Think before you rent !
As many know, rentals can negatively impact the value of properties within an HOA. The reasoning behind this, of course, is that tenants are less likely to care for the property or follow the rules since they don't have a stake in the community.
Our association has a legal obligation to protect residents in the community from known risks or risks that landlords should have been made aware of. Some owners may feel wary of the constantly changing neighbors with rental units.
The renting of your home in a gated community involves more then you may have considered. Please review the following information to help you in your decision of renting your home. As an owner of a rental unit in an HOA, you assume all responsibility for your renters and their guests while they are in our association.
1) All rental units should be registered with the County Assessor prior to occupancy.
2) All rental units must be registered with the GE Property Manager prior to occupancy and must also be updated with every change in renter.
3) Renter contact and vehicle information must be submitted online prior to occupancy.
4) A maximum of 2 vehicles are allowed per unit without a permit issued by the board.
5) Rental unit property managers (if applicable) contact information must be supplied to the Gleneagles Property Manager.
6) All landlords must review, complete and submit the Rental Unit Policy Agreement with every change in renter.
7) All renters must receive and acknowledge the rules and regulations prior to occupancy.
8) Any damages to association property by your renters or their guests will be charged to the owner of the rental unit.
9) Any fines assessed for non-compliance of our CC&R's, By-Laws or Rules and Regulations by your renters or their guests will be charged to the owner of the rental unit.
10) Fines involving careless driving, by your renters or their guests, within association property, will be charged to the owner of the rental unit. (see Rules & Regulations for fine amounts)
11) Fines involving "pet waste removal" associated with your rental unit will be charged to the owner of the unit.
12) Gleneagles Condo association is a "Single family residential complex", all renters must fall within this definition. (Def. Single Family means a group of individuals related by blood, adoption, or marriage or a number of unrelated roommates not exceeding the number of bedrooms in a Residence.)
13) Removing a renter for non-payment of rent is a long and expensive task. If they can't pay rent they won't pay for damages to your rental unit. Consider a clause in your lease agreement to have the right to "spot check" with limited notice.
14) The minimum rental term for all rental units within Gleneagles Condo Association is 30 days.
15) It is your responsibility as a landlord to screen potential renters with current credit and criminal checks. Consider adding a crime-free addendum to your lease agreement.
16) As an owner of a rental unit, you are responsible for your renters and their guests actions within the association. The owner of the unit will be held liable for any damage, disturbance, theft or infraction conducted by your renters or anyone associated with your renters within the association.
17) Rental units tend to have a negative effect on property values within a gated community.
18) Illegal drug sellers and manufactures search for rental units to conduct illegal activity to avoid loss and damages to their own personally owned property and to avoid detection by authorities.
19) A landlord could be held criminally responsible for the criminal behaviors of the tenants.
20) There are many scams and horror stories involving rental units.
21) The selection of your renter has a impact on your neighbors and the community. Be a good neighbor...choose wisely.
