# Terms of Service for Football: Goal Poacher

Please read these Terms of Service (the "Terms") before downloading, installing, accessing, or using **Football: Goal Poacher** (the "Game"). These Terms are an agreement between you and TDSOFTWAREZ ("we," "us," or the "Developer").
By using the Game, you agree to these Terms. If you do not agree, do not use the Game.
## 1. Eligibility and acceptance
You must be at least 13 years old and meet the minimum age required to use a Meta account and the Game in your country.
You represent that you have the legal capacity to accept these Terms and that your use of the Game is permitted by applicable law and the rules of the platform through which you access it.
## 2. Limited license
Subject to these Terms, the Developer grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Game for your own non-commercial entertainment on compatible devices.
You may not copy, distribute, sell, rent, lease, sublicense, commercially exploit, or falsely represent ownership of the Game or any part of it, except where applicable law expressly permits otherwise.
## 3. Intellectual property
The Game and its content, including its software, gameplay systems, text, artwork, graphics, audio, logos, and trademarks, are owned by or licensed to the Developer and are protected by applicable intellectual property laws.
These Terms do not transfer ownership of the Game or its content to you. Rights not expressly granted under these Terms are reserved by the Developer and the relevant licensors.
## 4. Meta Platform services, leaderboards, purchases, and local data
The Game uses Meta Platform leaderboards. Leaderboard names, scores, ranks, and availability are managed in whole or in part by Meta Platform services. Leaderboards may be delayed, interrupted, unavailable, corrected, or reset because of maintenance, technical problems, platform decisions, suspected invalid scores, or changes to the Game. The Developer does not guarantee permanent availability or preservation of any leaderboard entry or rank.
Game progress, statistics, unlocks, settings are stored locally on your device. They are not backed up to a developer-operated cloud service. Clearing app data, uninstalling or reinstalling the Game, resetting or replacing the device, file corruption, or device failure may permanently erase local progress. The Developer may be unable to recover it.
Any purchase and refund may be processed by the applicable store or platform provider and is subject to that provider's terms, refund rules, and any mandatory rights available under applicable law.
## 5. Virtual reality health and safety
Virtual reality is immersive, and the Game involves sports-like head, arm, and body movement while you are wearing a headset. This creates inherent risks such as falls, collisions, loss of balance, motion sickness, repetitive strain, or contact with people, pets, furniture, walls, or other objects.
Before and while playing, you agree to take reasonable safety precautions, including:
- use the Game only in a sufficiently large, clear, level, and well-lit play area;
- remove obstacles and keep other people and pets outside the play area;
- correctly configure and remain within the Meta boundary or other available safety system;
- follow all in-Game, headset, device-manufacturer, and Meta health and safety warnings;
- avoid running, jumping, diving, or making movements that exceed the available space;
- take regular breaks and stop immediately if you experience dizziness, nausea, disorientation, pain, unusual fatigue, impaired balance, vision changes, or other discomfort; and
- never use the Game where a loss of balance or awareness could expose you or another person to danger.
If you have a medical condition, injury, disability, implanted medical device, history of seizures or loss of consciousness, balance or vision disorder, or any other condition that could be affected by virtual reality or physical activity, consult a qualified medical professional before using the Game. Do not continue playing against medical advice.
By using the Game, you acknowledge the ordinary and inherent risks of virtual reality and sports-like movement and agree to exercise reasonable care for your own safety and the safety of others. This acknowledgement does not waive any right or remedy that cannot legally be waived.
## 6. Disclaimer of warranties and limitation of liability
### 6.1 Mandatory rights remain protected
Nothing in these Terms excludes, restricts, or limits any warranty, consumer guarantee, right, remedy, or liability that cannot lawfully be excluded, restricted, or limited under applicable law.
### 6.2 No additional warranties
To the fullest extent permitted by applicable law, the Game is provided "as is" and "as available." The Developer disclaims warranties not expressly required by law, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
The Developer does not guarantee that the Game will always be available, uninterrupted, secure, error-free, compatible with every device or software version, or that local progress, leaderboard entries, scores, or ranks will never be lost, changed, delayed, or unavailable.
### 6.3 Excluded categories of damage
To the fullest extent permitted by applicable law, the Developer and its licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunity, goodwill, or data, arising out of or relating to the Game or these Terms, even if advised that such damage was possible.
### 6.4 Cap on liability
To the fullest extent permitted by applicable law, the total aggregate liability of the Developer and its licensors for all claims arising out of or relating to the Game or these Terms will not exceed the amount you actually paid to acquire the Game.
This limitation does not apply to any liability identified in Section 6.1 or to any other liability that applicable law does not permit to be limited in this manner.
### 6.5 User and third-party causes
To the extent permitted by applicable law, the Developer is not responsible for harm or loss to the extent it is caused by your failure to follow the safety instructions in Section 5, an unsafe play area, improper or unintended use of the Game or device, unauthorized or fraudulent leaderboard activity, third-party hardware or software, Meta Platform services, internet or network failures, or events outside the Developer's reasonable control.
Some jurisdictions do not allow certain warranty disclaimers or limitations of liability. In those jurisdictions, these provisions apply only to the maximum extent permitted by applicable law.
## 7. Privacy
The Developer's handling of information is described in the **Privacy Policy for Football: Goal Poacher**, available through the Game's Meta Horizon Store listing or other official distribution page. The Privacy Policy is incorporated into these Terms by reference.
## 8. Leaderboard integrity and acceptable use
You must not knowingly submit manipulated or fraudulent scores, exploit a defect to obtain an unfair leaderboard result, interfere with the Game's connection to Meta Platform services, attempt to compromise the security or availability of the Game, or use the Game for unlawful purposes.
Where reasonably necessary to protect users, the Game, or leaderboard integrity, the Developer may investigate suspected abuse and may reject, remove, reset, or report affected leaderboard activity where technically available and permitted by Meta's policies and applicable law.
## 9. Suspension and termination
You may stop using the Game at any time and uninstall it.
The Developer may suspend or terminate the license granted under these Terms if you materially breach these Terms, create a security or safety risk, engage in fraudulent leaderboard activity, or if suspension or termination is required by law or by the platform provider. Where required by applicable law, we will provide appropriate notice and an opportunity to remedy the breach.
When the license ends, you must stop using the Game. Provisions that by their nature should survive termination—including intellectual property, warranty disclaimers, limitations of liability, governing law, and dispute provisions—will continue to apply.
## 10. Updates to the Game and these Terms
The Developer may provide updates, fixes, balance changes, compatibility changes, or security changes to the Game. An update may modify or discontinue a feature when reasonably necessary because of technical, security, legal, platform, or operational requirements. Nothing in this section limits mandatory consumer rights.
We may update these Terms to reflect changes to the Game, law, security requirements, or platform policies. Updated Terms will identify a new "Last updated" date and will be made available through an official distribution or information page. Material changes will be communicated where required by applicable law and will apply prospectively from their stated effective date. If you do not agree to updated Terms, you should stop using the Game.
## 11. Governing law and disputes
These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles. However, this choice of law does not deprive you of mandatory consumer protections or rights available under the law of your country of residence.
Before starting formal proceedings, you and the Developer are encouraged to attempt to resolve the dispute in good faith through the contact method below. If the dispute cannot be resolved informally, it may be submitted to a court or other competent dispute-resolution authority as permitted by applicable law. Nothing in these Terms restricts your right to contact a consumer protection authority or use a remedy that cannot legally be restricted.
## 12. Severability and no waiver
If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will continue in effect.
A failure by the Developer to enforce a provision is not a waiver of the right to enforce it later.
## 13. Entire agreement
These Terms and the Privacy Policy constitute the agreement between you and the Developer regarding the Game, except for any additional mandatory terms imposed by the store or platform through which the Game is provided.
