1. ACCEPTANCE OF TERMS By downloading, installing, or using Foundly, you agree to be bound by these Terms of Use. If you do not agree, you must immediately cease use of the Application and delete it from your device.
2. ELIGIBILITY AND CONDUCT You must be at least 18 years of age. You agree NOT to use Foundly for:
Stalking, harassment, or unauthorized surveillance.
The extraction of data for commercial purposes (scraping).
Any activity that violates local, state, national, or international laws.
3. THE "COMMUNITY INSIGHTS" FEATURE By enabling contact synchronization, you represent and warrant that you have the requisite authority or implied consent from your contacts to process their metadata in an anonymized fashion. You acknowledge that Foundly acts as a neutral platform for user-contributed labels and does not verify the accuracy or intent of how contacts are named by other users.
4. INTELLECTUAL PROPERTY All software, algorithms, UI/UX designs, and brand assets are the exclusive property of Foundly. You are granted a limited, non-exclusive, non-transferable license for personal, non-commercial use.
5. DISCLAIMER OF WARRANTIES THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." FOUNDLY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SOCIAL MEDIA IDENTITIES DISCOVERED ARE ACCURATE, COMPLETE, OR UP-TO-DATE.
6. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOUNDLY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM (A) YOUR ACCESS TO OR USE OF THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
7. INDEMNIFICATION You agree to indemnify, defend, and hold harmless Foundly and its officers, directors, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from your use of the Application, your violation of these Terms, or your violation of any third-party rights, including privacy rights.
