Idaho Statute 55-1812 states that it is unlawful for any person to engage in any practices or acts that would be determined as deception, fraud, or misrepresentation towards a buyer of a subdivided land. Being that Idaho classifies timeshare as a subdivided land, timeshare buyers are protected against fraudulent companies in regards to timeshare sales and resale.
According to Idaho Statute 55-1817, no person, salesperson, or real estate broker may sell a timeshare without proper licensing. Under this law, all timeshares in the state or sold within the state are included. If you are contacted by someone wishing to sell your timeshare who is not a licensed broker, please seek legal counsel from a timeshare lawyer.

If you are considering buying or selling a timeshare, it is important to know what the licensing requirements are in the State where you are considering the selling of a timeshare or purchasing a timeshare resale. My advice is to always use a licensed professional when buying or selling a timeshare. By working with a licensed professional you are assured that every transaction is in compliance with the laws of the state where you wish to buy or sell a timeshare and that you will receive the appropriate disclosure statements and rescission period. A licensed timeshare broker is required to provide you with any disclosure statements and inform you of rescission rights for timeshare sales.

If you're thinking about buying a timeshare, or have already bought one, you can better protect yourself by learning about your state's timeshare laws. Many states have laws that require specific timeshare contract disclosures, give timeshare purchasers the right to cancel the contract, and provide special protections for buyers when purchasing a timeshare. Below you can learn some key information about timeshare law in each of the 50 states plus the District of Columbia.
How long do you have to cancel a timeshare purchase? If you have the right to cancel the timeshare purchase, state law will give you a certain number of days to do so. Typically, the cancellation time frame begins on the date you sign the contract or the date you receive certain disclosures (whichever is later). If state law doesn't provide you with the right to cancel, the timeshare contract itself may give you a certain number of days to cancel the transaction.
Are there any special protections for buyers when it comes to timeshare purchases? Another common travel scam is the timeshare resale scam. A timeshare owner who is looking to sell gets a call from someone claiming to be a real estate broker or agent. These scammers claim to specialize in timeshare resales and promise they have buyers ready to purchase. To secure this service, the scammer pressures the target into paying an upfront fee. The timeshare owner pays up, but the reselling agent never delivers.
