The Privacy Policy of the "Ground Level" Mobile Application

Article 1. General Provisions


1. The Privacy Policy of the Ground Level application (hereinafter referred to as the “Privacy Policy”) regulates the rules of collecting, storing and processing personal data that are necessary for the performance of services provided via the mobile application, hereinafter referred to as: the “Application” by Roman Chudziak, conducting business activity under the business name of Roman Chudziak – P.P.H.U. “TRANSKOBET”, NIP 7130205715, Łuszczów Pierwszy 85, Wólka, 20-258 Lublin

2. The controller of personal data is Roman Chudziak conducting business activity under the business name Roman Chudziak – P.P.H.U. “TRANSKOBET”, NIP 7130205715, Łuszczów Pierwszy 85, Wólka, 20-258 Lublin (hereinafter referred to as the “Controller”).

3. User should be understood as a natural person using the application.

4. The user is aware that providing personal data is voluntary, and the use of the application functions does not require supplying any personal data. Their provision is preceded by the acceptance of this Privacy Policy.


Article 2. Personal data


1. In order to contact the controller, the user may voluntarily provide personal data.

Indication of personal data enables verification of the user.

2. The data collected during contacting, obtaining assistance and consulting with the Controller are used only to explain the correct use of the application, remove any problems and modernise the application, report any complaints, and above all to communicate professionally and efficiently between the user and the controller.

3. Personal data provided by the user may include first and last name, telephone number or e-mail address.


Article 3. Automatic data


1. Automatic data is data that is not personal. The collection of such data shall take place in a manner independent of the will of the user.

2. The following data are automatic data – name of the device used by the user.

3. Automatic data can be used to improve the functioning of the application.

4. The possibility of interference, change or deletion of automatic data is excluded.


Article 4. Obligations and rights of the Controller


1. The Controller is obliged to process personal data in accordance with the Personal Data Protection Act of 10 May 2018.

2. The controller shall ensure that the personal data of users provided on a voluntary basis are adequately protected by appropriate technical measures.

3. Ensuring protection of voluntarily provided data prevents them from being made available, processed and accessed by unauthorised persons, as well as their loss.

4. The data retention period depends on the period during which the controller performs the activities related to solving the problem reported by the user.

5. Personal data may be transferred to entities responsible for proper and correct operation of the application only to the extent necessary for the proper functioning of the application.


Article 5. Obligations and rights of the application user


1. If the user does not voluntarily transfer their personal data to the controller in the manner specified in Article 2 (1) and (2), the controller processes only the IP address of the device used by the user for its proper functioning. The legal basis for these activities is Article 6 (1) (f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR).

2. In the case of voluntary transfer of data by the user on the terms set out in Article 2 (1) and (2), the user has the following rights: the right to access, rectify, restrict the processing, transfer, modify, update, change, supplement, delete the provided personal data and the right to object in the cases specified in the provisions of the Act.


Article 6. Other contractual provisions


1. The Controller is entitled to amend and update the privacy policy. If the user does not give their consent to introduce changes in the application, the user removes the application. The changed privacy policy is made available to the user after the first launch of the application following the changes. Lack of acceptance of the amended provisions of the privacy policy is equivalent to resignation from the use of the application and results in uninstallation and removal of the application.

2. The Controller makes every effort to ensure the safe use of the application, but the actions taken do not exclude unlawful actions of third parties.

Article 7. RevenueCat Privacy Policy

This is the Privacy Policy for the website hosted at https://www.revenuecat.com/ (“our site”), our products and services, and for other RevenueCat activities at which you may provide your personal data, such as sponsored events or trade shows. The site is operated by or on behalf of RevenueCat, Inc. (“we”, ”us”, “our”). We are committed to protecting and respecting your privacy.

Information we collect

We will collect and process the following personal data from you:

  • Information you give us, which may consist of:

  • Information about you that you give us by filling in forms on our site or by corresponding with us by phone, e-mail or otherwise. It includes information you provide when you register to use our site, subscribe to our service, search for a product, in discussion boards or other social media functions on or via our site, enter a competition, promotion or survey, submit a query, providing information at trade shows or sponsored events and when you report a problem with our site;

  • Your name, address, e-mail address and phone number, financial and credit card information, personal description and photograph, login and password details; and

  • Employment details if you send us a CV, resumé or other details of your employment history in connection with an advertised job vacancy or a general inquiry regarding employment opportunities with us.

  • Technical information, which may include the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, operating system and platform;

  • Information about your visit, which may include the full Uniform Resource Locators (URL), clickstream to, through and from our site (including date and time), page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, and any phone number used to call our customer service number or social media handle used to connect with our customer service team.

  • IP Location data, where IP addresses are collected and location is inferred based on IP location.

  • Information collected from other platform activities.

If you are using our products or services as a developer, the following information regarding your end users may be received and processed by us:

  • “End User Technical Information”: This refers to technical information related to an end user’s mobile device or computer, such as: device type, operating system,

  • “End User Transaction Information”: This refers to transaction information related to an end user’s activities with respect to your app or other digital product, and may include:

  • Last seen time that the end user used your app or digital product;

  • Apple receipt file; and

  • Google purchase token,

  • “Optional End User Information”: This refers to information that we may receive if you select or enable this option in our products, which may include:

  • User ID of the end user in your app or digital product; and

  • Additional attribution or metadata associated with an end user.

End User Technical Information, End User Transaction Information, and Optional End User Information are collectively referred to as “End User Information”.

Information we receive from other sources

We may receive other personal data about you:

  • If you use any of the other websites or apps we operate or the other services we or our affiliates provide.

  • From third parties we work with:, which may include Zapier Lead Scoring.

Cookies and other tracking technologies

Our site uses cookies and/or other similar technologies such as device-IDs, in-app codes, pixel tags or web beacons to collect and store certain information. These typically involve pieces of information or code that a website transfers to or accesses from your computer hard drive or mobile device to store and sometimes track information about you. Cookies and similar technologies enable you to be remembered when using that computer or device to interact with websites and online services and can be used to manage a range of features and content as well as storing searches and presenting personalized content. Our site uses cookies and similar technologies to distinguish you from other users of our site. This helps us to provide you with a good experience when you browse our site and use our service and also allows us to improve our site. Most web browsers automatically accept cookies and similar technologies, but if you prefer, you can change your browser to prevent that and your help screen or manual will tell you how to do this. However, you may not be able to take full advantage of our website if you do so. You can object to further marketing at any time by checking and updating your contact details within your account, or selecting the “unsubscribe” link at the end of all our marketing and promotional update communications to you, or by submitting your email address here.

Lawful Bases

We will only collect and process personal data where we have lawful bases. Lawful bases include consent (where you have given consent), contract (where processing is necessary for the performance of a contract with you (e.g. to operate the site or deliver any products or services you have requested) and “legitimate interests”. We rely on our legitimate interests as our lawful basis only where those interests are not overridden by the impact on you (unless we have your consent or our processing is otherwise required or permitted by law). Who we share your information with

We may share your information with:

  • Any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, who support our processing of personal data under this policy. If any of these parties are using your information for direct marketing purposes, we will only transfer the information to them for that purpose with your prior consent.

  • Selected third parties which may include:

  • Organizations who process your personal data on our behalf and in accordance with our instructions and applicable law. This includes organizations supporting the services we offer through the site, in particular organizations providing website and data hosting services, providing fulfillment services, distributing any communications we send, supporting or updating marketing lists, and facilitating feedback on our services. These organizations (which may include third party suppliers, agents, sub-contractors and/or other companies in the RevenueCat group of companies) will only use your information to the extent necessary to perform their support functions.

  • Analytics and search engine providers that assist us in the improvement and optimization of our site and subject to the cookie section of this policy (this will not identify you as an individual).

  • Payment processing providers, such as Stripe, who provide secure payment processing services. (Your payment card details are not shared with us by the provider.)

  • We will disclose your personal information to third parties:

  • In the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets, subject to the terms of this Privacy Policy.

  • If RevenueCat or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.

  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of service, terms of use, and other agreements with you; or to protect the rights, property, or safety of RevenueCat, our customers, or others.

Where we store your information

The data that we collect from you will be stored securely on Amazon Web Services (“AWS”) in the USA.

How We Respond to DNT Signals

Your browser settings may allow you to automatically transmit a Do Not Track signal to websites and other online services you visit. We do not alter our practices when we receive a Do Not Track signal from a visitor’s browser because we do not track our visitors to provide targeted advertising. Public forums

The site may, from time to time, make chat rooms, message boards, news groups and/or other public forums available to its users. Any information that is disclosed in these areas becomes public information and you should exercise caution when using these and avoid posting any personal information.

Child safety

The site is intended for use only by persons who are at least 16 years of age. By using the site, you confirm to us that you meet this requirement. If you are under the age of 16, you confirm you have received permission from your parent or guardian before using this site or sending us personal information.

Payment processing

Payment details you provide will be encrypted using secure sockets layer (SSL) technology before they are submitted to us over the internet. Payments made on the site are made through our payment gateway provider. You will be providing credit or debit card information directly to the operator which operates a secure server to process payment details, encrypting your credit/debit card information and authorizing payment. Information which you supply is not within our control and is subject to the operator’s own privacy policy and terms and conditions.

How we protect your information

Security is one of our biggest priorities at RevenueCat. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

  • All application data is secured in transit using TLS.

  • Any payment transactions will be encrypted using SSL.

  • RevenueCat audits changes to the application throughout the development lifecycle: architecture reviews are performed as well as stringent automated and manual code review processes.

  • RevenueCat monitors application servers, infrastructure, and the RevenueCat network environment to detect potential abuse.

  • RevenueCat uses Amazon Web Services (“AWS”) to persistently store Customer data and does not host Customer data on its premises. AWS is a leading cloud provider, and holds industry best security certifications, such as SOC2 and ISO 27001. Customer data sent to RevenueCat from around the world is sent to AWS data centers located in the United States.

How long we keep your information

We retain personal data during any period in which you have expressed an interest in our products and services, for as long as you have an account with us in order to meet our contractual obligations to you, and for six years after that to identify any issues and resolve any legal proceedings. We may also retain aggregate information beyond this time for research purposes and to help us develop and improve our services. You cannot be identified from aggregate information retained or used for these purposes.

EU Citizen Rights Under GDPR

  • You have the right under certain circumstances:

  • to be provided with a copy of your personal data held by us.

  • to request the rectification or erasure of your personal data held by us.

  • to request that we restrict the processing of your personal data (while we verify or investigate your concerns with this information, for example).

  • to object to the further processing of your personal data, including the right to object to marketing.

  • to request that your provided personal data be moved to a third party.

  • You may opt out at any time from allowing further access by us to your location data by emailing compliance@revenuecat.com.

  • Your right to withdraw consent:

  • Where the processing of your personal information by us is based on consent, you have the right to withdraw that consent without detriment at any time by going here.

You can also exercise the rights listed above at any time by contacting us at compliance@revenuecat.com. We will respond to your requests within a reasonable timeframe. Please note these rights may be limited in certain circumstances as provided by applicable law.

Data processed on behalf of our Customers

RevenueCat may process End User Information on behalf of its customers. We are not the controllers of this data and act as data processors, and have no direct relationship with the individuals or end users whose personal information it processes. The processing of personal data sent from our Customers is governed by our Terms of Use, Data Processing Addendum or any other agreement agreed to and signed by us with our Customers. These agreements cover data transfers to third parties that may occur as part of RevenueCat’s provision of its services to the customer. We will process such data on behalf of the customer as prescribed in the respective agreements between RevenueCat and the customer. The customer’s privacy policy or other agreement between the customer and you (or your organization) will apply to such processing, and not this policy.

If your personal data is processed by RevenueCat on behalf of one of our customers and you wish to discontinue such processing, or if you seek to correct, amend, or delete inaccurate data, please contact the RevenueCat customer (the data controller) directly. The RevenueCat customer should then provide instructions to us, if necessary. If requested to remove data by the data controller we will respond within a reasonable timeframe. We will retain personal information pursuant to our retention policy and will retain this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Note to users outside the United States

RevenueCat is based in the United States. The Site and our products and services are controlled and operated by us from the United States and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States. Your personal data may be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Services you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your personal data.

REGULATIONS OF "Ground Level" MOBILE APPLICATION

Article 1. General provisions


1. Pursuant to the provision of the Article 8 of the Act of 18 July 2002 on the provision of services by electronic means, the regulations are established (hereinafter referred to as: the “Regulations”) specifying the terms and conditions of using the Ground Level mobile application (hereinafter referred to as: the “Application”). This application is compatible with the iOS and Android operating system.

2. The owner and operator of the Application using which the services described below are provided is Roman Chudziak, conducting business activity under the business name of Roman Chudziak – P.P.H.U. “TRANSKOBET”, NIP 7130205715, Łuszczów Pierwszy 85, Wólka, 20-258 Lublin (hereinafter referred to as: The “Operator”)

3. Whenever the term “user” appears in the regulations, it means a natural person using the application.

4. The services provided by the application operator are based on the calculation of height measurement differences based on input data.

5. The application is available through: Google Play (for Android) and the App Store (for iOS).

6. Installation of the Application is equivalent to acceptance of the content of the Regulations by the User and the conclusion of a contract for the provision of services by electronic means between the Operator, in accordance with the rules described herein.

7. Downloading and installing the application is free of charge. The use of the application after a 14-day free trial period is payable. The fee is paid by the user via the AppStore or Google Play platform. The monthly subscription payment is collected from the Google Play or Apple Store account or through other applications provided by other entities that act as an intermediary in the payment of the fees. The payment is indicated on the App Store or Google Play platform. If the user fails to order the deactivation of the paid subscription during a 14-day trial period, the user will switch to a paid, renewable service in monthly settlement periods. The cyclical service is renewed monthly to order its deactivation by the user.

8. The use of the application (subscription) starts with the user’s consent before the expiry of the withdrawal period. Therefore, pursuant to the provision of Article 38 (13) of the Consumer Rights Act of 13 May 2014, the user is not entitled to withdraw from the contract.

9. Internet connection is necessary to download, install and use the Application. All costs related to the use of the Internet, in particular data transmission, constitute costs paid by the user. Their amount and terms of payment are specified in the agreements concluded by the user with telecommunications operators or Internet providers.

11. The application, its design and layout and other elements of this nature are subject to the operator's copyright.


Article 2. Use of Applications and Technical Requirements


1. The application is preceded by downloading and installing it on the user’s mobile device. It is necessary for a given device to be compatible with technical requirements of the application.

2. The application in question must meet the following technical requirements for correct installation and use:

1) having iOS system version 11 (or later) if the app is downloaded from the App Store,

2) having Android system in version 5.0 (or later) in the case of downloading applications from Google Play store.

3. Downloading this application from a portal other than indicated in the previous paragraph

conflicts with the provisions of the regulations. However, if the operator gives their prior consent, the user will be entitled to use the application downloaded from another portal.

4. An active Internet connection is not necessary to use the application.



Article 3. Rules of using the application


1. The use of the application requires the user to comply with the provisions of laws and other generally applicable acts of law and generally accepted principles of social coexistence, as well as the provisions of the regulations and the privacy policy.

2. The use of the application, contrary to the rules and recommendations of the operator, constitutes an unacceptable violation of the provisions of these regulations. If the event occurs, the user should report it to the operator.

3. The User uses the Application voluntarily, on their own responsibility. However, the Operator's liability for potential damage arising in connection with the use of the Application (in particular the lack of its functioning, as well as improper operation and accounting errors) is excluded to any legally permissible extent.

4. The user's right to uninstall and remove the application is not limited in time.

5. The operator is exempted from liability for interruptions or difficulties in functioning of ICT systems required for proper use of the application.

6. The use of the application in a manner contrary to the rules specified in Article 3 (2) related to the violation of good name or property rights of the operator may result in limiting or preventing the user from using the application, as well as may be related to claiming compensation from the user by the operator on general terms.

Article 4. Final Provisions


1. In the case of voluntary transfer of personal data by application users, their controller will be Roman Chudziak, conducting business activity under the business name Roman Chudziak – P.P.H.U. “TRANSKOBET”, NIP 7130205715, Łuszczów Pierwszy 85, Wólka, 20-258 Lublin

2. In the case of voluntary transfer of personal data by the user in order to report problems related to the functioning of the application, the user has the following rights: the right to access, rectify, limit the processing, transfer, modify, update, change, supplement, delete the provided personal data and the right to object in cases specified in the provisions.


Article 5. Complaint procedure


1. Any complaints regarding proper operation, use of the application and enquiries should be submitted to the e-mail address groundlevelcalculator@gmail.com

2. The submitted complaint should include: the name and model of the device on which the application has been installed, as well as the problem described and the reason for the complaint.

3. The Operator shall examine the complaint and respond to it within 14 days from its receipt to the e-mail address indicated by the complainant.

4. If the notification referred to in the preceding paragraph requires clarification, the operator shall request the user to rectify or complete it. The period of waiting for additional information from the user suspends the period for processing the complaint.

5. The user and the operator shall attempt to settle disputes arising from the use of the application amicably. The User has the right to use out-of-court complaint handling and recovery methods.

6. The User has the right to obtain detailed information on the possibility of using out-of-court methods of handling complaints and pursuing claims in the registered offices and on the websites of county (urban) consumer ombudsmen, social organisations whose purposes include the protection of consumer rights, Voivodeship Inspectors of Trade Inspection and the Office of Competition and Consumer Protection, in particular on the following websites:

7. User – the consumer may obtain free of charge assistance in dispute between him and the operator at the county (urban) consumer ombudsman or social organisation appointed to protect consumer rights.

8. The Apple App Store or Google Play platform is competent to handle complaints regarding the payment for the subscription of the applications in accordance with the procedures and rules applicable to these platforms. The Operator undertakes to cooperate with the managing entities of Apple App Store and Google Play in order to timely and professionally process the complaint concerning this section.


Article 6. Final Provisions


1. To the extent not regulated by these regulations, the provisions of the Civil Code, the Act on Electronic Services and other generally applicable laws shall apply.

2. The user can read these regulations on the website and via the Ground Level application.

3. An operator may at any time amend the provisions of this Regulation.

4. The user is informed about the change of the regulations when starting the application in such a way as to make it possible to read the amended regulations. Then the user can accept the amended regulations. Failure to accept the amended regulations results in termination of the agreement for the provision of services by electronic means. The agreement is terminated after the operator receives information about the termination of the agreement by the user. The termination of the contract results in uninstallation and removal of the application from the user's device.


Article7. Terms and Conditions RevenueCat

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Application Services operated by RevenueCat, Inc. ("us", "we", or "our"). The "Application Services" (the "Service") shall mean the online, web-based applications and programming interfaces under revenuecat.com. RevenueCat also maintains open-source SDKs provided under the MIT License as a means of accessing the Service through mobile-applications. A "Subscription(s)" shall mean a specified pricing plan and term length with associated features, functionality and volume tiers for the Application Services purchased by Customer.

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.

Subscriptions

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly basis.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or RevenueCat, Inc. cancels it. You may cancel your Subscription renewal at any time either through your online account management page or by contacting RevenueCat, Inc. customer support team.

A valid payment method, including credit card, is required to process the payment for your Subscription. You shall provide RevenueCat, Inc. with accurate and complete billing information including full name, address, state, zip code, and a valid payment method information. By submitting such payment information, you automatically authorize RevenueCat, Inc. to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, RevenueCat, Inc. will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

Free Trial

RevenueCat, Inc. may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial").

You may be required to enter your billing information in order to sign up for the Free Trial.

If you do enter your billing information when signing up for the Free Trial, you will not be charged by RevenueCat, Inc. until the Free Trial has expired. On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.

At any time and without notice, RevenueCat, Inc. reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.

Fee Changes

RevenueCat, Inc., in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

RevenueCat, Inc. will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

Refunds

Certain refund requests for Subscriptions may be considered by RevenueCat, Inc. on a case-by-case basis and granted in sole discretion of RevenueCat, Inc..

Accounts

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

RevenueCat, Inc. shall hold Customer harmless from liability to third parties resulting from infringement by the Service of any United States patent or any copyright or misappropriation of any trade secret, provided RevenueCat is promptly notified of any and all threats, claims and proceedings related thereto and given reasonable assistance and the opportunity to assume sole control over defense and settlement; RevenueCat will not be responsible for any settlement it does not approve in writing. The foregoing obligations do not apply with respect to portions or components of the Service (i) not supplied by RevenueCat, (ii) made in whole or in part in accordance with Customer specifications, (iii) that are modified after delivery, (iv) combined with other products, processes or materials where the alleged infringement relates to such combination, (v) where Customer continues allegedly infringing activity after being notified thereof or after being informed of modifications that would have avoided the alleged infringement, or (vi) where Customer’s use of the Service is not strictly in accordance with this Agreement. If, due to a claim of infringement, the Services are held by a court of competent jurisdiction to be or are believed by RevenueCat to be infringing, RevenueCat may, at its option and expense (a) replace or modify the Service to be non-infringing provided that such modification or replacement contains substantially similar features and functionality, (b) obtain for Customer a license to continue using the Service, or (c) if neither of the foregoing is commercially practicable, terminate this Agreement and Customer’s rights hereunder.

§ 1 Postanowienia ogólne

1. Dane automatyczne stanowią dane, które nie są danymi osobowymi. Gromadzenie przedmiotowych danych odbywa się w sposób niezależny od woli użytkownika.

2. Danymi automatycznymi są następujące dane – nazwa urządzenia, z którego użytkownik korzysta z aplikacji.

3. Dane automatyczne mogą być przeznaczone do poprawy funkcjonowania aplikacji.

4. Wyłączona jest możliwość ingerencji, zmiany bądź usuwania danych automatycznych.


§ 4 Zobowiązania i uprawnienia administratora


1. Administrator jest zobligowany do przetwarzania danych osobowych zgodnie z ustawą o ochronie danych osobowych z 10 maja 2018 r.

2. Administrator zapewnia należytą ochronę dobrowolnie przekazanych danych osobowych użytkowników przy zachowaniu adekwatnych środków technicznych.

3. Zapewnienie ochrony nad dobrowolnie przekazanymi danymi uniemożliwia ich udostępnianie, przetwarzanie oraz dostęp osobom niepowołanym jak również ich utratę.

4. Okres przechowywania danych jest uzależniony od okresu realizacji wykonywanych czynności przez administratora związanych z rozwiązaniem problemu zgłaszanego przez użytkownika.

5. Dane osobowe mogą być przekazane podmiotom odpowiedzialnym za właściwe i poprawne działanie aplikacji wyłącznie w niezbędnym zakresie do prawidłowego funkcjonowania aplikacji.


§ 5 Zobowiązania i uprawnienia użytkownika aplikacji


1. W przypadku, gdy użytkownik nie przekaże dobrowolnie danych osobowych administratorowi w sposób określony w § 2 pkt 1 i 2 to administrator przetwarza wyłącznie adres IP urządzenia, z którego użytkownik korzysta z aplikacji w celu jej właściwego funkcjonowania. Podstawę prawną przedmiotowych czynności stanowi art. 6 ust. 1 lit f) Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (RODO).

2. W przypadku dobrowolnego przekazania danych przez użytkownika na zasadach określonych § 2 pkt 1 i 2 użytkownikowi przysługują następujące uprawnienia: prawo do dostępu, sprostowania, ograniczenia przetwarzania, przenoszenia, modyfikacji, aktualizacji, zmiany, uzupełnienia, usunięcia udostępnionych danych osobowych oraz prawo do wniesienia sprzeciwu w przypadkach określonych w przepisach ustawy.


§ 6 Pozostałe postanowienia umowne

1. Administrator jest uprawniony do dokonywania zmian i uaktualniania polityki prywatności. Niewyrażenie zgody przez użytkownika na wprowadzenie zmian w aplikacji związane jest z usunięciem aplikacji przez użytkownika. Użytkownikowi jest udostępniana zmieniona polityka prywatności po pierwszym uruchomieniu aplikacji następującym po wprowadzeniu zmian. Brak akceptacji zmienionych postanowień polityki prywatności jest równoznaczny z rezygnacją z korzystania z aplikacji i skutkuje odinstalowaniem i usunięciem aplikacji.

2. Administrator dokłada wszelkich starań, żeby zapewnić bezpieczne korzystanie z aplikacji, jednakże podjęte działania nie wykluczają bezprawnych działań osób trzecich.

If your personal data is processed by RevenueCat on behalf of one of our customers and you wish to discontinue such processing, or if you seek to correct, amend, or delete inaccurate data, please contact the RevenueCat customer (the data controller) directly. The RevenueCat customer should then provide instructions to us, if necessary. If requested to remove data by the data controller we will respond within a reasonable timeframe. We will retain personal information pursuant to our retention policy and will retain this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

RevenueCat is based in the United States. REGULAMIN APLIKACJI MOBILNEJ "Ground Level"

§ 1 POSTANOWIENIA OGÓLNE

1. Na podstawie przepisu art. 8 ustawy z 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną ustala się regulamin (zwany dalej: „regulaminem”) określający zasady i warunki korzystania z aplikacji mobilnej Ground Level (zwaną dalej: „aplikacją”). Przedmiotowa aplikacja jest kompatybilna z systemem operacyjnym IOS oraz Android.

2.Właścicielem i operatorem Aplikacji, za pomocą której świadczone są niżej opisane usługi jest Roman Chudziak prowadzący działalność gospodarczą pod firmą Roman Chudziak – P.P.H.U. „TRANSKOBET”, NIP 7130205715, Łuszczów Pierwszy 85, Wólka, 20-258 Lublin (zwany dalej: „Operator”)

3. Ilekroć w regulaminie wystąpi pojęcie ”użytkownik” oznacza ono osobę fizyczną korzystającą z aplikacji.

4. Usługi świadczone przez operatora aplikacji opierają się na obliczaniu różnic w pomiarach wysokości na podstawie wprowadzonych danych.

5. Aplikacja jest dostępna w za pośrednictwem: Google Play (dla systemu Android) oraz App Store (dla systemu iOS).

6. Zainstalowanie Aplikacji jest równoznaczne z akceptacją treści Regulaminu przez Użytkownika oraz zawarciem kontraktu świadczenia usług drogą elektroniczną pomiędzy Operatorem, zgodnie z zasadami opisanymi w niniejszym Regulaminie.

7. Pobranie i zainstalowanie aplikacji jest bezpłatne. Korzystanie z aplikacji po upływie 14 dniowego bezpłatnego okresu próbnego jest płatne. Opłata jest uiszczana przez użytkownika za pośrednictwem platformy AppStore lub Googleplay. Płatność za miesięczną subskrypcję jest pobierana z konta na platformie Google Play lub Apple Store lub za pośrednictwem innych aplikacji udostępnianych przez pozostałe jednostki, które pośredniczą przy realizacjach opłat. Wysokość opłaty jest wskazywana na platformie App Store lub Google Play. Brak zlecenia wyłączenia płatnej subskrypcji przez użytkownika podczas 14-dniowego okresu próbnego skutkuje przejściem na usługę płatną, odnawialną w miesięcznych okresach rozliczeniowych. Cykliczna usługa jest odnawiana miesięcznie do zlecenia jej wyłączenia przez użytkownika.

8. Korzystanie z aplikacji (subskrypcji) rozpoczyna się za zgodą użytkownika przed upływem terminu do odstąpienia od umowy. Zatem na podstawie przepisu art. 38 pkt. 13 ustawy z dnia 13 maja 2014 r. o prawach konsumenta użytkownikowi nie przysługuje prawo do odstąpienia od umowy.

9. Do pobrania, zainstalowania i korzystania z Aplikacji konieczne jest połączenie z Internetem. Wszelkie koszty związane z korzystaniem z Internetu, w szczególności transmisja danych stanowią koszty opłacane przez użytkownika. Ich wysokość oraz warunki uiszczania określają umowy zawierane przez użytkownika z operatorami telekomunikacyjnymi lub dostawcami Internetu.

10. Aplikacja zawiera odnośnik do strony na portalu społecznościowym Facebook: https://www.facebook.com/groundlevelcalculator . W celu uzyskania szczegółowych informacji dotyczących uprawnień użytkownika i przyjętych przez portal społecznościowy Facebook zasad przetwarzania danych osobowych należy zapoznać się z polityką prywatności portalu dostępną pod adresem: http://www.facebook.com/about/privacy

11. Aplikacja, jej projekt i układ graficzny oraz inne elementy o tym charakterze stanowią przedmiot praw autorskich operatora.


§ 2 Korzystanie z aplikacji i wymagania techniczne


1. Korzystanie z aplikacji poprzedzone jest jej pobraniem i zainstalowaniem na urządzeniu mobilnym użytkownika. Konieczne jest, aby dane urządzenie było kompatybilne z wymogami technicznymi aplikacji.

2.Przedmiotowa aplikacja do prawidłowego zainstalowania oraz użytkowania wymaga spełnienia poniższych wymagań technicznych:

1.) posiadanie systemu iOS w wersji 11. (lub nowszej) w przypadku pobrania aplikacji ze sklepu App Store

2.) posiadanie systemu Android w wersji 5.0 (lub nowszej) w przypadku pobrania aplikacji ze sklepu Google Play

3. Pobieranie niniejszej aplikacji z innego portalu niż wskazane w poprzednim ustępie

stoi w sprzeczności z zasadami regulaminu. Jednakże, jeżeli operator wyrazi uprzednią zgodę to użytkownik będzie uprawniony do korzystania z aplikacji pobranej z innego portalu.

4.Do korzystania z aplikacji nie jest konieczne aktywne połączenie z Internetem.



§ 3 Zasady korzystania z aplikacji


1. Korzystanie z aplikacji wymaga stosowania się przez użytkownika do przepisów ustaw i innych powszechnie obowiązujących aktów prawa oraz do ogólnie przyjętych zasad współżycia społecznego, a także postanowień regulaminu oraz polityki prywatności.

2. Sprzeczne z zasadami i zaleceniami operatora korzystanie z aplikacji stanowi niedopuszczalne naruszenie postanowień niniejszego regulaminu. W przypadku wystąpienia danego zdarzenia użytkownik winien je zgłosić operatorowi.

3. Użytkownik korzysta z Aplikacji dobrowolnie, na własną odpowiedzialność. Jednak odpowiedzialność Operatora za ewentualne szkody powstałe w związku z korzystaniem z Aplikacji (w szczególności brak jej funkcjonowania, a także nieprawidłowe działanie, omyłki rachunkowe) jest wyłączona w jakimkolwiek prawnie dopuszczalnym zakresie.

4. Prawo użytkownika do odinstalowania i usunięcia aplikacji nie jest ograniczone czasowo.

5. Operator jest zwolniony z odpowiedzialności z tytułu przerw bądź trudności w funkcjonowaniu systemów teleinformatycznych wymaganych do właściwego korzystania z aplikacji.

6.Użytkowanie aplikacji w sposób sprzeczny z zasadami określonymi § 3 ust. 2 związane z naruszeniem dobrego imienia bądź praw majątkowych operatora może spowodować ograniczenie bądź uniemożliwienie użytkownikowi korzystania z aplikacji jak również może być związane z dochodzeniem odszkodowania przez operatora od użytkownika na zasadach ogólnych.

§ 4 Postanowienia końcowe


1. W przypadku dobrowolnego przekazania danych osobowych przez użytkowników aplikacji ich administratorem będzie Roman Chudziak prowadzący działalność gospodarczą pod firmą Roman Chudziak – P.P.H.U. „TRANSKOBET”, NIP 7130205715, Łuszczów Pierwszy 85, Wólka, 20-258 Lublin

2. W przypadku dobrowolnego przekazania danych osobowych przez użytkownika w celu zgłoszenie problemów związanych z funkcjonowaniem aplikacji użytkownikowi przysługują następujące uprawnienia: prawo do dostępu, sprostowania, ograniczenia przetwarzania, przenoszenia, modyfikacji, aktualizacji, zmiany, uzupełnienia, usunięcia udostępnionych danych osobowych oraz prawo do wniesienia sprzeciwu w przypadkach określonych w przepisach.


§ 5 procedura reklamacyjna


1.Ewentualne reklamacje dotyczące poprawnego działania, korzystania z aplikacji oraz zapytania należy zgłaszać na adres poczty elektronicznej groundlevelcalculator@gmail.com

2. Zgłaszana reklamacja powinna zawierać: nazwę i model urządzenia, na którym została zainstalowana aplikacja, jak również opisany problem i powód reklamacji.

3. Operator rozpatrzy zgłoszenie i udzieli odpowiedzi na przedmiotową reklamację w terminie 14 dni od jej otrzymania na wskazany przez zgłaszającego adres e-mail.

4. Jeżeli zgłoszenie, o którym mowa w ustępie poprzedzającym będzie wymagało wyjaśnienia to operator zwróci się do użytkownika o jego sprostowanie lub uzupełnienie. Okres oczekiwania na udzielenie dodatkowych informacji od użytkownika zawiesza bieg terminu na rozpatrzenie reklamacji.

5. Użytkownik i operator podejmą próby polubownego rozstrzygnięcia sporów wynikających z korzystania z aplikacji. Użytkownik ma prawo skorzystać z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia należności.

6. Użytkownik ma prawo uzyskać szczegółowe informacje dotyczące możliwości skorzystania z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń w siedzibach oraz na stronach internetowych powiatowych (miejskich) rzeczników konsumentów, organizacji społecznych, do których celów należy ochrona praw konsumenta, Wojewódzkich Inspektorów Inspekcji Handlowej oraz w Urzędzie Ochrony Konkurencji i Konsumentów, w szczególności na stronach internetowych:

7.Użytkownik – konsument może uzyskać nieodpłatną pomoc w zakresie sporu pomiędzy nim a operatorem u powiatowego (miejskiego) rzecznika konsumenta lub organizacji społecznej powołanej do ochrony praw konsumentów.

8. Właściwe do rozpoznawania reklamacji dotyczących płatności za subskrypcję aplikacji są platformy Apple App Store lub Google Play w trybie właściwym dla procedur i zasad przedmiotowych platform. Operator zobowiązuje się do współdziałania z podmiotami zarządzającymi Apple App Store i Google Play w celu terminowego i profesjonalnego rozpatrzenia reklamacji dotyczącej niniejszego ustępu.


§ 6 Postanowienia końcowe


1. W zakresie nieuregulowanym przedmiotowym regulaminem zastosowanie mają przepisy ustawy kodeks cywilny, ustawy o świadczeniu usług drogą elektroniczną oraz inne przepisy prawa powszechnie obowiązującego.

2. Użytkownik może zapoznać się z niniejszym regulaminem na stronie internetowej oraz za pośrednictwem aplikacji Ground Level.

3. Operator może w dowolnym czasie dokonać zmian postanowień niniejszego regulaminu.

4. Użytkownik jest informowany o zmianie regulaminu przy uruchamianiu aplikacji, w sposób umożliwiający zapoznanie się z treścią zmienionego regulaminu. Następnie użytkownik ma możliwość zaakceptowania regulaminu w zmienionym brzmieniu. Niezaakceptowanie regulaminu o zmienionej treści powoduje rozwiązanie umowy o świadczenie usług drogą elektroniczną. Umowa ulega rozwiązaniu po uzyskaniu przez operatora informacji o wypowiedzeniu umowy przez użytkownika. Następstwem rozwiązania umowy jest odinstalowanie i usunięcie aplikacji z urządzenia użytkownika.

Article7. Terms and Conditions RevenueCat

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Application Services operated by RevenueCat, Inc. ("us", "we", or "our"). The "Application Services" (the "Service") shall mean the online, web-based applications and programming interfaces under revenuecat.com. RevenueCat also maintains open-source SDKs provided under the MIT License as a means of accessing the Service through mobile-applications. A "Subscription(s)" shall mean a specified pricing plan and term length with associated features, functionality and volume tiers for the Application Services purchased by Customer.

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.

Subscriptions

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly basis.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or RevenueCat, Inc. cancels it. You may cancel your Subscription renewal at any time either through your online account management page or by contacting RevenueCat, Inc. customer support team.

A valid payment method, including credit card, is required to process the payment for your Subscription. You shall provide RevenueCat, Inc. with accurate and complete billing information including full name, address, state, zip code, and a valid payment method information. By submitting such payment information, you automatically authorize RevenueCat, Inc. to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, RevenueCat, Inc. will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

Free Trial

RevenueCat, Inc. may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial").

You may be required to enter your billing information in order to sign up for the Free Trial.

If you do enter your billing information when signing up for the Free Trial, you will not be charged by RevenueCat, Inc. until the Free Trial has expired. On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.

At any time and without notice, RevenueCat, Inc. reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.

Fee Changes

RevenueCat, Inc., in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

RevenueCat, Inc. will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

Refunds

Certain refund requests for Subscriptions may be considered by RevenueCat, Inc. on a case-by-case basis and granted in sole discretion of RevenueCat, Inc..

Accounts

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of RevenueCat, Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of RevenueCat, Inc..

Our Service may contain links to third party web sites or services that are not owned or controlled by RevenueCat, Inc.

RevenueCat, Inc. has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that RevenueCat, Inc. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third party web sites or services that you visit.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Indemnification

You agree to defend, indemnify and hold harmless RevenueCat, Inc. and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

RevenueCat, Inc. shall hold Customer harmless from liability to third parties resulting from infringement by the Service of any United States patent or any copyright or misappropriation of any trade secret, provided RevenueCat is promptly notified of any and all threats, claims and proceedings related thereto and given reasonable assistance and the opportunity to assume sole control over defense and settlement; RevenueCat will not be responsible for any settlement it does not approve in writing. The foregoing obligations do not apply with respect to portions or components of the Service (i) not supplied by RevenueCat, (ii) made in whole or in part in accordance with Customer specifications, (iii) that are modified after delivery, (iv) combined with other products, processes or materials where the alleged infringement relates to such combination, (v) where Customer continues allegedly infringing activity after being notified thereof or after being informed of modifications that would have avoided the alleged infringement, or (vi) where Customer’s use of the Service is not strictly in accordance with this Agreement. If, due to a claim of infringement, the Services are held by a court of competent jurisdiction to be or are believed by RevenueCat to be infringing, RevenueCat may, at its option and expense (a) replace or modify the Service to be non-infringing provided that such modification or replacement contains substantially similar features and functionality, (b) obtain for Customer a license to continue using the Service, or (c) if neither of the foregoing is commercially practicable, terminate this Agreement and Customer’s rights hereunder.

Limitation Of Liability

In no event shall RevenueCat, Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

RevenueCat, Inc. its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

Governing Law

These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
