While both sides agree that King was speeding in Claremont and had illegal drugs in her system before the fatal crash on April 23, 2016, the county attorney is taking exception to remarks made by the judge at sentencing.

Judge Brian Tucker cited King's lack of a criminal record and her taking responsibility for her actions as factors in her favor, and he also stated that her addiction is a mitigating factor, a view Sullivan County Attorney Mark Hathaway vehemently rejects.

The Kings have two children in high school. Jacob King said they are dealing with it, and he is planning on taking them back to Texas, where the couple is from, until Amber King is out of prison.
