These Terms of Service ("Terms") govern your access to and use of the mobile application Gate Grinders (the "App"), provided by Kobasic ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, do not install or use the App.
You must be at least 13 years old (or 16 in the European Union) to use the App. By using the App, you represent that you meet this requirement. If you are a minor in your jurisdiction, you must have permission from a parent or legal guardian.
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a mobile device that you own or control, solely for your personal, non-commercial entertainment, and subject to these Terms.
You may not:
Copy, modify, distribute, sell, lease, or rent any part of the App;
Reverse engineer, decompile, or disassemble the App, except as permitted by applicable law;
Use the App for any commercial purpose without our written consent;
Remove any proprietary notices from the App;
Use cheats, automation tools, mods, or any third-party software to gain an unfair advantage or interfere with the App;
Attempt to access another user's account or data;
Use the App in any way that violates applicable laws.
The App offers optional in-app purchases ("IAPs") processed through Google Play Billing.
In-game coins, characters, boosters, "No Ads" status, and other virtual items (collectively, "Virtual Items") have no real-world monetary value.
Virtual Items cannot be exchanged for cash or transferred outside the App.
Virtual Items are licensed to you, not sold; you do not own them.
Prices are shown in your local currency by Google Play.
All purchases are final. Refund requests are handled exclusively by Google Play under its refund policy: https://support.google.com/googleplay/answer/2479637
We do not issue refunds directly.
If you uninstall the App, lose your device, or your Google Play account is terminated, your Virtual Items may be lost. We are not responsible for such loss.
Non-consumable purchases (such as "No Ads") may be restored on the same Google account by reinstalling the App and using the "Restore Purchases" function, where available.
The App is supported by advertising provided by Google AdMob. By using the App, you acknowledge that ads will be displayed, including banners, interstitial ads, and rewarded video ads.
If you do not wish to see ads, you may purchase the "No Ads" product, which removes banner and interstitial ads. Rewarded video ads remain available as an optional way to earn rewards.
You agree to use the App only in lawful ways and not to engage in any conduct that could damage, disable, or impair the App or interfere with another user's use of the App.
We may release updates, patches, or new versions of the App. Some updates may be required to continue using the App. We may also modify, suspend, or discontinue the App or any feature at any time without notice. We are not liable for any modification, suspension, or discontinuation.
All content in the App, including graphics, sounds, text, characters, levels, and code, is owned by Kobasic or its licensors and is protected by copyright, trademark, and other laws. Nothing in these Terms grants you any rights to such content other than the limited license described above.
We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. Upon termination:
Your license to use the App ends immediately;
You must uninstall the App;
Any unused Virtual Items are forfeited without refund.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.
WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KOBASIC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD 50.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, our liability shall be limited to the smallest extent permitted by law.
You agree to indemnify and hold harmless Kobasic and its affiliates from any claim, demand, loss, or damage arising out of your use of the App, your violation of these Terms, or your violation of any rights of another party.
These Terms are governed by the laws of the Republic of Croatia, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or the App shall be resolved by the competent courts of the Republic of Croatia, unless mandatory consumer-protection law in your country of residence provides otherwise.
We may revise these Terms at any time. The "Last updated" date at the top reflects the most recent revision. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the changes, stop using the App.
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
