Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Privacy Policy:

•  Application means Is It Healthy?, the software program provided by the Company.

•  Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Is It Healthy?.

•  Country refers to: India.

•  Device means any device that can access the Service, such as a mobile phone or a tablet.

•  Device Identifier means a random, anonymous identifier generated on Your Device the first time You use the Application. It is not linked to Your name or any identifying information.

•  Personal Data is any information that relates to an identified or identifiable individual.

•  Photos means the photographs of food packaging, labels, or products that You capture with Your camera or select from Your photo library for analysis by the Service.

•  Service refers to the Application.

•  Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, or to assist the Company in analyzing how the Service is used.

•  Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself.

•  Verdict (or Analysis Result) means the health assessment, score, and related information that the Service returns for a scanned product.

•  You means the individual accessing or using the Service.


Collecting and Using Your Personal Data


Types of Data Collected


Personal Data


The Application does not require You to create an account, log in, or provide identifying information such as Your name, email address, or phone number.


If You choose to contact Us for support by email, We will receive Your email address and the contents of Your message.


Photos and Images You Provide


The core function of the Service is to analyze photographs of packaged food. When You capture or select an image (up to 4 images per scan), that image is transmitted to Our servers and to a third-party artificial intelligence provider (see "Third-Party AI Processing" below) so that a Verdict can be generated. Uploaded images are stored in private, access-controlled storage associated with Your anonymous Device Identifier.


Anonymous Device Identifier


The first time You use the Application, a random Device Identifier is generated and stored on Your Device. It is sent with each scan to enforce fair-use limits and prevent abuse. It contains no personal information and is not linked to Your identity.


Usage Data


Usage Data is collected automatically when using the Service. It may include information such as Your Device's type and operating system, and Your Internet Protocol (IP) address.


We use Your IP address only transiently, to enforce usage limits and prevent abuse. We do not store Your raw IP address. Instead, We store only a salted, irreversible SHA-256 hash of it, from which the original address cannot be recovered.


Analysis Results


The Verdict returned for a scan — including the product assessment, score, and product name where available — is stored on Our servers (associated with Your anonymous Device Identifier) and in a recent-scan history kept locally on Your Device. You can clear Your on-device history at any time from within the Application.


Third-Party AI Processing


To produce a Verdict, the Photos You submit are transmitted to and processed by Google's Gemini API. Google processes this data as Our Service Provider in accordance with its own terms and privacy policies. We encourage You to review Google's privacy practices at https://policies.google.com/privacy.


Use of Your Personal Data


The Company may use the collected data for the following purposes:


•  To provide and maintain our Service, including analyzing the Photos You submit and returning a Verdict.

•  To enforce usage limits and prevent abuse, using the anonymous Device Identifier and hashed IP address.

•  To improve and monitor our Service, including diagnosing technical issues and evaluating the quality and performance of the analysis.

•  To respond to Your requests, if You contact Us for support.

•  To comply with legal obligations and to protect the rights, property, or safety of the Company, its users, or others.


Retention of Your Personal Data


Your photos and the health verdicts generated from them are stored on Our servers for a limited period and then deleted automatically within about 30 days.

The Company will retain Your other data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your data to the extent necessary to comply with Our legal obligations, resolve disputes, and enforce Our legal agreements and policies.

Usage Data (including the hashed IP address used for rate limiting) and crash diagnostics are generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.


Transfer of Your Personal Data


Your information, including the Photos You submit, is processed at the Company's operating locations and by Our Service Providers, which may be located outside of Your state, province, country, or other governmental jurisdiction where the data protection laws may differ. Our infrastructure is hosted in the Asia-Pacific (Singapore) region, and Our AI Service Provider operates globally.


Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer. The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy.


Delete Your Personal Data


You have the right to delete or request that We assist in deleting data We have collected about You.


•  You can clear Your on-device scan history at any time from within the Application.

•  You may request deletion of server-stored data by contacting Us at the email address below.


Please note that because We store only anonymized data with no personal identifiers, We may require Your Device Identifier to locate the associated records, and in some cases may be unable to identify specific data as belonging to You. We may also need to retain certain information when We have a legal obligation or lawful basis to do so.


Disclosure of Your Personal Data


Business Transactions


If the Company is involved in a merger, acquisition or asset sale, Your data may be transferred. We will provide notice before Your data is transferred and becomes subject to a different Privacy Policy.


Law enforcement


Under certain circumstances, the Company may be required to disclose Your data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).


Other legal requirements


The Company may disclose Your data in the good faith belief that such action is necessary to:


•  Comply with a legal obligation

•  Protect and defend the rights or property of the Company

•  Prevent or investigate possible wrongdoing in connection with the Service

Security of Your Personal Data


The security of Your data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While We strive to use commercially acceptable means to protect Your data, We cannot guarantee its absolute security.



Service Providers


We employ third-party companies to facilitate Our Service, to provide the Service on Our behalf, or to assist Us in analyzing how Our Service is used. These third parties have access to Your data only to perform these tasks on Our behalf and are obligated not to disclose or use it for any other purpose. Our Service Providers include:

The Verdicts and information provided by the Service are for general informational purposes only and are intended as guidance to help You make choices. They are not medical advice and are not a substitute for professional advice from a qualified healthcare provider. Children's Privacy


Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with data, please contact Us. If We become aware that We have collected data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information.

Our Service may contain links to other websites that are not operated by Us. If You click on a third-party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.
