WHO THESE TERMS COVER
These terms are between you and AppSurge commv, Belgium (“AppSurge,” “we,” or “us”). They apply to our mobile apps and related services that link to these terms. By using them, you agree to these terms; if you do not agree, stop using them. Features differ by app and platform. Apple App Store or Google Play terms also apply to downloads and purchases made through those stores. If you use an app on behalf of an organization, you must have authority to do so.
If you are below the age at which you can enter a binding agreement where you live, a parent or guardian must agree to these terms for you. Our apps are not directed specifically to children under 13. Adults who provide a child’s information or photograph must have authority to do so.
YOUR USE OF THE APPS
We grant you a limited, non-exclusive, non-transferable right to install and use the apps through your authorized store account, subject to these terms and applicable store rules. You may use features, including creative and automation tools, for lawful personal or business purposes. We retain rights in our app software, designs, names and other materials that we provide.
Do not use our services to violate another person’s intellectual-property, privacy or other rights; create non-consensual intimate material or exploitative content involving children; impersonate someone deceptively; attack our systems; or bypass purchase and usage controls. Do not interfere with other users or use the apps in a way that violates applicable law. We may restrict access or remove submitted content when reasonably necessary to address violations, abuse, safety or legal requirements.
YOUR CONTENT AND AI RESULTS
You are responsible for content you submit and must have the rights and permissions needed to use it, including when it depicts another person or a child. You retain any rights you have in your submitted content. You allow us and the providers needed for a feature to host, transmit, process and store that content to deliver the feature, maintain and secure the service, and handle support or reports you submit. You may use results generated for you, subject to applicable law and others’ rights. AI results can be inaccurate, unexpected, similar to results given to others, or unsuitable for your purpose. We do not guarantee that a result is unique or eligible for copyright protection. Review it before publishing, relying on or sharing it. Health, nutrition and wellness features provide general information and are not a medical diagnosis or a substitute for qualified professional advice.
AppSurge does not use customer information to train AI models. Any feature-specific disclosure or permission required before sharing personal content with a third-party AI service is separate from these terms.
PURCHASES AND SUBSCRIPTIONS
Paid features and plans vary by app. The price, billing period and any trial or introductory offer shown by Apple or Google before purchase govern that purchase. Subscriptions renew and are charged through the store unless you cancel before the next renewal under the store’s rules. You can manage or cancel an Apple subscription in your Apple account’s Subscriptions settings, or a Google Play subscription in Google Play’s Subscriptions section. Uninstalling an app does not cancel a subscription. Unless a different rule or applicable law provides otherwise, cancellation leaves paid access available until the current paid period ends.
Apple or Google handles store billing and its refund request process. For purchase problems, contact the store where you paid or email us at info@appsurge.app. Nothing here limits any refund, withdrawal or other consumer right that applies where you live. Changes to subscription prices or offers take effect only as allowed by the store’s rules and applicable law.
AVAILABILITY AND CHANGES
We may update features, fix errors, suspend a feature or discontinue a service. We aim to keep the apps working, but availability and AI results can be affected by network, device, store and provider conditions. If a material change affects a paid service, your statutory rights and any applicable store remedies continue to apply.
We may update these terms and their date. We will give additional notice or seek agreement when required by law. Your use after an update is subject to the updated terms to the extent allowed by law.
RESPONSIBILITY AND LEGAL RIGHTS
We provide the services with reasonable care and skill as required by applicable law. We are not responsible for losses that could not reasonably have been expected when you agreed to these terms, or losses caused by your breach of these terms or by third-party services outside our control, to the extent the law permits. Nothing in these terms excludes or limits liability or consumer rights where doing so is unlawful.
Belgian law governs these terms, without taking away mandatory consumer protections in your country of residence. Any dispute may be brought before a court that has jurisdiction under applicable consumer law. You may contact us first to seek a practical resolution, but you are not required to give up any right to bring a claim.
