TERMS AND CONDITIONS OF USE
1. GENERALITIES
These Terms and Conditions of Use ("Terms") constitute a legally binding agreement ("Agreement") between you ("User") and IADH.
This document describes all the terms and conditions (hereinafter "the Conditions") applicable to the use and access to the contents, functionalities, and services available through the IADH CASE MIX TOOL Application (hereinafter "the Platform") for PC, cell phone, tablet, and other smart devices, as well as application program interfaces, within the territory of the Argentine Republic.
For the purposes hereof, “User” means any natural person who requests the creation of an Account on the Platform.
Prior to registering a User Account, IADH requires that the User be an active member of the association and must read and expressly accept these Terms and Conditions. Acceptance of these Terms and Conditions is done through the electronic means available on the Platform, by clicking on the “I ACCEPT” button after reading the entire document. If the User does not accept these terms and conditions, IADH will immediately reject or revoke the User's subscription request and User Account.
IADH reserves the right to request any information and/or documentation from the User in order to prove his/her identity or other required information and to require the User to provide a holographic, electronic, and/or digital signature of acceptance of these Terms and Conditions.
When you click on accept, you understand that this is a preliminary version of the iADH uCMT and that validation of the tool has not been completed yet.
I understand that all data entries related to patients should be anonymized. The information entered through this web-app will be stored according to Argentinean data protection law #25326 and a research protocol for the use of this information has been approved by CIEIS-Reina Fabiola.
2. ACCESS AND USE OF THE APPLICATION. REQUIREMENTS.
2.1. Access to and use of the Platform requires prior subscription or registration by the User. The User's subscription or registration account is personal, and the User is therefore prohibited from allowing or authorizing third parties to access the Platform through his or her User Account.
2.2. The requirements to be a User of the platform are:
Be over 18 years old.
Be a member of IADH.
IADH may request from the User at any time the documentation that proves compliance with the requirements detailed in this clause. In the event that the User does not adequately prove compliance with the requirements, IADH will reject the User registration request or suspend and/or revoke the User Account.
3. AUTHORIZED USES.
3.1. The User accepts that he/she uses and accesses the Platform voluntarily and undertakes to use it in accordance with the conditions set forth herein, applicable legislation, good faith, and public order.
3.2. The Platform offers a technological solution that gathers and systematizes patient information anonymously, allowing dentists to add information related to patients and their characteristics according to the established protocol.
3.3. The User is permitted to access the Platform and use the functionalities detailed in clause five in accordance with the objectives of the Platform.
3.4. The User is prohibited from any use other than those stipulated herein or that violate the aims and objectives of the Platform. In particular, the User is prohibited from any use for illegal purposes or that harms or impedes, may damage and/or overload in any way, the use and normal operation of the Platform, or that directly or indirectly violates the same or any right of a third party, IADH reserving the right to suspend the Account and prohibit access and use of the Platform if it has reasonable suspicions that the User does not comply with the provisions established herein.
4. WARRANTIES. LIABILITY.
4.1. Responsibility of IADH.
4.1.1 Contents and Services
IADH does not guarantee continued or uninterrupted access and use of the Platform.
The content published on the Platform, whether pharmaceutical products, advertising, or events, belongs to third parties (Laboratories and related companies) outside of IADH.
It is the User's responsibility to verify by their own means the responsibility of uploading data that does NOT identify the patient. For such purposes, IADH provides the User with an alternative mechanism in which no personal data is specified, but only the characteristics of the patient, in accordance with the protocol.
4.1.3 System Failures
The Platform may occasionally be unavailable due to technical difficulties or Internet failures, maintenance reasons, or any other circumstance beyond IADH's control. In such case, IADH will take the necessary measures to restore the operation of the Platform in the shortest possible time.
4.1.4 Access keys
It is the User's responsibility to take care of and safeguard the confidentiality of their access keys and/or passwords to the Platform. IADH does not know or have access to the User's keys and/or passwords. IADH has a key and password encryption system that blocks any possibility of access to the data by IADH, without affecting the access or operation and security of the system.
4.2. Limitation of Liability.
In no event shall IADH be liable for indirect damage, loss of profit, loss of opportunity, or loss of information resulting from the use of the Platform or for technical failures or interruptions in its operation.
5. FUNCTIONALITIES AND CONTENTS.
5.1. The User may access and view the content published on the IADH website linked from the application.
5.2. What data is shared in IADH CASE MIX TOOL?
Through the Platform, the User will be able to share their data with other professionals to interact in the community. The platform does not provide access to messaging but rather makes available the telephone number provided when each user registers on the platform.
6. PROTECTION OF PERSONAL DATA
The collection and processing of personal data of the User will be subject to the provisions of the IADH Privacy Policy.
7. JURISDICTION AND APPLICABLE LAW.
This “Terms of Use and Conditions” contract is subject in all its points to the laws in force in the Argentine Republic. Any controversy derived from this agreement, its existence, validity, interpretation, scope or compliance, will be submitted to the Ordinary Courts of the City of Córdoba, with Users expressly waiving any other jurisdiction that may apply to them, including the federal court.
