I. Terms and Definitions
For purposes of these Terms of Use, the following terms shall have the meanings as specified below:
Lernest: means the Lernest company which is the owner and the copyright owner of the Full Stack EAP and its services.
Services: mean services, including, but not limited to, Market, Signals, Freelance, Blogs, Articles
"User" means You or any person or entity who uses https://sites.google.com/view/fullstackexpertadvisor and who has placed an Order of service is hereinafter referred to as the Customer.
Full Stack EAP chooses the most viable option or application to provide software development services as submitted by the customer via email @ fullstackexpertadvisor@gmail.com
Full-Stack EAP developer and customer begins to negotiate the details of the Order
If no conditions for transferring exclusive rights to the program developed via the Developer service are set in the requirements specification, all the exclusive rights to the ordered software belong to the Customer. In that case, Full-Stack EAP developer can use the developed software for his or her own needs on the terms of a free and simple (non-exclusive) license within the entire duration of the exclusive right.

II. Fulling and Execution of Software development Orders
An Order passes through the following execution steps:
Work Agreement
Requirements Negotiation
Part Payment (70%)
Demonstration
Work Acceptance
Payment Commpletion (30%)
At each step, the Customer and the Full Stack EAP (Developers) shall confirm the fulfilment of their obligations on this step.
Only after the confirmation of both parties involved in the Order, they can go to the next step.
Prototype/Model
The Developer provides a Prototype or Model of the ordered solution to the Customer, in order to agree on the operation mode and/or appearance.
The Prototype/Model is not required to contain the entire functionality described in the requirements specification, being only an outline or draft.
On this step, the Customer and the Developer shall specify the fine details of the final order, which does not affect the overall operation of the ordered solutions, but can bring additional comfort during utilization.
For the Prototype, the Developer can provide outlines, configuration dialogs, templates of information panels positioning, examples of technical messages to print in the "Experts" journal and so on.
The ultimate goal of the discussion at this step is the approval of an agreement on how a complete solution should look like.
Demonstration
Before delivering the work to the Customer, the Developer shall demonstrate the operation of the complete solution.
The parties may have further discussions to fix detected errors or add some clarifications.
The ultimate goal is the approval of the Customer that the presented materials allow the transfer of work from the Developer to the Customer.
Specific details of what is a demonstration and criteria of checking whether a solution complies with the Order, must be specified in the Requirements Specification.
Work Acceptance
The completed work is delivered by way of providing files. The number of files is not limited. Files with *.dll extension are delivered only in a compressed form
Communication must be done via email, from / to: fullstackexpertadvisor@gmail.com or any platform provided by Full Stack EAP
Upon the completion of step Requirements Negotiation, a 70% Payment of the agreed sum will be made by the customer and at the 30% of the agreed sum will be made when the job is completed successfully and confirmed by the customer.
Payment will be made via “PAY-STACK” a third-party payment company for Lernest/ Full Stack EAP services.
A 10% non-refundable fee is paid in order to process any project while 90% of funds is refundable in case of any dispute.
In case any disputes arise out of the Order execution: the arbitration may make one of three decisions:
To complete the job in favor of the Developer: 100% of the amount blocked for a job in question is deducted from the Customer's account, while 90% of this amount is transferred to the Developers account and 10% is the service commission. The job is classified as "Completed" and the feedback can only be given by the Developer.
To cancel the job in favor of the Customer: 10% of the amount blocked for a job in question is deducted from the Customer's account, while the remaining 90% is released; no amount is transferred to the Developer's account and the service commission is 10%.
To lay the blame for the situation on both parties and split the money in half minus Freelance service commission, namely:
10% of the amount blocked for a job in question is deducted as the Freelance service commission,
the remaining 90% of the Agreement sum is divided into two halves: the first half (45% of the Agreement sum) is returned to the Customer's account, while the second half (45% of the Agreement sum) is used to pay the Developer 50% of the original due payment,
the job is classified as "New" and becomes available to new Developers; the feedback can be given by both parties - the Developer and the Customer.
III. Payments
All payments are made in the internal Payment system or third party "PAY STACK" used by Lernest/Full-stack EAP, hereinafter referred to as the Payment System.
IV. Liability of the Parties
Lernest or Full Stack EAP shall not be liable for any direct or consequential loss, as well as for lost profits from the operation of a completed Order developed via the Developer service.
Using the Developer service to place and execute the Orders violating the law (decomplication, creating malware or spyware, etc.) is forbidden
V. Termination of Service Without Prior Notice in Case of Serious Violations of Terms of Use
According to the provisions by Lernest on the https://sites.google.com/view/fullstackexpertadvisor website. Lernest/ Full Stack Eap reserves the right to permanently terminate the service and the Agreement without prior notice.
Below are the examples of serious violations of the Terms of Use of FULL-STACK EAP:
Any actions that threaten the operation of the https://sites.google.com/view/fullstackexpertadvisor web site services for other users.
Interception, imitation or redirection of the communication protocols used as a part of https://sites.google.com/view/fullstackexpertadvisor web site services regardless of the method of performing the above actions.
Working with Full-STACK EAP web site services via a third-party modified interface provided neither by Lernest/Full-STACK EAP on https://sites.google.com/view/fullstackexpertadvisor web site.
Development or use of means for fraud, modifiers, hacking tools, decompilers, as well as any other third-party software to illegally modify the operation of https://sites.google.com/view/fullstackexpertadvisor site services.
The use of any third party software that intercepts, collects or otherwise gathers information included in https://sites.google.com/view/fullstackexpertadvisor web site services or transmitted through it.
Use of the Developer service for carrying out any fraudulent financial transactions, including creation of fictitious jobs for making third-party payments. Any correspondence between the Customer and the Developer, as well as submission of order execution results must be made directly in the conducted work on the https://sites.google.com/view/fullstackexpertadvisor web site.
Performing attacks on any of LERNEST. or Full Stack EAP servers, participation in such attacks or engaging in them, as well as other attempts to hinder the servers operation.
Removal, obscuring or altering copyright notices, trademarks, or other proprietary rights notices of Lernest or Full Stack EAP.
Reproduction, copying, selling, exchange and reselling the content of https://sites.google.com/view/fullstackexpertadvisor web site services, unless otherwise permitted by a separate agreement with Lernest.
VI. Privacy and Personal Data Protection.
We use personal data, which help us to create, develop, manage, provide and improve our Services and contents, as well as to protect against fraud and copyright violation.
We may occasionally use Your personal data to send You important notices of changes in our Terms of Services or Policies. We may also use personal data for internal purposes, such as auditing, data analysis and research, which enable us to improve our Services.
When You visit our websites, we may collect technical and navigational information, such as the type of the web browser, Internet protocol address, language, location, time zone, unique device/browser identifier and requested URLs so that we may better understand customer behavior and improve our Services. We may also collect information regarding specific activities you perform on our website. This information is used to help us improve the content and usability of our websites. This information is aggregated and we consider aggregated information as non-personal for the purposes of our privacy policy If we do combine non-personal information with personal information the combined information will be treated as personal information for as long as it remains combined.
VII. Additional Terms and agreement
Terms of Use: This constitutes the entire agreement between Lernest and the User, as well as updated, modified and/or amended future versions thereof as now or hereafter in effect.
Additional Agreements: mean agreements that apply to Your use of Full Stack EAP Services, published or declared in addition to these Terms of Use.
Content: means any and all content, consisting of text, sounds, pictures, design, photos, video and/or any type of information or communications.
Trademarks: mean trademark and service mark names, logos, domain names and other distinctive features of trademarks of their respective owners (or license holders).
Intellectual Property Rights: mean patents, patent applications, designs, trademarks and trade names (registered and unregistered), copyrights and other similar rights, database rights, computer software rights, technology, know-how and confidential information, all other intellectual property rights and similar or equivalent rights anywhere in the world that exist now or may exist in the future, as well as applications, alterations and amendments to any of the above rights.
Payment Processor: means a third-party payment system authorized by Lernest to provide payment processing services related to financial transactions in https://sites.google.com/view/fullstackexpertadvisor.
Payment Account: means a financial account issued by the Payment Processor in its payment system pursuant to a separate agreement with a User whose use of the Payment Account must be approved by the Payment Processor.
Personal Data: User's personal details provided by him/her when registering, emailing or paying for a service on Full Stack EAP Website.
These Terms of Use, as well as updates hereof, constitute the entire agreement between You and Lernest and govern the terms on which You can use the website https://sites.google.com/view/fullstackexpertadvisor and it Services.
By Using these services, you agree to the Terms of Use of this Agreement.
The User who has not agreed to be bound by these Terms of Use shall have no right to use the website https://sites.google.com/view/fullstackexpertadvisor and its Services.
The website https://sites.google.com/view/fullstackexpertadvisor is available for use by persons aged 18 and older.
These Terms of Use will automatically cease to be effective if it appears that You are under the age of 18, or (c) a person who is not allowed to use the Full Stack EAP in accordance with the applicable law of any country, including the country of Your residence.
If You are a company employee or executive and You use https://sites.google.com/view/fullstackexpertadvisor on behalf of Your company ("Company"), You accept and agree to the below:
i. By Using https://sites.google.com/view/fullstackexpertadvisor You acknowledge that You are explicitly authorized to do so by the Company based on Your and Company's compliance with this Agreement regarding the use of Full Stack EAP by You and the Company;
ii. You have obtained all consents, approvals and authorizations from the Company whatsoever needed, allowing You to officially act on behalf of the Company under these Full Stack EAP Terms of Use. You represent and warrant that You have obtained such consents, approvals and authorizations to use https://sites.google.com/view/fullstackexpertadvisor on behalf of the Company. If You do not have such authority, You shall not have the right to use Full Stack EAP website.
You acknowledge and agree that by accepting these Terms of Use, as well as Additional Terms and Additional Agreements, You enter into a legally binding agreement with Lernest In case of any conflict between the Additional Terms or Additional Agreements and these Terms of Use, Additional Terms or Additional Agreements shall prevail with respect to any particular service offered by Lernest on the https://sites.google.com/view/fullstackexpertadvisor website
We reserve the right to revise and update any of these Agreements, Terms and Rules from time to time. Such changes shall be effective upon their publication on the https://sites.google.com/view/fullstackexpertadvisor site. Before using any of Full Stack EAP Services, you are required to read and accept the corresponding Rules, Additional Terms and Additional Agreements.
You hereby consent to the use of electronic communication in order to enter into agreements, contracts, make payments, place orders and other records, as well as to the electronic delivery of notices, policies and records of transactions initiated or completed via the website https://sites.google.com/view/fullstackexpertadvisor and its services
Furthermore, You hereby waive any rights or requirements under any laws or regulations in any jurisdiction which require an original non-electronic signature or delivery or retention of non-electronic records, to the extent permitted by applicable mandatory law.
If You are a resident of a jurisdiction where the use of the https://sites.google.com/view/fullstackexpertadvisor or the Full Stack EAP Services is prohibited by law due to different requirements or a complete ban on the use of Full Stack EAP Services in any such jurisdiction, do not use them.
