Hona's Terms and Conditions

Hona is a mobile application by Creative Apps LLC , ("Creative Apps", "we", and "us")! The application as a whole and all rights, titles, and interests in and to the application are owned by the Creative Apps LLC. These terms ("Terms") were last updated on August 01, 2018, and the Creative Apps team reserves the right to change and update them without warning or notification.


PLEASE REVIEW THE TERMS AND CONDITIONS BELOW CAREFULLY BEFORE USING THE APPLICATION.


OUR AUDIENCE

Hona is intended for by people who are 13 years of age or older. You represent and warrant that you are at least 13 years of age. If you are under age 13, you may not, under any circumstances or for any reason, use Hona. We may, in our sole discretion, refuse to offer the Hona application to person or entity and change its eligibility criteria at any time


USAGE DATA


WHAT YOU CANNOT DO WITH THE APPLICATION

In addition to the other restrictions outlined in these terms, when using the Hona application, you agree to not:

1- Use any data mining or extraction methods in relation to the application;

2- Interfere with or hinder the operation of the application or any other individual's

use of the application in any way;

3- Inflict or impose any perverse or excessive burden on the application in any way; 4- Compromise the security of the application;

5- Use the application for any purpose that is illegal, beyond the scope of the application's intended use, or prohibited in these terms;

6- Distribute spam contains expletives or language which could be deemed offensive or is likely to harass, upset, embarrass, alarm or annoy any other person is obscene, pornographic or otherwise, may offend human dignity; .is abusive, insulting or threatening, or which promotes or encourages racism, sexism, hatred or bigotry; encourages any illegal activity including, without limitation, terrorism, inciting racial hatred or the submission of which in If constitutes committing a criminal offence; is defamatory; involves the transmission of "junk" mail or "spam, contains any spyware, adware, viruses, corrupt files, worm programs or other malicious code designed to interrupt, damage or limit the functionality of or disrupt any software, hardware, telecommunications, networks, servers or other equipment, Trojan horse


or any other material designed to damage, interfere with, wrongly intercept or expropriate any data or personal information whether from Hona or otherwise; or .itself, or the posting of which, infringes any third party's rights (including, without limitation, intellectual property rights and privacy rights) .Please use your common sense when picking the content that you choose to post on or send via Hona because you are solely responsible for, and bear all liability in relation to, such content



WHAT YOU SHOULD NOT POST

You should not display any personal contact or banking information on Hona whether in relation to you or any other person (for example, names, home addresses or postcodes, telephone numbers, email addresses, URLs, credit/debit card or other banking details). If you do choose to reveal any personal information about yourself to other users, itis at your own risk. We encourage you to use the same caution in disclosing details about yourself to third parties online as you would under any other circumstance

RIGHT TO MONITOR AND REMOVE

We reserve the right, but not the obligation, to monitor all conduct on and content submitted to Hona.

  • suspend or revoke your registration (where applicable) and your right to access and/or use Hona or submit any content to Hona; and
  • make use of any operational, technological, legal, or other means available to enforce the Terms (including without limitation blocking specific IP addresses)

We will try (but we are not obliged) to notify you if your access to Hona and/or your HonaProfile is to be or has been suspended or terminated


ACCOUNT SECURITY

After opening an account in the Hona mobile application, you accept all responsibility for any activity that occurs while logged into your account. Subsequently, you alone are responsible for making sure that your account information including your username and password is kept secure and safe. In the event that your Hona account is compromised please notify the Creative Apps team immediately at support@honaapp.com



INTELLECTUAL PROPERTY

Unless otherwise stated, all materials on the Hona mobile application, including, but not limited to, text, graphics, images, illustrations, designs, icons, photographs, video clips and written and other materials that appear as part of the application, as well as their selection and arrangement are protected by copyright, trademark, trade dress, patent, and or other intellectual property laws, and any unauthorized use of this content violates such laws and these terms. Except as expressly provided herein, Creative Apps does not grant any express or implied rights to use this content. By agreeing to these terms you agree that you will not copy, reproduce frame, download, modify, reverse sell, or participate in any sale of, rent, lease, loan, assign, distribute, license, sublicense, or exploit in any way, in whole or in part, any of the content, the application or any related software, except as expressly provided herein. You may re-publish, transmit or display content from Hona ONLY in the context of sharing your experience with your social network.

Please note though that by posting or sending content on Hona you represent and warrant to us that you have the right to do so, and automatically grant to us a non-exclusive, royalty free, perpetual, worldwide license to use such content in any way (including, without limitation, editing, copying modifying, adapting, translating, reformatting, creating derivative works from, incorporating into other works advertising, distributing and otherwise making available to the general public such content, whether in whole on in part and in any format or medium currently known or developed in the future).

We may assign and/or sub-license the above license to our affiliates and successors without any further approval by you By submitting content to Hona you are warranting that you are the exclusive author and owner of that content and you agree that you waive any and all moral rights relating to that content (including, without limitation, the right to be identified as the author). We have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to Hona constitutes a violation of their intellectual property rights or of their right to privacy or any other law.

We also grant you a limited, non-exclusive license to access and use Hona for your own personal, non-commercial purposes. This license is personal to you and may not be assigned or sublicensed to anyone else. Except as expressly permitted by Creative Apps in writing, you will not reproduce, redistribute, sell, create derivative works from, decompile, reverse engineer, or disassemble Hona. All rights not expressly granted by us are reserved


INDEMNIFICATION

By agreeing to these terms you agree to indemnify, defend and hold harmless Creative Apps, its managing members, shareholders, employees, subsidiaries, affiliates, licensors and suppliers from and against any and all complaints charges, claims, damages, losses, costs, liabilities, and expenses (including attorneys' fees) due to, arising out of, or relating in any way to your use of the application.




LIMITATION OF LIABILITY

EXCEPT WHERE PROHIBITED BY LAW, IN NO EVENT WILL Creative Apps OR ANY OF ITS AFFILIATED ENTITIES BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, EXEMPLARY COMPENSATORY, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM-1) THE USE OF, OR INABILITY TO USE, THE APPLICATION; 2) THE PERFORMANCE OF THE SERVICES AND MATERIALS AVAILABLE FROM THE APPLICATION; OR 3) THE CONDUCT OF OTHER USE OF THE APPLICATION, EVEN IF Creative Apps HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR LIMITATION OF LIMITATION OF LIABILITY EXTENDS WITHOUT LIMITATION TO: BODILY INJURY, DEATH, EMOTIONAL DISTRESS, AND/ OR ANY OTHER DAMAGES RESULTING FROM COMMUNICATIONS OR MEETINGS WITH OTHER Hona USERS OR PERSONS YOU MEET THROUGH Hona. YOU AGREE TO TAKE REASONABLE PRECAUTIONS IN ALL INTERACTIONS WITH OTHER USERS OF THE SERVICE, PARTICULARLY IF YOU DECIDE TO MEET OFFLINE OR IN PERSON. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER Hona USERS. YOU UNDERSTAND THAT WE DO NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON USERS WE DO NOT INQUIRE INTO THE BACKGROUNDS OF USERS OR ATTEMPT TO VERIFY THE STATEMENTS OF USERS. WE MAKE NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF USERS OR THEIR COMPATIBILITY WITH ANY CURRENT OR FUTURE USER.


You are responsible for providing your own access to Hona. We have no obligation to screen or monitor any content and do not guarantee that any content available on Hona complies with this Agreement or is suitable for all users. You assume total responsibility for your use of the application. Your only remedy against Creative Apps for dissatisfaction with the application or any content is to stop using the application. If, notwithstanding the terms, Creative Apps is found liable to you for any damage or loss which arises out of or is in any way connected with your use of the application or any content, Creative Apps liability shall in no event exceed $1.00. YOUR REPRESENTATIONS


YOUR REPRESENTATIONS

For each piece of content that you submit, you represent and warrant that: (i) you have the right to submit the content to Hona and grant the licenses set forth hereunder, (i Hona will not need to obtain licenses from any third party or pay royalties to any third party; (ii) the content does not infringe any third party's rights, including intellectual property rights and privacy rights, and (iv) the content complies with this Agreement and all applicable laws



User Content

We strictly prohibit any user-generated content which may become sexually explicit or objectionable in any manner. We have zero tolerance to objectionable content. We use moderators to flag and remove inappropriate content. We encourage users to report objectionable content and the users who generate this content. We will act on these reports within 24 hours by removing the content and ejecting the user who provided the offending content. If we find any of your content inappropriate or objectionable it will be removed from the application within 24 hours without giving any prior notice and you will be ejected from the application. That includes but is not limited to unethical, sexually explicit, depictions of sex acts or nudity that is sexually provocative or in a sexual context, and graphic depictions of sexual arousal. You understand that by using any of the Services, You may encounter content that may be deemed offensive, indecent, or objectionable, which content may or may not be identified as having explicit language, and that the results of any search or entering of a particular URL may automatically and unintentionally generate links or references to objectionable material. Nevertheless, You agree to use the Services at Your sole risk and that the Application Provider shall not have any liability to You for content that may be found to be offensive indecent, or objectionable.


OUR REPRESENTATIONS

We provide Hona on an "as is" and "as available" basis. You therefore use Hona at your own risk. Hona expressly disclaims any and all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose non-infringement, and any other warranty that might arise under any law. Without limiting the foregoing, we make no representations or warranties:


-That Hona will be permitted in your jurisdiction,

-That Hona will be uninterrupted or error-free .

- Concerning any content submitted by any user;

- Concerning any third party's use of content that you submit,

- That any content you submit will be made available on Hona or will be stored by Hona;

- That we will continue to support any particular feature of Hona

- Concerning sites and resources outside of Hona, even if linked to/from Hona.

To the extent any disclaimer or limitation of liability does not apply, all applicable express, implied, and statutory warranties will be limited in duration to a period of thirty (30) days after the date on which you first used Hona, and no warranties shall apply after such period.




CONTROLLING LAW AND SEVERABILITY

This agreement, as well as the Hona privacy policy, shall be construed in accordance with the laws of the State of California. Any subsequent dispute arising under the terms of this agreement will be settled exclusively in the state/federal courts of the State of California, county of San Francisco, and/or the Northern District of California.


INTERNATIONAL USERS

If you are a User accessing Hona from the European Union, Asia, South America or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please be advised that through your continued use of Hona is governed by U.S. law, and our Terms of Service. You hereby acknowledge you are transferring your personal information to Creative Apps and you consent to that transfer


COMPLIANCE WITH LAWS

You warrant that you have the right, authority and capacity to enter into and be bound by these terms and that by using Hona you will not be violating any law or regulation of the country in which you are resident. You are solely responsible for your compliance with all applicable local laws and regulations


RIGHT TO UPDATE

We reserve the right to modify, amend or change the Terms at any time (a "Change"). In certain circumstances, we may send an email to you notifying you of any Change. You should regularly check this page to take notice of any Changes. If you do not accept any Change to the Terms, you should stop using Hona immediately. Your continued use of Hona following any Change constitutes your acceptance of the Change and you will be legally bound by the new updated Terms.


USE AT YOUR OWN RISK

Your safety and security are very important to us. The nature of Hona promotes the sharing of personal information by users with other users. Hona cannot and does not assure that it is safe for you to have direct contact with other users. Current technological developments make it possible for users of the Internet to obtain personal information about and locate, other users, with very little other information. If you believe that any user is harassing you or is otherwise using personal information about you for unlawful purposes, we encourage you to first inform local law enforcement authorities and then to contact us so that we may take appropriate action to block further use of Honaby any user who is using Hona App information obtained from it for improper purposes.



COMPLETE AGREEMENT

These terms supersede all prior understandings regarding the same and represent the complete agreement between you and the Creative Apps team. No changes or amendments to these terms will be binding unless in writing and signed by us

Information Automatically Collected Through

our Mobile App


Additionally, we collect usage information and information about your device. This information allows us to understand how users access and utilize the mobile application Once a user has downloaded and started using Hona, we automatically collect information such as the model, manufacturer and version of device used, device identifiers, and time-stamped logs of messages sent and received including sender and recipient and data exchanges, and network status. We use all of this information to investigate trends and to restructure and improve the Hona application. We also detect when users take actions relating to messages as further described below.


User Data

When you send or receive any data using Hona, we may store your data on our servers for a period of time. Data, therefore, is sent at the risk of the user. We also log information about data, including time, date, and who sent and received)the data. We also collect and use aggregated or de-identified information. We may also collect information from other sources and associate that with any of the information described above. The data information we collect is stored on our servers.


USE

Our use of personal information collected through our app includes:

When you create a user name, we create a public profile with that username where users can contact you If the contact information you used to setup Honais in a friend's address book, they can tell whether you are a Hona user when they sync their address books with Hona Please be mindful of your own privacy needs as you choose who to connect with and what to share. We cannot control the privacy or security of information you choose to share with others. 1. Hona USERS AND VISITORS TO OUR APP

What information does Hona collect if I decide to join the Hona social community?



Hona is a meeting place for responsible persons, and we provide that service by operating a social network app offering users the opportunity to communicate with our global community of users To join the Hona network you will have to register using Facebook sign up or complete our registration form, where we ask you to provide us with information about you such as your name, your email address, your gender, your date of birth, your location details. You may have the opportunity to provide other details about yourself, but these are optional.

You control your user profile, these details are available to you at any time by accessing your "Profile" page, which gives you the chance to correct or update (other than gender, date of birth and email address) your information at any time by just logging in to Hona. Once you have created a Profile, we will automatically track certain information such as your IP, location and email addresses.


What information does Hona collect about me if I'm under 13?


You can only become a member of Hona if your aged 13 or over. We comply with the Children's Online Privacy Protection Act (COPPA), which requires that you be 13 or older to use Hona. We use your birth date to verify that you meet this age requirement. That means Hona does not knowingly collect any information about children, minors or anyone under the age of majority. Nor do we knowingly market to children, minors or anyone under the age of 13. If you are less than 13 years old, we request that you do not submit information to us. If we become aware that a child minor or anyone under the age of 18 has registered with usS and provided us with personal information, we will take steps to terminate that person's registration and delete their Profile information from Hona. If we do delete a Profile because you violated our no children rules, we may retain your email and IP address to ensure that you do not try to get around our rules by creating a new Profile.


If I put personal information about me on Hona, what does Hona do with it?


Hona is designed to make it easy for you to find, connect and interact with other members of Hona by posting information about yourself. You can also use our messaging system, which allows you to communicate with other users. We encourage you to think carefully about the information you disclose. We also do not recommend that you put email addresses, URLs, messaging details, phone numbers, full names or addresses, credit card details, national identity numbers, drivers' license details and other sensitive information in your Profile which is open to abuse and misuse. Remember that photographs or any video clips that you post on Hona may reveal these kinds of sensitive personal data. Where you do upload and choose to tell us sensitive information about yourself, you are explicitly consenting to our processing your information and making this public to other users. When you post information about yourself or use the messaging, the amount of personal information you share is at your own risk If you post anything that is inconsistent with our Terms and Conditions, we reserve the right to terminate your account.


What does Hona collect about me?

When you use Hona, we will collect information about WiFi access points as well as other location information about your longitude and latitude. That information helps us identify your physical location so that it can be displayed and shared with other members choosing to view "nearby" posts

Can Hona collect information about me from other sites I use, such as Facebook?

If you have registered using one of our partners, such as Facebook, your Profile information will be available to all users of the Hona. Remember that when you register with a Hona partner, you are also sharing with them and Hona personal information, we recommend that you read their privacy policies as Hona does not control how they use their information. If you have registered on one of our partner websites, such as Facebook, or you have verified your account via a partner website, we may connect your Hona profile with your profile on such partner website. We may do this by way of new products and applications which we introduce from time to time Does Hona collect any other personal information about me? If you contact our Customer Support team via support, we may receive your email address, phone number and may track your IP address as well as the information you give to us to help resolve your query. We will keep records of our communications with you, including any complaints that we receive from you about other users and from other users about you

In "Settings" Hona offers you the opportunity to receive notifications from us about changes or other purposes related to the use of the application


Does Hona use my personal information for any other purpose?


We may use material that you post on the open access areas of Hona in advertising and promotional materials with our partners and partner products. We believe these uses allow us to improve our site and better tailor your online experience to meet your needs. We use your personal information to resolve disputes, troubleshoot problems and enforce our Terms and Conditions



2. FRIENDS AND OTHER Hona USERS


When I put information about myself on Hona, what do the other users see?

Use it to meet new friends and make new contacts. You may not use other users' information for commercial purposes, to spam, to harass, or to make unlawful threats. Hona reserves the right to terminate the accounts of those who misuse other users information or who otherwise violate the Terms and Conditions.


What information does Hona collect about my friends and contacts?


If you want to invite your friends and contacts to become a Hona member, we will send a notification or a message invitation from Hona in your name to your friends and contacts to sign up to Hona. If any of the individuals you have invited do not register within a few days Hona may occasionally send reminder notification or message on your behalf to those individuals. When we send a notification or message invite to your friend or contact, we store their name, email address and their mobile number. Hona does not sell these email addresses or mobile numbers or use them to send any other communication besides invitations. The friend may contact Hona to request the removal of thein information from our database by visiting Support. Any such request will only apply to addresses or mobile numbers we have at the time of the request and not to any addresses that is provided to us later




3. THIRD PARTIES


Does Hona sell my information to other parties?

We do not sell or rent out any personal information about you to any third party. Hona discloses aggregated non-personal data for marketing and promotional purposes. That means we do not disclose any information that could be used to identify you.


Does Hona disclose my information to other parties?

We may share aggregated information that includes your personal information but which doesn't identify you directly, together with other information including log data with third parties for industry analysis and demographic profiling and to deliver targeted advertising about other products and services. In relation to targeted advertising, we use third-party advertising companies to serve ads when you visit. These companies may use information about your visits to this and applications in order to provide advertisements about goods and services of interest to you Hona maintains a healthy community, we will cooperate with law enforcement inquiries and with third parties to enforce their intellectual property or other rights. Where is my personal information kept?

Hona is a global website operating through servers located in a number of countries around the world. If you live in a country with data protection laws, the storage of your personal data may not provide you with the same protections as you enjoy in your country of residence. By submitting your personal information, or by choosing to upgrade the services you use, or by making use of the applications available on Hona, you agree to the transfer of your personal information to, and storage and processing of your personal information in, any such countries and destinations.

How does Hona protect my personal information?

Hona has implemented reasonable and appropriate security measures to protect and prevent the loss, misuse, and alteration of the information under our control, including your personal information. Hona uses reasonable security measures to safeguard the confidentiality of your personal information While we take reasonable precautions against possible security breaches of our application, member database and records, no application or Internet transmission completely secure and we cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur. We urge you to take steps to keep your personal information safe and to log out of your account after use. We cannot guarantee the security of your personal data while it is being transmitted to our application and any transmission is at your own risk. Once we have received your information we have procedures and security features in place to try to prevent unauthorized access.


How do I help keep my information secure?

You may not disclose or share your password with any third parties. If you lose your password or give it out your personal information may be compromised. If that happens, report it to Support via Support link. You must change your password immediately via your "Settings". Hona cannot be held responsible for your failure to keep your password secure and failure to do so may violate our Terms and Conditions.


6. YOUR RIGHTS


How do I change my Profile?

You can review and revise your profile information at any time. Once you register, you will be able to review and change much of your personal information including: contact email, images, city, region, country, and password. Users in certain jurisdictions are, in accordance with applicable law, entitled to exercise a right of access to personal information about themselves by asking for a copy of the information we hold about them (for which, where allowed by law, we may charge a small fee). Please put any such request in writing and contact Support. If you want to stop using your account it will be initially deactivated. This means that no user will be able to search for you on the website although they may still see you profile from direct cached links, but it will not be deleted.
