[Terms and Conditions] It’s Survey Time

Terms and Conditions of the Campaign (“T & C”)

TOHOKU 24 It’s Survey Time ("Campaign") is organized and sponsored by Japan National Tourism Organization Kuala Lumpur Office (JNTO) (hereafter referred to as the "Organizer").

AAB Asia Sdn. Bhd. (hereafter referred to as the “Agent”) has been entrusted by JNTO to be the administrator and the agent of the Campaign.

● The Campaign starts from 15:00 (GMT +8) on 15th Dec 2021 (Wed) and ends at 23:59 (GMT +8) on 30th Jan 2022 (Sat) (“Campaign Period”).

● Entry to the Campaign is free of charge and the Campaign is open to anyone who is at least eighteen (18) years old on the date of entry and only for Malaysian who living in Malaysia (“Participant”) except for the following:

✓ Permanent and/or temporary staff or employees of JNTO or any representative office around the world and its immediate family members.

✓ Representatives and/or agents (including advertising & promotion) of JNTO or other representative offices of JNTO around the world.

● The participant is required to read, understand, and agree on the terms and conditions stated in this T & C upon campaign entry.

Campaign Qualifying Requirements

To qualify for the Campaign, Participant shall meet all of the following

CAMPAIGN MECHANISM (“Campaign Mechanism”):

Answer all the necessary questions in the survey and fill out personal information as needed.

● All campaign entry needs to be completed and recorded by 23:59 (GMT+8) on 15th Jan 2022. Late entries will not be entertained.

● The Participant is only allowed to submit one entry. If you have multiple answers, the latest answer will be the one considered valid.

● Only Participant that fulfils the Campaign Mechanism as stated above shall be eligible to win the prize. Incomplete entries and/or Participant who fails to fulfil the Campaign Mechanism will automatically be disqualified from the Campaign.

● The Organizer reserves the right to disqualify any entry by the Participant which is deemed to contain offensive, inappropriate and/or obscene elements. Such entries will be disqualified immediately.

● By participating in the Campaign, it is deemed that the Participant agrees to be bound by the Terms and subject to the Conditions herein set out in this T&C upon submission of entry and is deemed to give their consent for personal information which is govern by our Privacy Policy which is available HERE.

Notification to Winners and Winning Prizes

The selected winners will be contacted by the Agent within 2 weeks after the campaign ended, via email or any other mode of communication deemed appropriate by the Organizer (Example: phone call, Email, text). If the selected winner is not responding to the email/ phone call from the Agent after 1 week from the date of winner announcement, the prize shall be forfeited, and a substitute winner shall be selected. No further appeal, enquiry and/or complaint from any Participant will be entertained.

● The winners will be asked to provide personal information to the Agent such as name, address, telephone number and other information required for the purpose of prize delivery.

● The decisions of the Organizer in relation to every aspect of the Campaign including but not limited to the type of prize and winners shall be deemed final and conclusive under any circumstance and no further appeal, enquiry and/or complaint from any Participant will be entertained.

● The winners are bound by the terms and conditions that come with the prizes, along with the T & C set in this Campaign. The acceptance of prize indicates the acknowledgment and agreement of such terms and conditions.

● The prize is not exchangeable and/or refundable by cash or any other benefit in kind. Failure to accept and collect the prize by the winners once informed via the mode of communication mentioned above when required to do so shall constitute a rejection by the winners and the Organizer reserves it rights to award the prize to another winner. Any cancellation and/ or refund request once the booking of the prize has been made is strictly not allowed.

● Organizer retains the right to substitute the prize with another of similar value in the event the original prize offered is not available due to circumstances beyond its reasonable control.

● The prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated.

● Subject to these Rules, the prize is not transferable, and resale of the prize is prohibited.

● Delivery of prizes is limited to registered address in Malaysia (including East Malaysia). Winner who is unable to provide a registered address in Malaysia will not be eligible for the prize and their winning shall be forfeited. Once delivered, the Organizer will not resend / replace the prize regardless of whatever reason. The Organizer is not responsible to loses in delivery, damages and other faulty conditions of the prizes during delivery/ upon arrival.

Other Terms and Conditions

The Organizer reserves its rights to publish or display materials or information, including but not limited to the names of the Participant for marketing, advertising, and publicity purposes in any manner it deems appropriate. The Organizer further reserves its right to use any personal data of the Participant in any manner and/or for any purpose it deems fit and the Participant is deemed to consent to such use by participating in the Campaign with no monetary payment whatsoever.

● The Organizer reserves its right to vary, delete or add to any of the terms and conditions in this T & C without any prior notice.

● The Organizer reserves its right to cancel, terminate or suspend the Campaign with or without any prior notice and reason. For the avoidance of doubt, cancellation, termination or suspension by the Organizer shall not entitle the Participant to any claim or compensation against the Organizer for any and all losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.

● E-mail addresses of the Participant collected by Organizer will be compiled for future newsletters, marketing, or other promotional purposes. By participating in this campaign, the Participant agrees on the use of their email-addresses on the mentioned purposes.[u1]

The T & C herein shall prevail over any inconsistent terms, conditions, provisions, or representations contained in any other promotional or advertising materials for the Campaign.

● All other expenses associated with this Campaign but not mentioned herein such as any other transportation, accommodation, food, whichever applicable, shall be solely borne by the Campaign winners. Compliance with any health or other government requirements is the responsibility of the prize-winners and companion, if applicable.

● The Organizer shall bear no responsibility for any damage, loss (including but not limited to direct, indirect and consequential loss), liability, injury or disappointment incurred or suffered by the Winner or their guest in connection with this Campaign or the execution of the Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

● This Campaign is governed by the laws and regulations of Malaysia.
