DNA evidence is one of the main components of most criminal cases. The ever- evolving, more sensitive and discriminating technologies, procedures, and complicated interpretations can be difficult to navigate for defense counsel. The only way to sufficiently prepare a defense is to fully understand the significance of the DNA results in a case AFTER validating the work that was done by the prosecution.
The comprehensive review of a DNA case begins with the case background; this information is crucial to fully understand the context and circumstances surrounding the allegation(s) and interpret the evidence accordingly. The complete DNA case file from the prosecution's lab(s) will then be reviewed for methodology and potential errors, as well as alternative interpretation(s) and implications of the results presented in their report(s). This often involves reviewing the lab(s)' validations, Standard Operating Procedures, contamination records, corrective action reports, etc.
