Welcome to "AI Garden & Backyard Designer" (the "Application"). Your privacy is critically important to us. This Privacy Policy explains how we collect, use, transmit, and safeguard your personal data when you use our Application.
This policy has been explicitly designed to comply with global privacy standards, including Apple's App Store Review Guidelines regarding Data Collection, Data Use, and Third-Party AI Services.
1. WHAT DATA WE COLLECT
When you use the Application to design your outdoor spaces, we collect the following data:
- Text Prompts: The textual descriptions, ideas, and parameters you manually type into the Application to describe your desired garden, patio, or backyard layout.
- App Usage Data: Non-identifiable diagnostic data, such as crash reports and feature usage analytics, to help us improve the Application.
We do NOT collect, store, or transmit your name, email address, phone number, location, or biometric data. The Application only requires access to your device’s Photo Library strictly for the purpose of SAVING the generated images to your local device at your request. We do not upload your personal photos.
2. HOW WE COLLECT YOUR DATA
The data we collect is provided directly and voluntarily by you. Text prompts are collected only when you type them into the generation text box and explicitly tap the "Generate" button.
3. HOW WE USE YOUR DATA
The text prompts you provide are used for a single, specific purpose: to generate the architectural and landscape visual concepts you requested. We do not use your data for targeted advertising, nor do we sell or rent your data to any data brokers or marketers.
4. THIRD-PARTY AI SERVICES (WHO YOUR DATA IS SENT TO)
To provide our core AI-generation features, the Application must transmit your text prompts to specialized, industry-leading third-party Artificial Intelligence providers.
By using the Application, your text prompts (and only your text prompts) are securely transmitted to:
- OpenAI, LLC: Used to process, refine, and translate your text input into a highly detailed landscape architecture prompt.
- Replicate, Inc.: Used to render the actual high-resolution image based on the refined prompt.
5. USER PERMISSION AND CONSENT
We do not send any of your text inputs to our third-party AI partners without your explicit action. By tapping the "Generate" button within the Application, you explicitly grant us permission to securely transmit your typed text to OpenAI and Replicate for the sole purpose of rendering your image. We provide an in-app disclosure notifying you of this process before you use the AI features.
6. EQUAL PROTECTION BY THIRD PARTIES
We have carefully vetted our third-party AI service providers (OpenAI and Replicate) to ensure they handle your data securely.
- Your transmitted text prompts are sent via secure, encrypted connections (HTTPS/SSL).
- We utilize the enterprise APIs of these providers. Under their respective data processing agreements, OpenAI and Replicate do not use the data submitted through their APIs to train their public models.
- We confirm that these third parties provide the same or equal protection of your data as stated in this Privacy Policy, complying with strict industry data security standards.
7. DATA RETENTION AND DELETION
We do not store your text prompts or generated images on our remote servers. Once the image is generated and returned to your device, the transaction is complete. The generated images are stored locally on your device. You have the right to delete these images from your device or delete the Application at any time, which instantly removes all associated local data.
8. CHILDREN'S PRIVACY
Our Application does not knowingly collect or solicit any information from anyone under the age of 13. If you are under 13, please do not use or provide any information in the Application. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible.
9. CHANGES TO THIS PRIVACY POLICY
We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date. You are advised to review this Privacy Policy periodically for any changes.
