The Building Division is responsible for the issuance of building permits for new construction and renovations. The applications are reviewed for compliance with zoning codes, the Florida Building Code and other regulatory agencies. Inspections by qualified, licensed inspectors are required to insure the compliance of construction with code requirements. The City of Aventura would like to stress that it is against state law to do business with an unlicensed contractor.

This new edition of the Florida Building Code is effective December 31, 2023. All applications and documentation submitted for a permit as of this date must reflect this new code. Please make note of this date.

The Florida Building Code is based on national model building codes and national consensus standards, in addition to Florida-specific provisions. The code incorporates all building construction-related regulations for public and private buildings in the State of Florida other than those specifically exempted by Section 553.73, Florida Statutes. It has been harmonized with the Florida Fire Prevention Code, which is developed and maintained by the Department of Financial Services, Office of the State Fire Marshal, to establish unified and consistent standards.

The code is composed of nine main volumes: the Florida Building Code, Building, which also includes state regulations for licensed facilities; the Florida Building Code, Plumbing; the Florida Building Code, Mechanical; the Florida Building Code, Fuel Gas; the Florida Building Code, Existing Building; the Florida Building Code, Residential; the Florida Building Code, Energy Conservation; the Florida Building Code, Accessibility and the Florida Building Code, Test Protocols for High-Velocity Hurricane Zones. Chapter 27 of the Florida Building Code, Building, adopts the National Electrical Code, NFPA 70, by reference.

Our primary mission is to provide for the public safety, health, and general welfare in the built environment through education and enforcement of the building codes, local ordinances, and state laws. Life safety is our main goal and objective.

The Building & Permitting Services Department is responsible for inspecting new and active construction-related issues, construction parking, additions, and remodeling structures in accordance with the Florida building codes, as well as issues pertaining to business licenses (zoning should be checked, the applicant must have appropriate parking for business, and change out of signs must be approved/permitted). You may access all Florida Building Code Editions at floridabuilding.org or purchase the codes at boaf.net or iccsafe.org.

We are committed to ensuring a smooth transition for your projects and will be providing plans in compliance with the current 7th edition code through December 15th. After that date, all plans will be engineered and drafted to comply with the new 8th edition.

The new section that references mounting systems presents us with an opportunity to review the flashing requirements in the code. In particular, we should review the following sections and how they are related to rooftop solar installations.

Rooftop Solar Energy Systems are very complex and are covered extensively in other areas of the code including many referenced standards. This article is meant to address some of the specific items where solar systems interface with or comprise an integral part of the roof coverings.

The Building Inspection Division's primary responsibility is to inspect all buildings, structures, and facilities within City limits to protect the public health, safety, and general welfare by ensuring compliance with state and local building code regulations. Some of the activities related to enforcing the Florida Building Code include:

The effective date for the 7th Edition (2020) Florida Building Codes and the 2017 National Electrical Code is December 31, 2020. All applications submitted on, or after, December 31, 2020, shall be designed in accordance with the 7th Edition (2020) Florida Building Code for Building, Residential, Existing Building, Energy Conservation, Fuel Gas, Mechanical, Plumbing, and/or the 2017 National Electrical Code. These Codes and prior editions may be accessed online at the Florida Department of Business and Professional Regulation website. Visit the National Fire Protection Association website to learn about current codes and standards.

The Planning and Development Department is not required to approve private property real estate transactions. However, interested parties may want to verify that a site (property) can accommodate any existing/proposed types of use(s) and/or buildings meet all requirements for public health, safety and general welfare as well as local utility, code enforcement and zoning-related requirements (parking, grease interceptors, signage, sanitation, property maintenance, variances, special exceptions, setbacks, etc.) and fire-related (fire hazards, distance requirements, life safety, etc.) codes and there are not any existing non-conformities that may need to be rectified.

Applicants who utilize the Cookie Cutter or Master Model Programs should begin updating models to comply with the new code to avoid permitting delays. It is also important to keep in mind that any application submitted via the online portal after the close of business at 4 p.m. on Dec. 29, will have to comply with the 2023 edition.

RER will be hosting informational online workshops in the coming months to help you prepare for these changes. These sessions will provide detailed insights into the code changes. You may register in advance for the courses held via Zoom below:

The current adopted codes are the 2020 National Electric Code and the 2023 Florida Building Code (8th Edition), including Residential, Building, Existing Building, Energy Conservation, Accessibility, Fuel and Gas, Plumbing, and Mechanical.
