1. Acceptance of Terms
By downloading, installing, or using Fix & Restore Old Photos: Fixy ("Fixy", "the App", "we", "us", or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.
2. Description of Service
Fixy is an AI-powered photo restoration and editing application that provides the following features:
- Enhance: Sharpen and improve photo quality
- Colorize: Add color to black and white or faded photos
- Descratch: Remove scratches, cracks, and damage from photos
- Upscale: Increase the resolution and detail of photos
- Object Remove: Remove unwanted objects or elements from photos
The App processes your photos using third-party artificial intelligence services to deliver these features.
3. Eligibility
You must be at least 13 years of age to use Fixy. If you are under 18, you must have permission from a parent or legal guardian to use the App. By using Fixy, you represent that you meet these requirements.
4. User Accounts and Credits
4.1 Free Usage
Fixy provides a limited number of free credits for photo processing. Each restoration or editing task consumes one credit. Free credits are provided as follows:
- An initial credit is granted upon first use of the App.
- Additional credits may be earned through promotional actions such as rating the App.
- A daily credit may be granted to free users under certain conditions.
Credit availability and amounts are subject to change at our discretion without prior notice.
4.2 Fixy Pro Subscription
Fixy Pro is a premium subscription that provides unlimited access to all features without credit limitations, along with watermark-free exports. Subscription details are described in Section 7.
5. User Content and Photos
5.1 Your Photos
You retain full ownership of all photos you provide to the App. By using Fixy, you grant us a limited, temporary license to transmit your photos to our third-party AI processing providers solely for the purpose of performing the restoration or editing task you requested. This license terminates immediately once the processed result is returned to your device.
5.2 Processed Results
The processed photos (results) generated by the App are yours to use as you wish. We do not claim any ownership over the results produced from your photos.
5.3 Your Responsibilities
You are solely responsible for the photos you submit to the App. You agree that you will not use Fixy to process photos that:
- You do not own or have the right to edit
- Contain illegal, harmful, or objectionable content
- Infringe on the intellectual property rights, privacy rights, or any other rights of a third party
- Violate any applicable law or regulation
We reserve the right to refuse processing of any content that violates these terms or that we deem inappropriate, at our sole discretion.
6. AI Processing and Results
6.1 Nature of AI Processing
Fixy uses artificial intelligence to process your photos. AI-generated results are produced algorithmically and may vary in quality and accuracy. We do not guarantee that:
- Results will meet your specific expectations
- Processing will be free of errors or artifacts
- Colors, details, or restorations will be historically or factually accurate
- The AI will produce identical results if the same photo is processed multiple times
6.2 No Warranty on Results
All AI-processed results are provided on an "as-is" basis. We make no warranties, express or implied, regarding the quality, accuracy, or suitability of any processed photo. You acknowledge that AI restoration involves interpretation and generation of visual data, and results may not perfectly reflect the original scene or subject.
7. Subscriptions and Payments
7.1 Fixy Pro Subscriptions
Fixy Pro is available as an auto-renewable subscription with the following options:
- Weekly subscription
- Yearly subscription
Subscription prices are displayed in the App and may vary by region.
7.2 Free Trial
A free trial period may be offered for certain subscription plans. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription, and your Apple ID account will be charged the applicable subscription fee.
7.3 Payment and Renewal
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
- Any unused portion of a free trial period will be forfeited when you purchase a subscription.
7.4 Managing and Canceling Subscriptions
You can manage and cancel your subscriptions by going to your account settings in the App Store after purchase. Cancellation takes effect at the end of the current billing period. No refunds will be provided for any unused portion of a subscription period.
7.5 Price Changes
Subscription prices may change from time to time. If a price change affects your active subscription, you will be notified in advance and given the option to accept the new price or cancel your subscription.
7.6 Apple Terms
All purchases are subject to Apple's standard Terms and Conditions (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/).
8. Watermarks
Photos processed by free (non-subscribed) users may include a "Fixy" watermark on the exported image. Subscribing to Fixy Pro removes watermarks from all exports.
9. Intellectual Property
9.1 App Content
The App, including its design, code, graphics, interface, logos, and all other content created by us, is owned by us and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the App or its content without our prior written consent.
9.2 Trademarks
"Fixy", "Fix & Restore Old Photos", and associated logos are our trademarks. You may not use these trademarks without our prior written permission.
10. Prohibited Uses
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws
- Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
- Interfere with or disrupt the operation of the App or its associated servers and networks
- Attempt to bypass or circumvent any security measures, credit limitations, watermark protections, or subscription requirements
- Use automated systems, bots, or scripts to interact with the App
- Redistribute, sublicense, or resell access to the App or its features
- Use the App to process photos for the purpose of creating misleading, deceptive, or fraudulent content
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- Fixy is provided "as is" and "as available" without warranties of any kind, either express or implied.
- We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
- Our total liability for any claim arising from the use of the App shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim.
- We are not responsible for any loss or damage to your photos. You should always keep backup copies of your original photos.
12. Disclaimer
We are not responsible for:
- The accuracy of AI-generated colorizations, restorations, or enhancements
- Any decisions made based on AI-processed photos
- Loss of credits due to processing failures, network issues, or other technical problems (though we make reasonable efforts to refund credits when processing fails)
- Temporary unavailability of the App or its features due to maintenance, updates, or circumstances beyond our control
- Actions or policies of third-party services used by the App (AIProxy, Google, RevenueCat, Apple)
13. Termination
We reserve the right to suspend or terminate your access to the App at any time, without prior notice, if we reasonably believe you have violated these Terms of Use or engaged in any prohibited conduct. Upon termination, your right to use the App ceases immediately. Sections relating to intellectual property, limitation of liability, and disclaimers shall survive termination.
14. Changes to These Terms
We may update these Terms of Use from time to time. If we make changes, we will update the "Last Updated" date at the top of this document. Your continued use of Fixy after any changes indicates your acceptance of the updated terms. We encourage you to review these terms periodically.
15. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
16. Severability
If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
