Welcome to AI Future Baby Face Generator+ ("the App"). These Terms of Use ("Terms") govern your access to and use of our mobile application. By downloading, installing, or using the App, you agree to be bound by these Terms.

Please read these Terms carefully before using the App. If you do not agree to these Terms, do not use the App.

1. ACCEPTANCE OF TERMS

1.1 Agreement

By accessing or using AI Future Baby Face Generator+, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy.

1.2 Modifications

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms in the App. Your continued use of the App after such modifications constitutes your acceptance of the revised Terms.

Certain features of the App may be subject to additional terms and conditions, which will be presented to you when you access those features.

2. DESCRIPTION OF SERVICE

2.1 App Features

AI Future Baby Face Generator+ is an AI-powered entertainment application that provides the following features:

• AI Baby Generator: Uses artificial intelligence to generate predictions of what a future baby might look like based on photos of two parents (mother and father). Users can generate baby predictions at various ages.

• Who Does Baby Look Like: Analyzes photos of both parents and a child to determine which parent the child resembles more, providing percentage breakdowns of maternal vs paternal resemblance.

• AI Pregnancy Photo Generator: Transforms user photos into AI-generated pregnancy/maternity photos with various artistic styles.

• History & Gallery: Allows users to save and access previously generated results.

2.2 Entertainment Purpose Only

THE APP IS DESIGNED FOR ENTERTAINMENT PURPOSES ONLY. The AI-generated baby predictions, resemblance analyses, and pregnancy photos are:

• NOT scientifically accurate

• NOT based on actual genetic analysis

• NOT intended to predict actual genetic outcomes

• NOT medical, genetic, or scientific advice

• Created using artificial intelligence image generation technology

2.3 No Guarantees

We make no guarantees, representations, or warranties regarding:

• The accuracy of baby predictions

• The accuracy of resemblance percentages

• The quality or realism of generated images

• Any similarity between generated images and actual future children

3. ELIGIBILITY

3.1 Age Requirements

You must be at least 13 years of age to use this App. If you are between 13 and 18 years of age, you must have permission from a parent or legal guardian to use the App.

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your device and for all activities that occur through the App on your device.

3.3 Accurate Information

You agree to provide accurate, current, and complete information when using the App and to update such information as necessary.

4. USER CONTENT AND CONDUCT

4.1 Photo Uploads

By uploading photos to the App, you:

• Represent and warrant that you own the photos or have the right to use them

• Represent and warrant that you have obtained consent from any individuals depicted in the photos

• Grant us a limited, non-exclusive license to process the photos for the purpose of providing our services

• Understand that photos will be processed by third-party AI services (Google Gemini API)

4.2 Prohibited Content

You agree NOT to upload photos that:

• Contain nudity, sexually explicit content, or pornographic material

• Depict violence, abuse, or harm to individuals

• Contain hate speech, discrimination, or offensive content

• Infringe on the intellectual property rights of others

• Violate the privacy rights of others without their consent

• Contain images of minors without parental consent

• Are illegal or promote illegal activities

• Contain malware, viruses, or harmful code

4.3 Prohibited Uses

You agree NOT to use the App to:

• Harass, abuse, or harm another person

• Create content that is defamatory, obscene, or offensive

• Impersonate any person or entity

• Violate any applicable laws or regulations

• Interfere with or disrupt the App or servers

• Attempt to gain unauthorized access to the App or its systems

• Use the App for any commercial purpose without our permission

• Reverse engineer, decompile, or disassemble the App

• Use automated systems or bots to access the App

• Create deepfakes or misleading content intended to deceive others

4.4 Content Responsibility

You are solely responsible for all content you upload to the App. We do not endorse or guarantee any user-generated content and reserve the right to remove any content that violates these Terms.

5. INTELLECTUAL PROPERTY

5.1 App Ownership

The App, including its design, features, functionality, and content (excluding user-uploaded photos), is owned by us and is protected by copyright, trademark, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

5.3 Generated Content

• AI-generated baby predictions, resemblance analyses, and pregnancy photos created through the App are provided for your personal use

• You may share generated content on social media or with friends and family

• You may not use generated content for commercial purposes without our written permission

• We retain no ownership rights over photos you upload

5.4 Restrictions

You may not:

• Copy, modify, or distribute the App or its content

• Use our trademarks, logos, or branding without permission

• Remove any copyright or proprietary notices from the App

• Create derivative works based on the App

6. SUBSCRIPTIONS AND PAYMENTS

6.1 Subscription Plans

The App offers subscription plans that provide access to premium features. Available subscription options include:

• Weekly subscription

• Yearly subscription

6.2 Free Trial

Some subscription plans may include a free trial period. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

6.3 Payment Processing

• All payments are processed through Apple's App Store

• By subscribing, you agree to Apple's terms and conditions for in-app purchases

• We do not have access to your payment information

6.4 Auto-Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

• Your account will be charged for renewal within 24 hours prior to the end of the current period

• You can manage and cancel subscriptions in your App Store account settings

6.5 Cancellation

• You may cancel your subscription at any time through your App Store account settings

• Cancellation will take effect at the end of your current billing period

• You will continue to have access to premium features until the end of your paid period

6.6 Refunds

• Refund requests are handled by Apple in accordance with their refund policies

• We do not process refunds directly

• Contact Apple Support for refund inquiries

7. DISCLAIMERS

7.1 "As Is" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

7.2 No Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY

• WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE

• WARRANTIES OF NON-INFRINGEMENT

• WARRANTIES REGARDING ACCURACY, RELIABILITY, OR COMPLETENESS

7.3 AI Limitations

You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, or unexpected results

• The AI technology used in the App has limitations and may not produce desired results

• Generated baby predictions are fictional and may not resemble actual future children

• Resemblance percentages are estimates and not scientifically validated

7.4 Third-Party Services

We are not responsible for the actions, content, or policies of third-party services used by the App, including Google Gemini API, Apple, and RevenueCat.

7.5 Technical Issues

We do not guarantee that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

8. LIMITATION OF LIABILITY

8.1 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES

• DAMAGES RESULTING FROM YOUR ACCESS TO OR USE OF THE APP

• DAMAGES RESULTING FROM ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS

• DAMAGES RESULTING FROM ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP

8.2 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

8.3 Essential Purpose

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. INDEMNIFICATION

9.1 Your Responsibility

You agree to indemnify, defend, and hold harmless AI Future Baby Face Generator+, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App

• Your violation of these Terms

• Your violation of any rights of another party

• Any content you upload to the App

• Your violation of any applicable laws or regulations

10. TERMINATION

10.1 Termination by You

You may stop using the App at any time by uninstalling it from your device.

10.2 Termination by Us

We reserve the right to:

• Suspend or terminate your access to the App at any time, with or without cause

• Remove any content that violates these Terms

• Take appropriate legal action against users who violate these Terms

10.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease

• We may delete any data associated with your use of the App

• Provisions of these Terms that by their nature should survive termination will remain in effect

11. GOVERNING LAW AND DISPUTE RESOLUTION

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Any disputes arising from or relating to these Terms or the App shall be resolved through:

• Good faith negotiations between the parties

• If negotiations fail, through binding arbitration in accordance with applicable arbitration rules

• You agree to waive any right to a jury trial

11.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

12. GENERAL PROVISIONS

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

12.5 Notices

We may provide notices to you through the App, by email, or by other reasonable means.

13. APPLE-SPECIFIC TERMS

13.1 Acknowledgment

You acknowledge that these Terms are between you and AI Future Baby Face Generator+ only, not with Apple, and Apple is not responsible for the App or its content.

13.2 Scope of License

The license granted to you for the App is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the App Store Terms of Service.

13.3 Maintenance and Support

We are solely responsible for providing any maintenance and support services for the App. Apple has no obligation to provide any maintenance or support services.

13.4 Warranty

We are solely responsible for any product warranties. Apple has no warranty obligation with respect to the App.

13.5 Product Claims

We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.

13.6 Intellectual Property Claims

We, not Apple, are responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claims.

13.7 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

15. CONSENT
