Herz acts solely as an intermediary, enabling users to explore and engage with various product providers but does not itself provide these products. Herz does not own, operate, or manage any of the product providers listed on its platform. Users acknowledge that Herz is not responsible for the quality, compliance, or legality of products provided by third parties.
Article One - Definitions:
Herz Platform: The digital platform operated by Herz Information Technology Company, including mobile applications and websites.
Product Provider: A business or individual offering products via Herz.
Consumer: Any user utilizing Herz to purchase products from product providers.
Agreement: The terms, conditions, and policies governing the use of Herz.
Third-Party Services: External partners integrated into Herz for payment processing, logistics, or additional support.
Article Two - Nature of Herz’s Commitment:
Herz acts as a digital intermediary between consumers and product providers.
Herz does not verify, control, or guarantee the products offered by providers.
Product providers are solely responsible for compliance with applicable regulations and product quality.
Herz does not assume liability for disputes, damages, or issues arising from purchases made via its platform.
Article Three - User Responsibilities:
Users must provide accurate personal information when registering.
Users must ensure the security of their accounts and passwords.
Users agree to use Herz only for lawful and legitimate purposes.
Fraudulent activity, misuse, or disruption of Herz services may result in account suspension.
Article Four - Product Provider Obligations:
Product providers must comply with all applicable laws and industry regulations.
They are responsible for providing accurate descriptions and ensuring product quality.
Herz reserves the right to remove or suspend providers who violate platform policies.
Product providers must clearly state their refund and exchange policies on their store pages. Herz assumes no liability for refund or exchange decisions.
Article Five - Payments and Fees:
Payments are processed through Herz’s integrated payment gateways.
Herz does not guarantee refunds or cancellations but may facilitate communication between consumers and providers.
Service providers set their own pricing.
Herz reserves the right to adjust platform fees as needed.
Article Six - Limitations of Liability:
Herz does not guarantee product quality, availability, or timeliness.
Herz is not liable for damages, losses, or disputes between consumers and providers.
Fraudulent transactions, including unauthorized chargebacks, are strictly prohibited and may result in legal action.
Herz shall not be held liable for delays, failures, or interruptions in service caused by force majeure events, including but not limited to natural disasters, acts of war, government actions, labor strikes, technical failures, or any other events beyond Herz’s reasonable control.
Article Seven - Delivery of Products:
Herz facilitates product delivery through third-party logistics providers.
Product providers are responsible for the timely preparation and dispatch of products.
Delivery timelines vary based on location and provider policies.
Herz is not liable for delays, damages, or failures in delivery caused by third-party logistics providers.
Consumers should directly contact product providers or logistics partners for delivery issues.
Herz reserves the right not to refund customers in cases where:
The delivery agent arrives at the location but cannot reach the customer within 15 minutes.
Access to the delivery location is restricted (e.g., hospitals, compounds, military zones, hotels, universities).
The customer changes their location after the allowed time for order cancellation.
Article Eight - Privacy and Data Protection:
Herz is committed to protecting user data in accordance with its Privacy Policy.
Personal data may be shared with product providers as necessary to facilitate orders.
Article Nine - Account Suspension and Termination:
Herz may suspend or terminate accounts violating platform policies.
Fraudulent or unethical activities will result in permanent bans.
Providers failing to meet compliance or quality standards may be removed.
Article Ten - Governing Law & Dispute Resolution:
These terms are governed by the laws of the Kingdom of Saudi Arabia.
Herz will not mediate disputes but may assist as a facilitator.
Consumers are encouraged to resolve disputes directly with product providers.
Article Eleven - Amendments to Terms & Intellectual Property:
Herz reserves the right to modify these terms at any time without prior notice.
Continued use of Herz constitutes acceptance of the modified terms.
All content, including product descriptions and platform materials, is the intellectual property of Herz. Unauthorized use or distribution is prohibited.
