Terms of Use (CGU)

1. Application Overview

Welcome to Hopy, a mobile application developed by DE LA PENA Enzo, allowing users to create, organize, and share their wishlists and gift ideas.
By using Hopy, you fully accept these Terms of Use (CGU).

2. Access to the App and Operation

Hopy is a free application and can be used without creating an account.
All data (lists, wishes, responses, preferences) is stored locally on the user’s device.

No registration is required to use the application. As a result:

• Data is not synchronized across multiple devices,
  
  

• Deleting the app or changing devices will result in permanent loss of all data, unless a future manual backup feature is used.

3. Available Services

Hopy allows users to:

• Create and manage wishlists (e.g.: Christmas, birthday, wedding, etc.),
  
  

• Add custom wishes (products, links, ideas, photos, etc.),
  
  

• Organize gift ideas in any way they like,
  
  

• (Premium features) Collaborate, share, and receive alerts on their lists.
  
  

Features may be added, removed, or modified at any time.

4. Business Model & Freemium Subscription

Hopy is free to download and use. Some advanced features are available through an optional premium subscription, with pricing and benefits clearly displayed before purchase.

The premium subscription includes:

• Access to exclusive features (sharing, collaboration, alerts, etc.),
  
  

• An enhanced, unrestricted experience,
  
  

• Support for the ongoing development of the app.
  
  

Payment terms:

• Payment is handled by Apple (App Store) or Google (Play Store),
  
  

• Subscription renews automatically unless canceled at least 24 hours before the end of the current period,
  
  

• Subscription can be managed or canceled from your Apple/Google account settings,
  
  

• No partial refunds are provided for already started billing periods.
  
  

5. Affiliate Links and Partnerships

Some parts of Hopy may include external links, particularly to merchant websites such as Amazon.
Some of these links may be affiliate links, meaning that Hopy may earn a small commission if you make a purchase through them.

These commissions do not affect the price you pay and are used to support the app’s development.
Hopy is not responsible for the content, availability, or terms of external websites.

6. Personal Data & Privacy

Hopy does not require registration or personal data to function.
However, certain data is stored locally on your device to ensure the app works properly, including:

• Your lists and wishes,
  
  

• Your display preferences and onboarding answers.
  
  

This data is never transmitted to external servers without your explicit consent.

You may request the deletion of all local and stored data (if applicable) by emailing: hopy.app.contact@gmail.com

Hopy complies with the General Data Protection Regulation (GDPR).

7. User Content & Intellectual Property

All content you create in Hopy (lists, wishes, texts, photos, etc.) fully belongs to you.
However, adding or sharing content assumes you have the rights to use the materials you include (text, images, links, etc.).

The Hopy name, logo, and brand identity are the exclusive property of DE LA PENA Enzo.
Any unauthorized reproduction or use is strictly prohibited.

8. Liability

Hopy aims to provide a reliable experience but does not guarantee:

• The accuracy or availability of external products linked within wishes,
  
  

• Continuous app operation on all devices,
  
  

• Preservation of data following deletion of the app or device change without backup.
  
  

Hopy cannot be held responsible for data loss, misuse, or issues resulting from external links (Amazon, etc.).

9. Usage Rules

Users agree to:

• Use Hopy for personal purposes only,
  
  

• Not upload illegal, offensive, or copyrighted content without authorization,
  
  

• Not misuse the app or divert it from its intended purpose.
  
  

Hopy reserves the right to restrict or block access for users who violate these rules.

10. Data Deletion

To delete all data associated with the app, send an email to:

including:

• The name of your device,
  
  

• And, if applicable, your temporary identifier (username).
  
  

Deletion will be completed within a maximum of 30 days from the request.

11. Governing Law & Jurisdiction

These Terms of Use are governed by French law.
Any dispute relating to their interpretation or execution will fall under the jurisdiction of French courts.
