Welcome to GraceChat!
These Terms of Service ("Terms") constitute a binding legal agreement between you and the operators of the GraceChat service (collectively referred to as "GraceChat", "we", "us", or "our").
By creating an account, accessing, or using our app, website, or related services (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree, please do not use the Services.
You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you have the legal capacity to enter into this agreement and that you are not barred from using the Services under any applicable laws.
Mission: The Services are designed to provide social connection, meaningful companionship, and personalized advice. We aim to offer a supportive environment for interactive communication and emotional engagement.
Information & Guidance: While the Services may provide information, insights, or guidance on various topics ("Consulting Content"), such content is for informational and supportive purposes.
Not a Replacement for Licensed Professionals: Please note that GraceChat is not a licensed medical, legal, or financial provider. While we strive to offer helpful and high-quality advice, the Services should not replace the judgment of qualified professionals for critical health, legal, or financial situations.
To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
In-App Purchases and Payments: We may offer subscriptions, premium features, or virtual items (“Coins”) for purchase through the Apple App Store, Google Play Store, or other supported payment methods, including credit cards and debit cards. All transactions are subject to the terms, payment rules, and refund policies of the applicable app store, payment provider, or processor.
No Refunds: All purchases are final and non-refundable, including purchases made by credit card, debit card, Apple App Store, Google Play Store, or any other payment method, except where required by applicable law. GraceChat does not process refunds directly for app store purchases. For payments handled by third-party platforms or payment processors, you may need to contact the applicable provider for support.
Virtual Rights: Virtual items are licensed to you for use only within the Services. They have no real-world monetary value, cannot be exchanged for cash, and are not transferable. We reserve the right to modify, suspend, or discontinue virtual items, premium features, or paid services at any time.
You retain ownership of the content (e.g., text messages) you send through the Services, but you grant us a worldwide, royalty-free license to use, store, and analyze such content to operate and improve the Services.
You agree NOT to:
Use the Services for any illegal purpose.
Harass, bully, threaten, or defame others.
Generate or share content depicting child sexual abuse or exploitation.
Promote self-harm, violence, or hate speech.
Attempt to reverse engineer, scrape, or extract the source code or underlying data of the Services.
We reserve the right to ban any user or terminate any account that violates these rules at our sole discretion.
All rights, title, and interest in and to the Services (including software, graphics, logos, and proprietary content) are and will remain the exclusive property of GraceChat and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services for personal use only.
TO THE FULLEST EXTENT PERMITTED BY LAW, GRACECHAT AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS.
Binding Arbitration: Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration, rather than in court.
Class Action Waiver: You agree to resolve disputes with us on an individual basis, and you waive any right to participate in a class action lawsuit or class-wide arbitration.
Governing Law: These Terms shall be governed by the laws of the State of California, USA, without regard to its conflict of law principles.
We may modify these Terms at any time. If we make material changes, we will notify you through the Services. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
