Justice My Ass
Get Rid Of The Fokken (It's Dutch) Lawyers
SPECIFIC SOLUTIONS—NOT LAWYER-BLABBERBALONEY
The lawyer mob thinks it's invulnerable. It doesn't know pissed physics-math-EEs. We don't often get pissed, but watch out when we do.
Bill #1: "Congress repeals 28US#371 judge FAKE-Retirement. Retired judges are now subject to Congress' objective Boolean conclusions of corrupt decisions, each such decision diminishing a retired judge's compensation 15% of remaining compensation.
The UnConstitutional, corrupt lawyer-monopoly-mob (ABA, godfather entity) controls and restricts access to (Am1 right to petition in) federal & state courts. And the mob has its corrupt paws on every lever of govt power. This is the UnConstitutional factual reality despite various ABA cover-their-ass statements they erroneously believe get them off the hook. The mob is a protection racket of judges protecting other judges who protect lawyers & their fees. The racket sees that court decisions "come out right," as Mobster Scalia said.
Congress, stuffed with lawyers and their lackeys (McConnell & Grassley very-notable examples), are the non-analytical (or brainwashed) algebra-flunking crew who repeat their rote-memorized mantras ("independence of the judiciary is #1) from their worthless polysci-type undergrad "studies." Read Article3 from our former—now crippled and largely-destroyed—Constitution, and you'll see the word REGULATIONS in the 3rd paragraph. Congress has full regulatory authority over 99.9% of what the fed courts do. There is no "independence of the judiciary."
Congress—and the lawyer-judge wordpushers outside of Congress—doesn't want you to know about that word REGULATIONS. You must remind Congress every day that they must write AND ENFORCE on fed judges the simple Boolean expessions (TRUE/FALSE facts Inputs⇒Legal Conclusion Output), which are THE RULE OF LAW. Congress' writing fillable webforms that court-litigants must use—and judges must either approve the form's result or explain why it's wrong—would incease court efficiency by 1000x for the first two rounds in civil cases. This efficiency would free-up "scare judicial resources," about which judges always complain, for the criminal cases.
The press/media are fellow travelers with the lawyer-mob in the wordpushing biz. They are bamboozled by the Arguably-Accordingly-Moreover-Indeed lawyer mumbo-jumbo. They are ignorant or willfully-ignorant of the reality of the huge Scalia-scam where judges "make it come out right" for the lawyer-monopoly-mob.
Leaning on the media via advertiser boycotts is the only possible way to focus media attention. Or our former country is fully lost; and it may be too late at this point.
5/1/23 Rambling Screed (with revisions to the 12/27/22 "Born a Rambling Screed Man"): This site is Justice My Ass, and is part of the Make America Geeky Again Anti-Corruption Project. DONATE TO JOHN'S SENATE CAMPAIGNs—strategic and tactical campaigns to call out AND FIX the corrupt failure of the courts—top to bottom controlled by the lawyer-monopoly-mob—including the Sup Ct with its (hold your nose ) "CANONS of ethics." They like fancy-words (and liturgical "canon" words work well for their schemes). Like the "CANONS of statutory construction" and other mumbo-jumbo covers for these frauds, you get the CANNONball that takes you down to the lower reaches of the cesspool. UNLESS you pay into the Dues Process of the lawyer monopoly. Here's the root cause of the crippling of our Bill of Rights over the last 40 years (and George Floyd's death and the deaths of the five Dallas officers and countless others): S ⇒ ~Ft. This is the WRONG ("legally-erroneous" FALSE faulty MISTAKEN logically-bankrupt BULLSHIT) 1983 Feldman rule. And that's the concise description. Here is the corrected Feldman rule: ~ST ⇒ Ft.
BTW I'm the crazy cripple pissing on himself in a corner of the internet. Yep—cracked, screw-loose, flipped-out, and if I've forgotten anything, email me with the subject: bonkers. After you're done with the name calling, you can pay attention to the root-cause analysis and SOLUTIONS. I am correct, and we're gonna have a public debate, outside of the cronyistic confines of a courtroom, Ted Cruz and Amy Klobuchar. You will not avoid me forever.
Also BTW, I have a post-trauma/survivor's guilt from my Brainfartica-Arctica hypothermic plane crash. I apparently didn't give up over 3 hours (which I don't remember except for a bit near the end as I was on the edge of a frozen death, when the rescuers arrived), and I certainly won't quit before I debate Cruz and Klobuchar and then any other lawyer-Congresstype who wants to take me on. They don't deal with pissed-off physics-math-EEs and don't know how to. Few do, because we like our nerdy puzzle-solving and blinkenlights in our labs, and we tend to stay there and not deal with, for example, stupid judge-megalomaniacs.
But fate deals some bizarre hands, and either your play them or fold. I didn't fold, but I also had the help of an unknown number of guardian angels, including the son of a sheriff dept dispatcher in Santa Fe, who told me that her late son had been watching over me, when I had called the sheriff's office. from my hospital bed. That conversation was one card that fate dealt that kept me going through 6 months of neuropathic agony while I stayed off of opioids as much as possible. Also, I didn't land on an occupied house or a playground at recess.
So, I'm something of a ghost living a comparatively great life with spinal nerve and cord damage and lots of metal in my bones, but I can actually play tag with my daughter. And I'm a ghost haunted by countless souls who would give anything to have had my luck and agonizing pain and disability. But I'm not a firendly ghost when it comes to the lawyer-mob. I'm not putting up with the judge-lawyer bullshit that, in particular, has crippled our precious Bill of Rights over the 40 years since the 1983 Feldman abomination; and has ruined and terminated a huge number of lives. This abomination especially includes Hennepin Burke and Sgt I-know-nothing David Schultz, the Minneapolis moron magistrate judge.
To Schultz and the other dunce-judges (the vast majority)...the WRONG rule (S ⇒ ~Ft) says that if a state judge violates your Constitutional rights (or any other federal right), you CANNOT take that "state-court decision" (S), to a federal trial court (Ft) to correct (that is, give an ass-whoopin' to) the state judge—for example, the simpleton-fraud-judge Kevin the Hennepin-Menace Burke who rang the clarion call, in the months prior to Mr. Floyd's death: that Minneapolis courts were a total wackjob.
The corrected rule is ~ST ⇒ Ft. It's still not actually correct, but it's good enough and certainly a huge step away from the current disaster. It says that so long as you don't have a final decision from a state's supreme (top ST) court, you CAN take that state-judge's decison to a federal trial court Ft. The 1880 Virginia case was exactly that. The 1972 Mitchum case was that too, even more emphatically IN ITALICS.
The most crucial goal of this project—and the EASIEST FIX to the US's broken down government—is: ~ST ⇒Ft.
The § 1257 statute pertains only to the top court in states. It cannot have any control of lower state courts. Some judges use what they call a "negative implication" or "negative inference"—which is a logical FALLACY (falsehood), calling the "inverse" of a proposition TRUE when it is FALSE). The 6th Circuit federal appeals court (which covers Tenn and is, of course, where Tyre Nichols was killed) is especially good about showing their failure of 10th grade math (with the exception of one or maybe two judges) and more.
Congress MUST tell the moron-judges that there is no legitimate "negative inference" of the kind they want to find: first of all, it's a logical fallacy. The Sup Ct does point to a "negative inference" that is legitimate, although "negative inference" is very poor nomenclature: "a negative inference may be drawn from the exclusion of language from one statutory provision that is included in other provisions of the same statute." Rumsfeld (2006). If Congress writes two lists in a statute, and one list is missing something the other list has; then it's safe to assume that Congress meant the omission. But Congress can resolve this by including Booleans in statutes: expressions that assign letters ("variables," basically) to words and phrases. This restates that language in a compact form that will virtually eliminate an ambiguity. No more judge-fudging around with Congress' (the Big Magilla) and Mr/Ms Peebles' laws. Period.
I told you this project is about specific SOLUTIONS. That's what we engineers do.
Background: Congress is inherently political, so there will always be hypocrisy. The courts have ginned-up and gotten away with their FALSE-non-political, "independence" baloney for a long time. The lawyer-monopoly-mob (the ABA, the godfather entity with its code of silence, Model Rule 8.2: you can't say anything bad about a judge) has flown under the radar forever, basically, and wreaked havoc on the Constitution and everything else.
What constitutes egregious corruption in Congress (in contrast with its garden-variety corruption) can be debated forever. But lawyers—beneficiaries of the lawyer-monopoly-mob—infesting Congress, who won't do their Article III job of REGULATING (Art3, 3rd paragraph) the courts because of their myth of "independence of the judiciary," have crippled our Constitutional rights and effectively destroyed due process and property rights. This has happened because the WRONG Feldman rule has given federal courts a "quasi-magical means of docket-clearing," and Bravo to this Judge Eric L. Clay on the 6th Circuit. Truth be told, I haven't read his whole dissent in RLR (2021), but that phrase alone puts this guy way above the rest of the sorry pack.
This MAGeeky Again project began 5/27/20 the day I saw George Floyd. He had been killed two days previously, while I was focused on writing objections to a Minneapolis federal magistrate judge, I-know-nothing Sgt. (David) Schultz. I had already called-out Hennepin County courts and the Minnesota state appeals court as a "military regime" (with the simpleton-fraud-judge Kevin Burke, dictator-in-chief) on the record of Minnesota's Sup Ct. on 4/15/20.
When I saw Mr. Floyd, I knew immediately what I had to do. I had no choice. Among the chapters of a lifetime of hallucinations in a two-week medical coma after my plane crash, I was trying to tell a nurse that this thing in my mouth and going down my windpipe was preventing me from talking and, at times, breathing.
I had already seen more than enough court-corruption—and that's exactly what it is—of judges in the pocket of big-law over medium-law over small-law; and if you don't have a lawyer, you get the bone. Judges want good clerks. Clerks want good jobs. Big firms have the most jobs. They also get the big-budget cases to hire "special masters" (often former judges), so judges feather their post-retirement nests by getting on the "good" list of the big firms. QED.
Judge Posner (the hardest-working appeals judge ever; look him up) called this out with strong words when he resigned. Not as strong as mine, of course, but his words should have been one of the whistleblower stories of all time. Barely a word from the media (certainly compared with some K-liposuction thing). Why? Because the media are the flipside of the lawyers—useless word-pushers who don't have any real solutions, just the same old "steep, precipitous decline" drivel over-and-over, as I watched Hannity on my hospital-bed-mounted TV screen until he nearly forced me to an opioid overdose...while he chatted with his lawyer-pals, who will never say what must be said: that the lawyer monopoly must end; there is no place in the Constitution (and of course in THE government) for a state-sanctioned royal class. It is not OUR government so long as Congress is stuffed with this royal class.
Tucker Carlson, in an unguarded moment, gave away the keys to the store. Two points for him. JD Vance (of whom I'm no fan but I hope he grows-up a little does something constructive in Congress) was candid in that youtube video: he said he didn't want to be against the wall for money, so he went to law school. Two points for his candor (at least then). That brief exchange was Fox's most important NEWS FLASH ever. And I'm going to make sure of it.
Engineers and hard-science types and anyone who troubleshoots a real-world problem—all of them engineers (machinists, HVAC, engine/auto-body mechanics, airframe-powerplant techs, plumbers, electricians, etc; and I will always drive this point home) SIMPLIFY. We narrow down a problem and look for the root cause. We control as many things as we can in an experiment. We ask questions and demand answers. It's called the scientific method. It brought us out of the caves and is the foundation of civilization.
By contrast, lawyers take simple—and essentially trivial—ideas, and pump them up with inflated lingo to make things sound complicated for their job security and monopolistic fees AND THEN GET THEM WRONG. This is the root cause of every major US domestic problem. They are retrograde and are taking us back to the caves.
The courts—the lawyer-monopoly-mob—have flown their corruption under the radar far too long. This project—to terminate that mob—is a tall order for sure, but technology gives small voices more leverage today than ever before. This project doesn't snow you with slogans; it treats you as the intelligent people you are because #1) you followed a link to read this.
Congress holds all the cards under our Constitution's Article III to REGULATE the lower federal courts. Congress is the Big Magilla, controlled by Mr/Ms Peebles (formerly known as We the People).
Read Art III; it's six short paragraphs. Congress, stuffed with lawyers and their lackeys, has abdicated its role as a helicopter parent over its laws—which are supposed to be OUR laws written by OUR representatives; and not corrupted by "negative inferences" by flunkees (in robes) of basic logic taught in 10th grade BUT WHAT EVERY REAL-WORD PROBLEM SOLVER UNDERSTANDS regardless of what degree he or she has. And I absolutely mean that.
I'm now harassing Ted Cruz and Amy Klobuchar (both lawyers/litigators), against whom I've registered with the FEC. I've also registered against Liz Warren. Though Warren is as far out in left field—from the home plate of budgetary arithmetic, to which it all "goes around and comes around" (I'm revolted that I've used that expression)—she wasn't a litigator, according to the Wiki. Though she probably knows full well that the courts are a cesspool, she gets a little bit of a break because she wasn't a litigator and might not know first-hand how awful the courts are.
Once again...this project is about specific SOLUTIONS—an engineering approach to actually Debugging the Constitution, not just the lawyer-blather (rinse and repeat) from Congress. The Constitution is a remarkable document, but like anything, it has defects. It could not scale up from 13 small states on one edge of a continent, to the US today. It was a good try, but it's not surprising it wouldn't be up to the task. An engineering approach, however, doesn't mean you throw out everything that has had some reasonable success for 250 years (and that statement hits a big roadblock with blacks, of course, but fixing the courts to have TRUE objectivity—or as close as it gets—would have saved Mr. Floyd and countless others; and I'm still studying Tennessee). Engineering is that done by any real-world problem solver: those who "cut metal" (as I've noted)—anyone whose job depends on diagnosing and fixing a problem, so the car or airplane doesn't come back to the shop. Or fail at an inconvenient time and place (my brain failed at 9000' not the plane); or doesn't require another house call to fix the plumbing or electricity—problems you cannot talk your way around the way lawyers try to.
Our Bill of Rights has been crippled for the last 40 years by the 1983 Feldman decision. Due process—which always means, at a minimum, you are given notice and a chance to be heard by an OBJECTIVE judge (except in Montgomery County, Maryland from which this Raskin loud mouth lawyer is elected, who "implored" the Senate to convict Trump, the one president who attacked the DC-NY nucleus of power and exposed, among other things, the blatant political tuning of federal judges)—and property rights are all but dead, as a result of Feldman. Congress can reverse course on this destruction in a week, literally, by reading the courts the riot act from the floor of Congress. No legislation is needed to put the courts on notice that their jig is up; and to tell them why. This will, one would hope, get the media off their lazy butts and to start scrutinizing judges, who have been given a free pass forever.
The 1983 Feldman rule is ~ST ⇒Ft: a Boolean expression (formally taught in junior-high/high-school math), but it's just a questionnaire—a jury instruction, which is the law without the mumbo-jumbo. If you don't have a final, last decision from a state's top court (typically called the supreme court; Maryland has finally corrected that pathology of its courts—one of many pathologies), then you can file a federal civil rights complaint in a federal trial court against any judge who, you believe, has violated one of your Constitutional rights. (I capitalize "Constitutional;" judges don't, but even if they did, they would still trash our Constitution.)
Stupid, incompetent, lazy federal judges—including all of those on the Sup Ct when Brennan and his clerks wrote Feldman in 1983, didn't notice that a word was missing (see below). Any computer programmer 10 years old and up, who wanted to program the Feldman rule, can see what went wrong. But all of the "legal scholars" over nearly 40 years haven't been able to.
The 1st Circuit federal appeals court (Boston) got it exactly right in 2018. The 4th Circuit basically got it right in 2016 but stuck one word in that gave lazy, incompetent federal judges (in North Carolina, in particular) an excuse to do the obviously-wrong thing. This is an observation based on some judges' decisions out of NC federal courts, not a comment on NC itself. I'll show you the decisions later.
There are few if any true conservatives in Congress. Lawyers are, by definition, not conservative. They live and breathe their state-granted monopoly—their bar license—without which they'd be mid-level bureaucrats with a polysci major. True conservatives are extremely skeptical of monopolies. Monopolies are antithetical to free markets. This absence of actual conservatism—paying attention to specifications—in Congress is why so much of the US is in the dumper.
The other concentration of power—the infinite money-printing monopoly, the FED—is the other principal focus of this project. Though the FED's infinite-tentacled infiltration of the economy and our lives is an impossible problem to bring anywhere near a full analysis (in contrast with the courts, which are very easy to analyze and fix), and the current FED system will fail eventually, things may not be as bad as they could be (how's that for optimism?). The heel in the curve of FED destruction of our economy occurred on October 15, 1998 when Greenspan made a double-interest-rate cut shortly before the stock markets closed. This began the Greenspan Socialist Transform, which turned the stock market into a statistical debt instrument. Standard "financial planning" then described the (unitary) stock market as "yielding" some "historical" return over, say, 10 years. When the market didn't behave, the social hue and cry would erupt, and Alan (and his successors) would respond in socialized fashion to keep the socialized stock market going up.
At some point, the FED will lose control of prices and will send some message to Congress that capital controls are the "solution," i.e. you can't spend your money when you want on what you want. I don't make predications of "when."
12/19/22: This site is part of the Make America Geeky Again Project. Court "reform," "access to justice," and other such catch phases pushed by the lawyer monopoly (and its enablers and bedfellows, the media) are "woefully inadequate," to coin a phrase—yup. The court system requires the Rooter, long drain to the street. It must be deep-sixed. This is a war of WORDS, no no no no no violence, as I wrote in September 2020. Violence would ruin everything, and it happens to be, like, illegal ya know...criminal eveeen, says Snagglepuss. Goofing around is a strategic tool here (and happens to come naturally to me), in case you're wondering; it's for contrast with the seriousness of this project. Make no mistake about the seriousness of this project. This project requires some reading, though I'll make it as succinct as I can. Time is precious. I know. I was given a second life. The countless souls who never stood a chance, and ran out of time, weigh on me.
And I repeat that I'm very serious about NO VIOLENCE. It would backfire and ruin the truly effective strategy: to show factually and logically the bull-sheeÉt (2nd syllable accent; it's French-franglais) of idiot-judges' decisions—and "opinions" if you're lucky enough to get more than petition DENIED or a few mumbled words.
If you've never had an inkling of the possibility that the inflated lawyer mumbo-jumbo might be hiding bull-sheeÉt, I'm not sure I'll be able to do anything for you. You'll need to do a lot of extra reading. Skepticism is the heart of science and civilization's progress. We came out of the caves by asking questions and demanding answers—the scientific method. The heart of the so-called "legal" system is Petition DENIED—the "summary" decision. No reason given by the "geniuses" and masters of language and logic. It hides bull-sheeÉt. The lawyers and the court system are retrograde—back to the caves. The lawyer monopoly is the most powerful—and separately the most corrupt—monopoly in the US and is the root cause of every major domestic problem. More so than the infinite-money-printing monopoly (the FED), the other principal monopoly under scrutiny and attack here (NON-VIOLENT, verbal attack).
I'll show you now the biggest turd that has been polluting and crippling our Bill of Rights for the past 40 years; and has essentially destroyed due process and property rights. And Congress must define due process and a specific structure for effecting it, which is extremely simple and begins with a Boolean expression—10th grade math—defining a legal principle. It will go a long way towards curing the US's problems. That is no overstatement. It's the first priority, in part because the solution is so simple. Congress has full authority to do it by "regulation" under Article III. Read Art. III. It's six very short paragraphs. The 3rd paragraph give Congress the power to REGULATE the lower federal courts, through the Supreme Court's review power over them—its "appellate jurisdiction." Here's the 40-year turd—the Feldman rule—that has polluted and now crippled our Bill of Rights. Fixing this is the first priority.
The Feldman rule (3 syllables) is what the courts inflate to the Rooker-Feldman doctrine—6 syllables. If they made it "doctorin' " citing the literary and etymological authority of Granny Clampett, who would boil-up a pot of vittles (and don't believe that other, incorrect spelling) when someone was feeling under the weather and needed doctorin', then it would be 7 syllables:
A panel of (three) appeals court judges made a similar— but flat wrong—word-inflation once with "contrapositive," but Granny's usage was "arguably" (one of the lawyer mumbo-jambalaya's favorite crawfish in their pie) correct; while "contrapositive" was flat wrong (it's in my blogs somewhere; I'll link to it when I locate it).
Inverse was correct but only two syllables. Contrapositive was flat wrong, but pumped-up syllabification wins.
Here's the BIG GOOF of the Feldman rule, known in pumped-up lawyer bull-sheeÉt as the Rooker-Feldman doctrine:
Here are the diagrams that show what's wrong:
The Feldman rule can apply only to a State's HIGHEST, TOP. TIPPITY-TOP, SUPREME court. It cannot apply to any of the lower courts of a state. In fact it applies only to the last word (final judgment) from a State's supreme court. I've written about this on my site makeusageeky.com, and I'll keep explaining it as many ways as I can, even though it is very simple, until these dumbass judges get it. The 1st Circuit (Boston) gets it precisely, though it took four decades. The 8th Circuit (Minnesota, Dakotas, Nebraska, Iowa, Missouri, Arkansas) is an abomination, as is the 9th Circuit. I won't comment on others at the moment. (More coming here soon.)
