本アプリの利用には、Apple標準のEULA[https://www.apple.com/legal/internet-services/itunes/dev/stdeula/]に加え、以下の独自利用規約が適用されます。

[１.目的、定義、同意]

本アプリをダウンロードおよび利用することで、ユーザーは本利用規約およびプライバシーポリシーに同意したものとみなされます。

本利用規約およびプライバシーポリシーは、必要に応じて予告なく変更されることがあります。変更後も本サービスの利用を継続することで、ユーザーは変更に同意したものとみなされます。

一 本利用規約（以下「本規約」）は、開発者（以下「当方」）が提供するアプリ（以下「本サービス」）の利用条件を定めるものです。

二 本サービスは、本サービスは、ユーザーの写真・動画、メモ（以下「コンテンツ」）を記録・管理するためのローカル（端末内）完結型アプリです。

三 記録したコンテンツに「閲覧期限」を設定し、期限終了後に自動でデータを削除する機能、およびアプリ起動を制限するパスワード機能を提供します。

四 ユーザーは、本サービスを利用することにより、本規約および別途定めるプライバシーポリシーに同意したものとみなされます。

[２.禁止事項]

ユーザーは、本サービスの利用にあたり、以下の行為を行ってはなりません。

一 本サービスを本来の目的以外の目的で利用すること。

二 法令に違反する行為、犯罪行為、またはそれらを助長・勧誘する行為に本サービスを利用すること。 

三 児童ポルノ、児童虐待、または公序良俗に反するコンテンツを保存・管理すること。 

四 第三者の著作権、肖像権、プライバシーその他の権利を侵害する行為（他人の情報を無断で撮影・記録する等）。

二 本サービスに含まれるソフトウェア、デザイン等の複製、改変、リバースエンジニアリング、逆コンパイル、ソースコードの抽出を試みる行為等、知的財産を侵害する行為

三 本サービスの一部または全部を販売、譲渡、または再許諾する行為。

四 本サービスに対し、ウイルス・マルウェア等に感染したファイルを送信する行為。

[３.アプリの停止・変更について。]

当方は技術的・運用上の都合またはその他の理由（規約・プライバシーポリシーの変更を含む）により、本サービスの内容を自由に変更、アップデート、中断、または終了できるものとします。

 [４.データ管理とプライバシー]

一  本サービスで作成されたコンテンツは、ユーザーの端末内のみに保存されます。当方がユーザーのデータをサーバー等に収集、保存、または閲覧することはありません。

二 自己責任の原則: 端末の紛失、故障、機種変更、またはアプリの削除に伴うデータの消失について、当方は一切の責任を負いません。必要なバックアップはユーザー自身の責任で行うものとします。

[５.重要事項（自動削除・パスワード）]

一 自動削除: ユーザーが設定した期限に基づき実行されるデータ削除は、その処理の性質上、削除後の復元が不可能です。期限設定の誤り等によるデータ消失について、当方は一切の責任を負いません。 

二 パスワード管理: ユーザーが設定したパスワード（パスコード等）を紛失した場合、セキュリティの都合上、当方がパスワードを解除したりデータを復旧したりすることはできません。

[６.免責事項]

一 機能の保証: 当方は、自動削除機能およびパスワード機能が、あらゆる環境下で不具合なく動作することを保証しません。 

二 トラブル: 本サービスの利用、または利用できなかったことによりユーザーに生じた損害（データの消失、パスワード紛失によるアクセス不能等）について、当方は一切の責任を負いません。

三 犯罪利用に関する免責: ユーザーが本サービスを犯罪行為または法令違反に利用した場合、それにより生じた一切の不利益および損害について、当方は一切の責任を負いません。

四 法的機関への情報提供: 本サービスはローカル完結型であり、通常当方はユーザーのデータにアクセスできませんが、法令に基づき捜査機関等から要請があった場合、当方は法令に従い、当方が保有し得る情報の提供（利用状況等）を行うことがあります。 これによりユーザーに損害が生じても、当方は一切の責任を負いません。

五 賠償制限:当方の過失（故意または重過失を除く）によりユーザーに損害が生じた場合、当方は、ユーザーに現実に生じた直接かつ通常の損害に限り、当該アプリの購入代金（もしあれば）を上限として賠償するものとします。

  [７.課金・サブスクリプション]

一 本サービスは一部機能について有料サブスクリプションを提供する場合があります。

二 サブスクリプション料金および支払方法は、App Storeの案内に従います。

三 サブスクリプションは自動更新されます。解約はお客様の設定アプリから行ってください。

四 支払後の返金は、App Storeの規約に従うものとし、当方は返金義務を負いません。

五 サブスクリプションは自動更新の、年額と月額プランがあります。

六 利用者が未成年の場合は、親権者等の法定代理人の同意を得た上でサブスクリプションをご利用してください。

七 サブスクリプション利用中の不具合やデータ消失についても、[５.重要事項]および[６.免責事項]が適用されます。

  [８.準拠法・管轄裁判所]

一 本規約の解釈および適用は、日本法に準拠するものとします。

二 本サービスに関して訴訟の必要が生じた場合、当方の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。

[１.取得する情報とその利用目的]

本サービスでは、ユーザーが任意に作成した以下の情報を端末内に保存・管理します。

本アプリをダウンロードおよび利用することで、ユーザーは本利用規約およびプライバシーポリシーに同意したものとみなされます。

• ユーザー自身によるコンテンツの閲覧・管理

• アプリ機能の提供

※本サービスは完全ローカル完結型であり、当方がユーザーのデータを外部サーバーに収集・保存・閲覧することはありません。

また、ユーザーがお問い合わせフォームを利用した際に入力した以下の情報を取得します。

一 取得情報：メールアドレス、デバイス情報（機種・OS）、アプリのバージョン、お問い合わせ内容。

二 利用目的：お問い合わせへの回答、不具合の調査・解決、およびサービス改善のため。

[２.ユーザーの権利]

一 ユーザーは、アプリ内の削除機能により、自身のコンテンツを削除できます。

二 パスワードの紛失や設定ミスによるコンテンツ復旧はできません。

[３.写真・動画、メモなど保存される情報について]

一 本サービス内のコンテンツは他ユーザーと共有されません。

二 開発者もユーザーのコンテンツを閲覧・共有することはありません。

[４.譲渡・売却について]

一 当方は、本サービスに関する事業の合併、事業譲渡、その他の事由による事業の継承が行われる場合があります。

二 本サービスはユーザーデータを端末内にのみ保持しているため、事業の譲渡や買収があっても、ユーザーのデータが外部に提供されることはありません。

[1. Purpose, Definitions, and Consent]

By downloading and using this app, you agree to these Terms of Service and Privacy Policy.

These Terms of Service and Privacy Policy may be changed without prior notice. Continued use of the Service after changes are made constitutes your agreement to the updated terms.

1. These Terms of Service (hereinafter "Terms") set forth the conditions for using the application (hereinafter "Service") provided by the developer (hereinafter "Provider").

2. This Service is a local (on-device) standalone application for recording and managing user photos, videos, and memos (hereinafter "Content").

3. This Service provides a feature to set an "expiration date" for recorded Content, which automatically deletes the data after the period expires, and a password feature to restrict app access.

4. By using the Service, users are deemed to have agreed to these Terms and the separately defined Privacy Policy.

[2. Prohibited Matters]

Users shall not engage in the following acts:

1. Using the Service for purposes other than its intended purpose.

2. Using the Service for acts that violate laws, criminal acts, or acts that encourage/solicit such behavior.

3. Storing or managing content related to child pornography, child abuse, or content that offends public order and morals.

4. Acts that infringe upon the copyrights, portrait rights, privacy, or other rights of third parties (e.g., recording others' information without permission).

5. Infringing on intellectual property rights, including copying, modifying, reverse engineering, decompiling, or attempting to extract the source code of the software or designs.

6. Selling, transferring, or sublicensing all or part of the Service.

7. Sending files infected with viruses, malware, etc., to the Service.

[3. Suspension and Modification of the Application]

The Provider may freely modify, update, suspend, or terminate the contents of the Service due to technical or operational reasons (including changes to the Terms or Privacy Policy).

[4. Data Management and Privacy]

1. Content created in this Service is saved only within the user's device. The Provider does not collect, store, or view user data on servers.

2. Principle of Self-Responsibility: The Provider shall not be liable for any loss of data due to loss of the device, failure, model change, or deletion of the app. Users are responsible for their own backups.

[5. Important Matters (Auto-deletion and Password)]

1. Auto-deletion: Data deletion executed based on the expiration date set by the user is, by its nature, impossible to restore. The Provider is not responsible for data loss caused by errors in setting the expiration date.

2. Password Management: If a user loses their set password (passcode, etc.), the Provider cannot unlock the password or restore data due to security reasons.

[6. Disclaimer]

1. Warranty of Function: The Provider does not guarantee that the auto-deletion and password features will operate without defects in all environments.

2. Troubles: The Provider shall not be liable for any damage (data loss, inability to access due to lost password, etc.) caused by the use or inability to use the Service.

3. Disclaimer regarding Criminal Use: If a user uses the Service for criminal acts or law violations, the Provider shall not be liable for any resulting disadvantages or damages.

4. Information Provision to Legal Authorities: While this Service is local-only and the Provider generally cannot access user data, the Provider may provide available information (such as usage status) in accordance with the law if requested by investigative agencies. The Provider is not liable for any damages caused by such provision.

5. Limitation of Liability: In the event that a User suffers damages due to the negligence (excluding willful misconduct or gross negligence) of the Provider, the Provider shall be liable only for direct and ordinary damages actually incurred by the User. The amount of such compensation shall be limited to the purchase price of the Application (if any) paid by the User.

[7. Billing and Subscription]

1. This Service may provide paid subscriptions for certain features.

2. Subscription fees and payment methods shall be in accordance with the guidance of the App Store.

3. Subscriptions will auto-renew and can be cancelled via your Settings app.

4. Refunds after payment shall follow the App Store's terms; the Provider has no obligation to refund.

5. Subscriptions include monthly and annual plans, both of which renew automatically.

6. If you are a minor, please obtain the consent of a parent or legal guardian before using the subscription.

7. The provisions of [5. Important Matters] and [6. Disclaimer] also apply to defects or data loss during subscription use.

[8. Governing Law and Jurisdiction]

1. The interpretation and application of these Terms shall be governed by the laws of Japan.

2. If litigation becomes necessary regarding this Service, the court having jurisdiction over the location of the Provider shall be the exclusive agreement jurisdictional court of the first instance.

This Service saves and manages the following information voluntarily created by the user within the device.

• Content: Photos, videos, memos, etc.

• Settings: Passwords and configuration information.

Purpose of Use:

• For viewing and management of Content by the user themselves.

• To provide application features.

Note: This Service is a completely local standalone application. The Provider does not collect, store, or view user data on external servers.

Additionally, when a user uses the inquiry form, the Provider collects the following information:

1. Collected Information: Email address, device information (model, OS), app version, and the content of the inquiry.

2. Purpose of Use: To respond to inquiries, investigate and resolve bugs, and improve the service.

[2. User Rights]

1. Users can delete their own Content at any time using the deletion feature within the app.

2. Data restoration is not possible in the event of password loss or configuration errors.

[3. Concerning Stored Information (Photos, Videos, Memos, etc.)]

1. Content within this Service is not shared with other users.

2. The Provider does not view or share the user's Content.

[4. Transfer or Sale of Business]

1. The Provider may transfer the business related to this Service due to merger, business transfer, or other reasons for succession of the business.

2. Since this Service maintains user data only within the device, user data will not be provided to external parties even in the event of a business transfer or acquisition.
