When you use any of our apps referenced above, you trust us with your personal data. We’re committed to keeping that trust. That starts with helping you understand our privacy practices. This Policy provides summaries of the data we collect and how we use it.

This notice describes how FoodyGhana and its affiliates collect and use data. This notice applies to all Foody Ghana Users. This notice specifically applies to:
· Customers: those who request or receive food or other products and services for delivery or pick-up via their FoodyGhana.
· Drivers: those who provide courier delivery service to customers individually via their Foodydriver app
· Merchant: those who provide delivery services via FoodyMerchant
· Guest users: those without an FoodyGhana app account who receive delivery services ordered by Backend staff of FoodyGhana.
Our privacy practices are subject to applicable laws in the places in which we operate. This means that we engage in the practices described in this notice in a particular country or region only if permitted under the laws of those places.

Data provided by users. This includes:
Account information: We collect data when users create or update their FoodyGhana accounts, or place orders via backend staff call inn order. This includes first and last name, email, phone number, login name and password, address, payment or banking information (via third party payment gateway- Paystack - https://paystack.com/)/ OTP via WhatsApp message provided by https://whatsify.me/
Background check information (Merchant): This includes information submitted during the driver/delivery person application process, such as driver history or criminal record (where permitted by law), license status, known aliases, prior addresses, and right to work in This information is collected by FoodyGhana Onboarding Team.
Identity verification documents and photos: This includes government issued identification such as driver’s license or passports (which may contain identification photos and numbers, date of birth, and gender), and user-submitted photos such as selfies and profile pictures.
User content: We collect data (including chat logs and call recordings) when users contact FoodyGhana customer support, provide ratings or feedback for users, restaurants or merchants, use features that enable users to upload content or submit recordings (including in-app audio recordings or dashboard cameras recordings), or otherwise contact FoodyGhana app.
Data created during use of our services.
This includes:
Location data (Merchant, Drivers and Customers): We collect precise and approximate location data from delivery person, Drivers and Customers’ mobile devices when the Foodyghana app is running in the foreground (app open and on-screen) or background (app open but not on-screen). Consent must be given by the user before the such data can be collected either while using the app or only at that particular time.
FoodyGhana collects such data from the time an order is requested until it is finished, and any time the app is running in the foreground (app open and on-screen). See “Choice and transparency” below for information on how Customers enable precise location data collection.
Customers enable precise location data when they manually enter their delivery address or enable a location turn on button for FoodyGhana app to automatically pick up their precise location.
In addition, precise location data collected from a driver’s device during a delivery is linked to the customer’s account, even if the customer has not enabled precise location data to be collected from their device. This data is used for purposes such as customer support, fraud detection, insurance, litigation and receipt generation.
An in-app notice is another way the Foodydriver app collects location data to enable better order management and live order tracking of delivery partners even when the app is closes or not in use. Live location tracking is turned off automatically when the logged out. consent must be given by the user to access device location either while using the app or only at that particular time.
Transaction information: We collect transaction information related to the use of our services, including the type of services requested or provided; order details (such as date and time, requested pick-up and drop off addresses, distance travelled and items ordered); and payment transaction information (such as a restaurant’s or merchant's name and location, amount charged, and payment method).
Usage data: We collect data about how users interact with our services. This includes access dates and times.
Communications data: We collect data regarding communications between users that are enabled through FoodyGhana apps. This includes communication type (text, date/time, and content).
How We Use Data
FoodyGhana uses data to enable reliable and convenient delivery services. We also use data:

• create/update accounts.
• enable delivery, such as:
· using location data to navigate Driver pick-ups and order drop-offs, calculate ETAs, and track the progress of drivers or deliveries.
· enabling features that involve data sharing, such as sharing driver first name and last information with Delivery person to facilitate pick-ups of orders, or features that enable ETA sharing and delivery charges.
· matching available drivers and Merchant to users requesting services, including based on personal data such as location and proximity to Merchant.
· calculating delivery charges, including using location data and trip or order details (such as requested order pick-up and drop off addresses). We may also consider non-personal data or factors, including date and time, estimated distance and time, minimum base charge, taxes and fees, and surge pricing.
· process payments, and enable payment and e-money products such Mobile money
· personalize users’ accounts. For example, we may present Customers with personalized restaurant or food recommendations based on their prior orders and delivery location.

Some Foody Ghana’s services and features require that we share data with other users, or at users’ request or with their consent. We may also share such data with our affiliates, subsidiaries, and partners, for legal reasons or in connection with claims or disputes.

Third-Party Services:
Whatsify: When obtaining OTP via Whatsify for authentication purposes, your phone number is shared with Whatsify. This helps in facilitating the secure and seamless verification process.
Payment Processing: Payment details, such as phone numbers and card information, are securely handled by Paystack, our trusted third-party payment provider. Foody Ghana does not store or retain this sensitive payment data directly.
User Communication and Operations:
User Contact Information: Phone numbers for customers, merchants, and delivery drivers may be shared among these users to facilitate order-related communications. This enables efficient and timely communication regarding order placement, delivery status, and operational updates.
Foody Ghana Staff Access: Our backend office staff may have access to user details for operational purposes, including promotions, fraud alerts, refunds, and other essential operational communications. This access is strictly limited to operational necessities and is employed solely to enhance user experience and ensure smooth service delivery.
Please note that any sharing of data with third-party services is conducted in accordance with our stringent privacy and security standards. Foody Ghana ensures that such data sharing is essential for service provision and operates under strict confidentiality agreements to safeguard your information.

Data retention and deletion
FoodyGhana retains user data for as long as necessary before offboarding. Users may request account deletion through the Foodyapps and websites. Alternatively, user can access how their account can be deleted from the https://foody.com.gh/pages/delete-account
FoodyGhana retains user data for as long as necessary for the purposes described above, which varies depending on data type, the category of user to whom the data relates, the purposes for which we collected the data, and whether the data must be retained after an account deletion request for legal purposes as part of domestic compliance processes.
For example, we retain data:
• for 1 year if necessary to comply with tax requirements. E.g., drivers’ and Merchant’ delivery location information.
Users may request deletion of their account through the account deletion tab in the Foodyapp, FoodyMerchant app or through Foodyghana website (https://foody.com.gh/pages/delete-account).
Following an account deletion request, we delete the user’s account and data, except as necessary for purposes of safety, security, fraud prevention or compliance with legal requirements, or because of issues relating to the user’s account (such as an outstanding credit or an unresolved claim or dispute). For drivers and Merchant, this generally means that we retain certain of their data for as long as necessary for actual or potential tax, litigation, or insurance claims. For Customers, we generally delete data within a day of an account deletion request, except where retention is necessary for the above reasons.
