1. Acknowledgement
This End User License Agreement ("EULA") is a legal agreement between you and the developers of Heartia. This EULA governs your use of the Heartia application (the "App"). This EULA is concluded between us, and not with Apple. We, not Apple, are solely responsible for the App and its content.
2. Scope of License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial health management purposes. This license does not allow you to use the App on any device that you do not own or control.
3. Health Data & Sensitivity
You acknowledge that the App may process data related to your health and fitness ("Health Data"). This data is particularly sensitive and is handled with the highest standards of protection as outlined in our Privacy Policy. By using the App, you consent to the processing of your Health Data solely for the purposes of providing the App's core functionality.
4. Not a Medical Device
THE APP IS INTENDED FOR HEALTH AND WELLNESS MANAGEMENT PURPOSES ONLY. IT IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR HEALTH CONDITION. YOU SHOULD ALWAYS CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL FOR ANY PERSONAL HEALTH ADVICE OR BEFORE MAKING ANY HEALTH-RELATED DECISIONS.
5. Maintenance and Support
We are solely responsible for providing any maintenance and support services for the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
6. Warranty and Liability
The App is provided "as is". We are solely responsible for any product warranties. To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App or reliance on its data. Apple will have no warranty obligation whatsoever with respect to the App.
7. Intellectual Property Rights
You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
8. Legal Compliance
You represent and warrant that you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a "terrorist supporting" country.
