After the Court Hearing on September 02, 2016, Cornell asked for time to make a submission to the Court.
Cornell submitted the following documents on September 16, 2016. In this document, Thomas D'Antonio and Wendy Tarlow (Cornell's lawyers) made several false statements to the court. For example,
1. They repeated the lie that the Tenure committee 'found no issues' with Gretchen Ritter's denial of Prof. Vengalattore's tenure. (In reality, the Tenure committee had clearly stated in March 2016 that the tenure process 'continues to suffer from serious deficiencies following Ritter's actions').
2. They claimed that the tenure committee had given 'no specific direction' to Ritter on how to address the severe flaws in her tenure decision. (In reality, their report clearly instructed Ritter to address the impact of discrimination against Prof. Vengalattore's research group, the role of false allegations in prejudicing the votes of the faculty, and to resolve the false allegations in accordance with Cornell policies. Ritter arbitrarily refused to follow any of these instructions and gratuitously lied to the Court claiming she was 'unaware' of these directions).
3. Michael Fontaine submitted another false affidavit under instructions from the Cornell lawyers claiming that the 'amended policy' that circumvented scrutiny of the process by an external committee was his own idea. (In reality, this 'amended process' was concocted by Ritter to evade scrutiny of her illegal actions.)
There was no action taken against Ritter, Fontaine and others for their perjury. However, the Court saw through these lies and ruled in favor of Prof. Vengalattore, calling the entire tenure process 'flawed, secretive' and in such denial of Prof. Vengalattore's due process rights as to be 'arbitrary and capricious'.
