Welcome to Hype Reel ("the App"). This Terms of Service agreement ("Terms") is a legal contract between you ("User" or "you") and BELLAVITA PROPERTY LIMITED, LLC ("Company," "we," "us," or "our"), a company located in Cumming, USA.
By downloading, installing, or using Hype Reel, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the App.
1. Description of Service
Hype Reel is a mobile application that provides an AI-powered video generation tool ("Service"). Users can input text prompts, upload images, or provide other digital assets ("Inputs") to generate AI videos, clips, and animations ("Outputs").
2. Eligibility
You must be at least 13 years old (or 16 years old in the European Economic Area/UK) to use this App. By using the App, you represent and warrant that you meet this age requirement and have the full legal capacity to enter into these Terms.
3. In-App Purchases, Subscriptions, and Billing
Hype Reel offers premium features, automated subscriptions, and consumable credits through In-App Purchases (IAP).
A. Subscriptions
Billing: Subscriptions are billed on a recurring periodic basis (e.g., weekly, monthly, or annually) as selected by you at the time of purchase.
Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it or turn off auto-renewal through your mobile platform store account (Apple App Store / Google Play Store) at least 24 hours before the current period ends.
Price Changes: We reserve the right to change subscription fees. Any price changes will take effect at the start of the next subscription period, and you will be notified in advance via the store platform.
B. Consumable In-App Purchases (Credits)
The App may offer consumable virtual items or "credits" used to generate videos.
Credits have no monetary value, do not earn interest, and cannot be redeemed for real currency or transferred to other users.
Unused credits may expire if your account is inactive or if the Service is discontinued, subject to applicable local laws.
C. Refunds and Storefront Management
Third-Party Processing: All payments, transactions, and subscriptions are managed exclusively through the Apple App Store and/or Google Play Store.
No Direct Refunds: BELLAVITA PROPERTY LIMITED, LLC does not directly process payments and cannot issue refunds.
How to Cancel or Request a Refund:
iOS Users: Manage subscriptions in your Apple ID settings and request refunds via reportaproblem.apple.com.
Android Users: Manage subscriptions and request refunds through your Google Play Account settings.
4. User Content and AI Generations
A. Your Inputs and Outputs
Ownership: As between you and the Company, you retain ownership of any raw materials (images, text, videos) you input into the App ("Inputs"), as well as the resulting video content generated by the AI ("Outputs"), to the maximum extent permitted by applicable intellectual property laws.
License to Company: By uploading Inputs, you grant us a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, process, and use your Inputs and Outputs solely for the purpose of providing, operating, maintaining, and improving the Service to you. We do not use your private generations to train public AI models without your explicit consent.
B. AI Generation Disclaimer
You acknowledge that AI video generation is a developing technology. Outputs are generated computationally and may not always be unique. Multiple users entering identical or similar inputs may receive identical or similar outputs.
We do not guarantee the quality, accuracy, uniqueness, or appropriateness of the Outputs.
5. Acceptable Use and Restrictions
You agree that you will not use Hype Reel to create, upload, or share any Input or Output that:
Infringes on the intellectual property, privacy, or publicity rights of any third party.
Contains deeply offensive, defamatory, pornographic, obscene, hateful, or racially or ethnically objectionable content.
Generates "Deepfakes," misleading media, or unauthorized likenesses of real individuals without their explicit consent.
Harasses, abuses, or harms another person.
Attempts to reverse-engineer, decompile, or extract the source code or underlying AI models of the App.
Uses automated systems (bots, scrapers) to extract data from the App.
We reserve the right to suspend or terminate your access to the App immediately if you violate any of these restrictions.
6. Intellectual Property Rights
Excluding your Inputs and Outputs, all rights, title, and interest in and to the App, including its interface, source code, designs, graphics, branding, and underlying technology, are owned exclusively by BELLAVITA PROPERTY LIMITED, LLC and its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use in accordance with these Terms.
7. Disclaimer of Warranties
THE APP AND ITS SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BELLAVITA PROPERTY LIMITED, LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT THE GENERATED OUTPUTS WILL MEET YOUR REQUIREMENTS.
8. Limitation of Liability
TO the MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BELLAVITA PROPERTY LIMITED, LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
9. Governing Law and Dispute Resolution
These Terms and your use of the App shall be governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved in the state or federal courts located near Cumming, Georgia, USA, and you consent to the personal jurisdiction of such courts.
10. Severability and Modifications
Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last Updated" date at the top of this document. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
