This Agreement outlines the rules and responsibilities for customers using IDBuzz SMS Marketing Services to ensure compliance with Opt-in & Opt-out regulations, industry best practices, and legal frameworks, including TCPA (USA), CASL (Canada), CTIA, and GDPR.
By using IDBuzz, you agree to send SMS messages only to recipients who have explicitly opted in and to provide an easy opt-out mechanism to comply with anti-spam laws.
IDBuzz users must only send SMS messages to recipients who have given explicit consent through one of the following approved methods:
Electronic Forms: The recipient enters their phone number and explicitly agrees to receive SMS by checking a consent box.
SMS Opt-in: The recipient voluntarily texts a keyword (e.g., JOIN, YES, SUBSCRIBE) to agree to receive messages.
Point-of-Sale (POS) or CRM Registration: Customers provide their phone number and consent during a purchase or account setup.
Written Consent: The recipient signs a document or electronic contract agreeing to receive SMS.
x IDBuzz DOES NOT ALLOW sending SMS without valid proof of Opt-in.
x Customers MUST store Opt-in records (timestamp, method, and consent details) for compliance.
x Unacceptable Opt-in Methods:
Purchasing phone number lists or using third-party databases.
Automatically adding contacts without explicit consent.
Assuming consent based on previous interactions without clear agreement.
Recipients must be allowed to opt out of receiving messages at any time using a simple and clear mechanism:
Every SMS must include Opt-out instructions, such as:
"Reply STOP to unsubscribe."
"Text STOP to stop receiving messages."
When a recipient replies with STOP, UNSUBSCRIBE, CANCEL, QUIT, or END:
IDBuzz shall immediately remove their number from the SMS list.
No further messages can be sent unless the user opts in again.
Customer is responsible for maintaining an updated Opt-out list and ensuring compliance.
Failing to honor Opt-out requests can result in service suspension or legal penalties under TCPA/CASL.
IDBuzz users MUST NOT use SMS for any of the following:
Sending SMS without consent (Spam messaging).
Fraudulent, misleading, or deceptive messages.
Gambling, adult content, illegal drugs, or other restricted content.
Sending excessive messages in a short time frame.
Messaging outside allowed hours: SMS should only be sent between 8:00 AM – 9:00 PM (recipient’s local time).
IDBuzz reserves the right to suspend accounts violating these rules.
If a customer violates Opt-in, Opt-out, or content guidelines, the following actions may be taken:
Immediate suspension of SMS services.
Permanent blacklisting of phone numbers used for violations.
Fines under TCPA or CASL regulations.
Legal responsibility for any claims, penalties, or damages resulting from non-compliance.
Customers are solely responsible for their message content & recipient lists.
By signing up for IDBuzz and using SMS services, you confirm that:
You have read and understood this compliance agreement.
You will only send messages to users who have opted in.
You will immediately honor Opt-out requests.
You acknowledge that violations may result in account suspension or legal action.
Our application may request access to your device’s contacts to provide features such as:
Synchronizing and displaying contacts within the app.
Suggesting friends or connections based on your contacts.
We do not collect, store, or share your contacts with third parties without your consent. You can deny or revoke contact access at any time through your device settings.
