Terms of Service
Please read carefully before purchasing any of my services!
General
By purchasing my art services, you acknowledge and agree to my Terms of Service.
Reposting or sharing the artwork is permitted, provided that proper credit is given to me (@hiyoko.the.oko)
I can decline your commission or offer for my adopts for any reason.
I retain all artistic copyright over my original work and reserve the right to use the image as a sample for self-promotion, inclusion in my portfolio, or sharing on my social media platforms, while crediting you as the rightful owner.
The use of any of my artwork, including commissions or adopts (as well as my personal work), for commercial purposes is strictly prohibited unless agreed upon. If we come to an agreement for a commercial use, an additional charge of 50% of the original price will apply
The use of any of my artwork/commission for the purpose of AI training or NFT is strictly prohibited.
Payment
The only currencies I accept is EURO and CZK
Payments are to be made through PayPal, Ko-fi, or VGen only.
I will not continue working on your commission until the payment has been made and the money is seen on my PayPal, Kofi or VGen account.
If you chargeback through PayPal, Ko-fi, VGen, or any platform used for the transaction after the commission or adopt has been paid for (whether completed or still in progress) and you'll obtain the money back. You will lose all rights to the ownership of the commissioned piece (please note, this applies specifically to the commissioned artwork and not to any original characters the individual already owns) and I will retain ownership of the commission/adopt and do with it as I see fit. (example: sell it)
For commissions under 50€, full payment is to be made before any work is done. Also known as 100% upfront.
For commissions over 50€, payment is to be made in 50/50 (50% beforer any work is done, and the remaining 50% after the final sketch stage). The percentage of each 50/50 could differ based on complexity of your commission.
For surprise me commissions, full payment is to be made before any work begins. Also known as 100% upfront.
You may be asked to pay additional charge for sketches, flat colors, render if the limit of free changes included in the original price of your commission are exceeded.
Pricing for backgrounds changes depending on the complexity and type of the background.

Sketches
--> First 5 sketches are FREE, for additional sketches you'll be asked to pay 2€ per one
Flat colors
--> First 3 recolors are FREE, for additional recolors you'll be asked to pay 5€ per one
Render
--> In the case your comission is still being worked on or is finished and you ask for a small change, you'll be asked to pay 5€ per one.
--> In the case your comission is still being worked on or is finished and you ask for a big change, you'll be asked to pay 10€ per one.

Transparent
--> Transparent backgrounds are FREE
Solid color
--> Solid color backgrounds are FREE
Scene art
--> Scene art commissions are ranged between 100€+ and 250€+ and more depending on the complexity of your order
Other
--> Backgrounds which are not either transparent, solid color, couple of colors or scene art are to be discussed pricewise separately. Final price of 'other' background will depend on the complexity of your order.
I do not accept refunds for any purchases.
However if circumstances such as rude/disrespectful behavior from the client, lack of communication, personal matters in my private life or matters that would not allow me to continue working on your commission any further, should occure I do reserve the right to cancel your commission. These situations are rare, and I always strike to maintain a professional and positive working relationship with the client. However if I must cancel your commission after the payment has been made, a refund will be issued based on the type / progress / type of payment of the commission:
Percentage of each refund may alter depending on the type of commission you purchased.
Bellow 50€ (100% upfront)
--> 0/4 commission hasn't began but you already paid the whole payment: 100% refund
--> 1/4 one third of the commission has been done: 70% refund
--> 2/4 half of the commission has been done: 50% refund
--> 3/4 two thirds of the commission has been done: 30% refund
--> 4/4 commission has been finished: 0% refund
Above 50€ (50/50)
--> 0/3 commission hasn't began but you already paid 1st half: 100% refund
--> 1/4 one third of the commission has been done, you paid for 2nd half: 70% refund.
--> 2/4 half of the commission has been done: 50% refund
--> 3/4 two thirds of the commission has been done: 30% refund
--> 3/3 commission has been done: 0% refund
Owner - adopts
Once purchased, you, as the new owner, will receive the PNG format of your adopt without a watermark.
You cannot claim the character as your creation. While the character is now your property, I will always retain credit as the creator of the original design.
You may make modifications to the character as you see fit.
You may trade or gift the characters to others
You may resell the character for the price you bought it for. If you have made upgrades to the design, you are free to sell the character for a price that reflects the value of your additions.
During the course of working on your commission, I assure you that I will not alter the Terms of Service to my advantage. Should any changes occur after the completion or while working on your commission occure, the previous Terms of Service will continue to apply to your commission.
