TERMS OF USE

Please read these Terms of Use ("Terms") carefully before using the Invoice Maker Estimate Billing mobile application ("the App") operated by Stilak ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. ACCEPTANCE OF TERMS
By accessing or using the App, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the App on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
2. DESCRIPTION OF SERVICE
Invoice Maker Estimate Billing is a mobile application that allows users to:
- Create, edit, manage, and share professional invoices and estimates
- Manage a client directory and item/service catalog
- Generate PDF documents from invoices and estimates using professionally designed templates
- Track invoice payment statuses (Draft, Unpaid, Paid) and estimate statuses (Pending, Accepted, Declined)
- Set up business profiles with logos and digital signatures
- View financial reports and analytics dashboards
- Receive local push notification reminders for unpaid invoices
- Convert accepted estimates into invoices
The App is intended as a tool to assist with invoicing and estimation. It is not a substitute for professional accounting, tax, or legal advice.
3. USER ACCOUNTS AND DATA
A. Local Storage
All data you create within the App (invoices, estimates, client information, business profiles, items, logos, and signatures) is stored locally on your device. We do not maintain user accounts or store your data on external servers.
B. Data Responsibility
You are solely responsible for the accuracy, completeness, and legality of all data you enter into the App. You are responsible for maintaining backups of your data. We are not responsible for any data loss resulting from device failure, App deletion, or any other cause.
4. SUBSCRIPTIONS AND IN-APP PURCHASES
A. Free and Pro Tiers
The App offers both free and paid (Pro) features:
Free Tier Includes:
- Up to 3 invoices per calendar month
- Up to 3 estimates per calendar month
- 5 free PDF templates
- Basic invoice and estimate creation
- Client and item management
- Financial reports and analytics
Pro Tier Includes:
- Unlimited invoices and estimates
- All 35 professional PDF templates
- Custom business logo on documents
- Digital signature on documents
- Watermark-free PDF generation
- Payment reminder notifications
- Estimate-to-invoice conversion
B. Subscription Plans
Pro access is available through the following plans:
- Weekly subscription
- Yearly subscription
- Lifetime purchase (one-time payment)
C. Payment and Billing
All purchases are processed through Apple's App Store. By purchasing a subscription, you agree to Apple's terms and conditions for in-app purchases. Payment will be charged to your Apple ID account at confirmation of purchase.
D. Auto-Renewal
Weekly and yearly subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price. You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
E. Free Trial
If a free trial is offered, the unused portion of the free trial period will be forfeited when you purchase a subscription.
F. Refunds
Refund requests are handled by Apple in accordance with their refund policy. We do not process refunds directly.
5. ACCEPTABLE USE
You agree to use the App only for lawful purposes. You shall not:
- Use the App to create fraudulent, misleading, or illegal invoices or documents
- Attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
- Modify, adapt, translate, or create derivative works based on the App
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the App
- Use the App in any way that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App
- Distribute, sublicense, lease, rent, or lend the App to any third party
6. INTELLECTUAL PROPERTY
A. Ownership
The App, including all content, features, functionality, design, templates, graphics, icons, and software, is owned by Stilak and is protected by international copyright, trademark, and other intellectual property laws.
B. Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device for your personal or business invoicing purposes, subject to these Terms.
C. Your Content
You retain ownership of all content you create within the App (invoices, estimates, client data, business information, logos, and signatures). By using the App, you grant us no rights to your content beyond what is necessary to provide the App's functionality on your device.
7. PDF TEMPLATES
A. Template License
PDF templates included in the App are licensed for use within the App only. You may use generated PDF documents for your business purposes. You may not extract, reproduce, or redistribute the template designs separately from the App.
B. Watermark
Documents generated by free-tier users may include a watermark. Upgrading to Pro removes the watermark from all generated documents.
8. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- THE APP WILL MEET YOUR SPECIFIC REQUIREMENTS
- THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
- THE RESULTS OBTAINED FROM THE USE OF THE APP WILL BE ACCURATE OR RELIABLE
- ANY ERRORS IN THE APP WILL BE CORRECTED
THE APP IS NOT A SUBSTITUTE FOR PROFESSIONAL ACCOUNTING, TAX, LEGAL, OR FINANCIAL ADVICE. YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT YOUR INVOICES AND ESTIMATES COMPLY WITH APPLICABLE LAWS AND REGULATIONS IN YOUR JURISDICTION.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STILAK, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY RELATED TO THE APP
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA
- ANY ERRORS, INACCURACIES, OR OMISSIONS IN INVOICES, ESTIMATES, OR OTHER DOCUMENTS GENERATED BY THE APP
10. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Stilak and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you create or share using the App
11. TAX COMPLIANCE
The App provides tools for creating invoices and estimates with tax calculation features. However, you are solely responsible for:
- Determining the correct tax rates applicable to your transactions
- Ensuring compliance with all applicable tax laws and regulations in your jurisdiction
- Filing tax returns and making tax payments as required by law
We do not provide tax advice and make no representations regarding the accuracy or applicability of any tax calculations.
12. TERMINATION
We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
13. CHANGES TO TERMS
We reserve the right to modify or replace these Terms at any time. Material changes will be reflected by updating the "Last Updated" date. Your continued use of the App after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
14. GOVERNING LAW
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the appropriate courts of the applicable jurisdiction.
15. SEVERABILITY
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
16. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and Stilak regarding the use of the App and supersede all prior agreements and understandings, whether written or oral, regarding the App.
