conditions, or other health concerns.
Subscriptions and In-App Purchases
KalFit may offer monthly, yearly, and lifetime purchase options. Pricing may vary by region or change over time, and the prices shown in the App and on the App Store at the time of purchase apply.
Subscription Terms
All purchases are processed through Apple's App Store.
Payment is charged to your Apple ID account at confirmation of purchase.
Auto-renewing subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current billing period.
Your Apple ID account may be charged for renewal within 24 hours before the end of the current period.
You can manage or cancel subscriptions through your Apple ID account settings.
Deleting the App does not cancel your subscription.
Refunds
Refund requests are handled by Apple and are subject to Apple's refund policies.
We do not issue refunds directly.
Cancelling a subscription stops future renewals but does not refund the current billing period unless required by Apple or applicable law.
Free Usage
Free access is limited to selected features as described in the App.
We reserve the right to modify free usage limits, trial access, feature availability, or pricing where permitted by law and platform rules.
User Conduct
You agree not to:
• Use the App for unlawful, harmful, fraudulent, or abusive purposes
• Violate applicable laws, regulations, or third-party rights
• Upload or submit content you do not have the right to use
• Infringe intellectual property, privacy, or publicity rights
• Attempt to reverse engineer, decompile, exploit, or interfere with the App
• Circumvent subscription, usage, guest, or entitlement limits
• Introduce malicious code, scripts, or software
• Misuse meal scanning, diet, or logging features in a way that harms the service or others
Intellectual Property
The App, including its design, features, text, graphics, branding, and functionality, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App except as permitted by law. All trademarks and service marks remain the property of their respective owners.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the App will always be available, uninterrupted, secure, or error-free, or that scan results, nutrition estimates, or recommendations will meet your goals or expectations.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE APP.
Our total liability shall not exceed the amount you paid for subscriptions or in-app purchases in the 12 months preceding the claim, or fifty U.S. dollars (USD 50) if you have not made any such purchases, whichever is greater, except where such limitation is prohibited by law.
Indemnification
You agree to indemnify and hold harmless us and our affiliates from any claims, damages, losses, liabilities, and expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
Termination
We may suspend or terminate access to the App if you violate these Terms, engage in abusive or fraudulent behavior, or attempt to bypass usage or subscription restrictions. Upon termination, your right to use the App ceases to the extent permitted by law.
Changes to These Terms
We may update these Terms from time to time. Updates will be reflected by revising the "Last Updated" date. Continued use of the App after changes become effective constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
Dispute Resolution
Any disputes arising from these Terms or your use of the App should first be addressed through good-faith communication. If unresolved, disputes shall be subject to the courts of competent jurisdiction in India, except where mandatory consumer protections in your country of residence require otherwise.
Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
Entire Agreement
These Terms constitute the entire agreement between you and us regarding use of the App and supersede all prior agreements on this subject.
