Acceptance of Terms. By accessing or using the Fax App website, the Fax App service, or any Fax App applications, including mobile applications (together, the “Service” or “Fax App”) made available by WHITE CODE TEKNOLOJI LIMITED SIRKETI (the “Company”, “we”, “us”, or “our”), you agree to be bound by these Terms of Use (“Terms of Use“). If you do not agree to be bound by the Terms of Use, do not access or use the Service.
Special Terms. There may be times when we offer a special feature that has its own terms and conditions that apply in addition to these Terms of Use. In case of conflict, the specific terms for such feature shall prevail.
ARBITRATION NOTICE FOR U.S. RESIDENTS: PLEASE READ SECTION 15 (U.S. ARBITRATION) CAREFULLY. By accepting the Terms of Use, you agree that:
Disputes between you and Fax App will be resolved by binding, individual arbitration.
You waive your right to participate in a class action lawsuit or class-wide arbitration.
Exceptions to binding arbitration:
You may opt-out from binding arbitration as described in Section 15 (U.S. Arbitration).
There are certain types of disputes described in Section 15 (U.S. Arbitration) that do not fall under the binding arbitration clause.
We may modify this Agreement from time to time. We will notify you at least 7 days prior to the effective date by email, through the App, or by presenting you with a new version of the Agreement for you to accept if we make modifications that materially change your rights. Your continued use of the App after the effective date of an updated version of the Agreement will indicate your acceptance of the Agreement as modified.
Privacy Policy. To learn more about how we collect, use, and protect your personal data, please review our Privacy Policy which forms an integral part of these Terms of Use.
If you are a resident of the European Economic Area (EEA), the United Kingdom, or other regions with laws governing data collection and use, you may have rights under applicable data protection laws, including the right to request access to and correction or deletion of your personal data, or to object to certain processing activities.
If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to request information about the collection, use, and disclosure of your personal information. Please refer to our Privacy Policy for more details.
WHITE CODE TEKNOLOJI LIMITED SIRKETI provides access to the Fax App designed to allow customers to quickly send and receive faxes from their iPhone or iPad without the need for a traditional fax machine. Users can upload, scan, preview, and combine documents of various formats, and send them globally. The scope of Services available may vary depending on the selected plan or data package.
General age limitation. Fax App is not intended for or directed at children under 13, and we do not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to use Fax App. If we become aware that we have inadvertently collected such data, we will delete it promptly.
If you are a parent or guardian and believe we have collected information from your child who is under the age of 13, please contact us at faxmac@whitecode.com.tr
Age limitation for EEA and UK individuals. You must be at least 16 years old in order to use Fax App. We do not allow use of Fax App by EEA and UK individuals younger than 16 years old. If you are aware of anyone younger than 16 using Fax App, please contact us at faxmac@whitecode.com.tr, and we will take the required steps to delete the information provided by such persons.
Any content you submit through Fax App is governed by the Company’s Privacy Policy.
As a condition of using the Services, you agree not to use the Fax App for any purpose that is prohibited by these Terms of Use. You are responsible for all of your activity in connection with the Services and you shall abide by all local, state, national, and international laws and regulations and any applicable regulatory codes. You agree that if you take any of the following actions, you will be materially breaching this Agreement, and you agree that you SHALL NOT:
resell, rent, lease, loan, sublicense, distribute, or otherwise transfer rights to Fax App;
modify, reverse engineer, decompile, or disassemble Fax App;
copy, adapt, alter, modify, translate, or create derivative works of Fax App without the written authorization of the Company;
permit other individuals to use Fax App, including but not limited to shared use via a network connection, except in accordance with these Terms of Use;
circumvent or disable any technological features or measures in Fax App for protection of intellectual property rights;
use Fax App in an attempt to, or in conjunction with, any device, program, or service designed to circumvent technological measures employed to control access to, or the rights in, a content file or other work protected by the copyright laws of any jurisdiction;
use or access Fax App to compile data in a manner that is used or usable by a competitive product or service;
use your Fax App account to engage in any illegal conduct;
use the Service in connection with chain letters, junk email, pyramid schemes, illegal or unethical testimonials, cross soliciting, money games, spamming or any duplicative or unsolicited faxes (commercial or otherwise), including unsolicited faxes as set forth under the Privacy and Electronic Communications Regulations (PECR);
create a false identity or forged email, or otherwise attempt to mislead others as to the identity of the sender or the origin of the message;
Harvest or otherwise collect information about others, including email addresses or fax numbers, without their consent;
upload or transmit any communications that infringe or violate the rights of any party;
access Fax App’s privacy API by means other than those permitted by Fax App;
upload media of any kind that contain expressions of hate, abuse, offensive images or conduct, obscenity, pornography, sexually explicit or any material that could give rise to any civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with these Terms of Use, and the Company’s Privacy Policy;
libel, defame or slander any person, or infringe upon any person’s privacy rights;
use the Service to fax-blast, or otherwise attempt to broadcast a single unsolicited document to many fax numbers at once, whether in violation or compliance with the PECR;
crawling, scraping, caching or otherwise accessing any content on the Service via automated means, including but not limited to, user profiles and photos (except as may be the result of standard search engine protocols or technologies used by a search engine with Fax App’s express consent);
interfere with another user’s use and enjoyment of the Service or another entity’s use and enjoyment of similar services; or
upload any material that contains software viruses or any other computer code, files, or programs that are malicious, technologically harmful, or designed to interrupt, destroy, or limit the functionality of any computer software, Fax App website or the app.
Any such forbidden use shall immediately terminate your licence to use the Services.
Since Fax App is only a facilitator of communication services, we may not guarantee or warrant that the content transmitted through the Service will not involve unsolicited commercial communication. You may occasionally receive unsolicited content. We will use our best effort to keep any unsolicited material from third parties to a bare minimum. By using our Service, you expressly agree and understand that you may receive unsolicited content.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms or pose a risk to the security or integrity of the Service. Upon termination, all rights granted to you under these Terms will immediately cease, and you must stop all use of the Service.
Users of Fax App are prohibited from uploading illegal content, or engaging in any activities that violate local, state, national, and international laws and regulations and any applicable regulatory codes.
We reserve the right to suspend or terminate accounts involved in such behavior and cooperate with law enforcement as required. Users may also be temporarily blocked if such violations are suspected.
Responsibility for the content. You are solely responsible for any content uploaded with the Service. You affirms, represents, and warrants that you own or have the necessary licenses, rights, consents, and permissions to upload any content with the Service, that the content will not violate any rights of any third party (including intellectual property rights or rights of publicity or privacy), and will not violate any applicable law, rule, regulation, or the terms of service of any other platform.
Note that it is strictly prohibited to use the Fax App for sending junk faxes, unsolicited fax advertisements.
User Files. We do not claim ownership in any of the documents, files, images or other data that you upload to the Fax App from yout photo library, Cloud Services, or that you create, scan, edit, fax or otherwise share using the Fax App. However, you hereby agree to grant us a limited purpose license with respect to your user files necessary solely to operate the Fax App Services and provide you with the Fax App functionality (i.e. to make it possible for you to upload user files to the Fax App, scan, edit, fax, and share them). Only you can exercise full control over your user Files.
No Responsibility for Sensitive Information. The Fax App is not intended for the transmission of highly sensitive or classified information. If you choose to send documents containing personal health information, financial data, or other confidential materials, you do so at your own risk. We strongly advise against using the Service for transmitting any data that may trigger heightened legal obligations under data protection, healthcare, or financial regulations.
Transmission Disclaimer. We work hard to ensure that your documents are successfully transmitted and received. However, fax delivery may be affected by issues beyond our control, including failures or delays on the part of third-party fax providers, recipient systems, or local telecommunication networks. While we cannot guarantee 100% delivery success, we monitor our Service uptime and will make reasonable efforts to assist you in troubleshooting failed transmissions and resending documents when appropriate. Please contact faxmac@whitecode.com.tr if you experience issues with sending or receiving faxes.
We grant you a personal, worldwide, revocable, non-transferable, and non-exclusive licence to access and use Fax App for personal and non-commercial purposes in accordance with the Terms of Use.
You may not copy, store, modify, distribute, transmit, perform, reproduce, publish, license, create derivative works from, transfer, or sell any text, graphics, logos, and other source-identifying symbols, designs, icons, images, or other information, software or code obtained from Fax App without prior express written permission from the Company which may be withheld for any or no reason.
You further agree not to download, display or use any content on Fax App that is provided by the Company or its licensors located on the Fax App for use in any publications, in public performances, on websites other than Fax App for any other commercial purpose, in connection with products or services that are not those of the Company, in any other manner that is likely to cause confusion among consumers, that disparages or discredits the Company and/or its licensors, that dilutes the strength of the Company or its licensor’s property, or that otherwise infringes the Company or its licensors’ intellectual property rights. You further agree to in no other way misuse any content published by the Company or third-party content that appears on Fax App.
All rights, title, and interest in and to Fax App not expressly granted in the Terms of Use are reserved by the Company. If you wish to use the Company’s software, title, trade name, trademark, service mark, logo, domain name, and/or any other identification with notable brand features or other content owned by the Company, you must obtain written permission from the Company. Permission requests must be sent to faxmac@whitecode.com.tr.
To avoid any doubt, the Company owns all the text, images, photos, audio, video, location data, software, code, and all other forms of data or communication that the Company creates and makes available in connection with Fax App, including but not limited to visual interfaces, interactive features, graphics, design, and the compilation of aggregate user review ratings and all other elements and components of Fax App, excluding User Content (collectively referred to herein as the “Company’s Content”). Except as expressly and unambiguously provided herein, we do not grant you any express or implied rights, and all rights in and to Fax App and the Company’s Content are retained by us.
The software that supports Fax App may be subject to U.S. export and re-export control laws and regulations, including the Export Administration Regulations (“EAR”) maintained by the U.S. Department of Commerce, trade and economic sanctions maintained by the Treasury Department’s Office of Foreign Assets Control (“OFAC”), and the International Traffic in Arms Regulations (“ITAR”) maintained by the Department of State. You represent and warrant that you are (1) not located in any country or region that is subject to a U.S. government embargo, and (2) are not a denied party as specified in the regulations listed above.
You agree to comply with all U.S. and foreign export laws and regulations to ensure that neither Fax App nor any technical data related thereto nor any direct product or products derived from or based on such technology received from Fax App under these Terms of Use thereof is exported or re-exported directly or indirectly in violation of, or used for any purposes prohibited by such laws and regulations.
If you believe any materials accessible on or from Fax App infringe your copyright, you may request removal of those materials (or access thereto) from Fax App by contacting the Company and providing the following information:
Identification of the copyrighted work that you believe to be infringed. Please describe the work, and, where possible, include a copy or the location of an authorised version of the work.
Identification of the material that you believe to be infringing and its location. Please describe the material, and provide us with its URL or any other pertinent information that will allow us to locate the material.
Your name, address, telephone number, and (if available) e-mail address.
A statement that you have a good faith belief that the complained use of the materials is not authorized by the copyright owner, its agent, or the law.
A statement that the information that you have supplied is accurate, and indicating that “under penalty of perjury,” you are the copyright owner or are authorized to act on the copyright owner’s behalf.
A signature or the electronic equivalent from the copyright holder or authorized representative.
In an effort to protect the rights of copyright owners, the Company maintains a policy for the termination, in appropriate circumstances, of users of Fax App who are repeat infringers.
Subscription. Fax App mobile application offers a subscription that allows you to send a total number of pages per day that will not interfere with the stability of Fax App and third-party fax providers that make it possible to implement the Fax App service, provides real-time tracking, and allows you to access complete sent faxes history. The terms, content, and limits of Service may vary depending on the country of use and the specific subscription chosen. Please note that the contents of the subscription may be modified at any time. By starting a subscription, you agree that it will automatically renew at the end of each billing period unless you cancel before the current period ends. You also acknowledge and agree that your purchase is for a recurring subscription service, and is not contingent on any future functionality, features, or dependent on any oral or written public statements or comments made by us regarding such future functionality or features.
Billing. You may purchase the subscription directly from Fax App or through a third party by paying a subscription fee plus applicable taxes in advance on a monthly basis or some other recurring interval disclosed to you prior to your purchase.
Trial. Some of our subscriptions may include a trial period, where you can experience the application for a specified period at a reduced price (“Trial”). Subscriptions with the Trial period will automatically renew to a paid subscription once your Trial expires.
If you purchase access to the subscription through a third party, separate terms and conditions with such third party may apply in addition to these Terms of Use. Please contact the third party regarding any refunds or to manage your subscription.
Refund Policy. For assistance with refunds, please contact our support team at faxmac@whitecode.com.tr in accordance with our Refund Policy.
Price and tax changes. The Company may from time to time make changes to the subscription, including recurring subscription fees, and will communicate any price changes to you in advance. Price changes will take effect at the start of the next subscription period following the date of the price change and, by continuing to use the subscription after the price change takes effect, you will have accepted the new price. If you don’t agree to a price change, you can reject the change by unsubscribing from the applicable subscription prior to the price change going into effect.
Tax rates or other fees are based on the rates applicable at the time of your monthly charge. These amounts can change over time with local tax requirements in your country, state, territory, county, or city. Any change in tax rate will be automatically applied based on the account information you provide.
Renewal and Cancellation. Your payment to Fax App or the third party through which you purchased the subscription will automatically renew at the end of the applicable subscription period. You should cancel your subscription or Trial before it renews to avoid the billing of the fees for the next subscription period. To comply with the FTC’s Click-to-Cancel Rule, we ensure that cancelling your subscription is as simple as signing up. You may cancel your subscription at any time directly through your device settings, with no additional steps required.
You can cancel the renewal of your subscription at any time by following the instructions below:
Open the Settings app > Tap your name > Tap Subscriptions > Tap the subscription > Tap Cancel Subscription
or
Open the Fax App > Tap Settings > Tap Manage subscription > Tap Cancel Subscription.
If you purchased your subscription through a third party, please cancel directly through that provider’s subscription management system.
For any questions or assistance with the cancellation process, contact our Support team at faxmac@whitecode.com.tr. However, please note that cancellation must be completed through your account as described above, and support cannot process cancellations on your behalf.
Fair Use Policy. To maintain service quality and prevent abuse, we reserve the right to impose limits on the number of pages or documents sent via your subscription, even if not explicitly stated in your plan. If your usage significantly exceeds the average use of other users or interferes with the normal operation of the Service, we may suspend or terminate your account without prior notice.
Disputes and Liability. Any disputes regarding payments processed through the third parties must be resolved directly with the respective payment provider. Our liability is limited to confirming the successful completion of transactions on our platform.
You agree to defend, indemnify, and hold the Company, its officers, directors, employees, agents, affiliates, representatives, licensors, suppliers, partners, advertisers, and content providers (together referred to as “Fax App Parties”), harmless from and against any claims, actions, demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, arising out of or resulting from, or alleged to result from, your violation of these Terms of Use.
Under no circumstances will the Fax App Parties be liable to you for any loss or damages of any kind (including, without limitation, for any direct, indirect, economic, exemplary, special, punitive, incidental or consequential losses or damages) that are directly or indirectly related to:
the Service;
the Fax App content;
user content;
your use of, inability to use, or the performance of the service;
any action taken in connection with an investigation by the Fax App parties or law enforcement authorities regarding your or any other party’s use of the service;
any action taken in connection with copyright or other intellectual property owners;
any errors or omissions in the service’s operation; or
any damage to any user’s computer, mobile device, or other equipment or technology including, without limitation, damage from any security breach or from any virus, bugs, tampering, fraud, error, omission, interruption, defect, delay in operation or transmission, computer line or network failure or any other technical or other malfunction, including, without limitation, damages for lost profits, loss of goodwill, loss of data, work stoppage, accuracy of results, or computer failure or malfunction, even if foreseeable or even if the parties have been advised of or should have known of the possibility of such damages, whether in an action of contract, negligence, strict liability or tort (including, without limitation, whether caused in whole or in part by negligence, acts of god, telecommunications failure, or theft or destruction of the service).
In no event will the Fax App Parties be liable to you or anyone else for loss, damage or injury, including, without limitation, death or personal injury. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event will the Fax App parties total liability to you for all damages, losses or causes or action exceed one hundred United States dollars ($100.00).
You agree that in case that you incur any damages, losses or injuries that arise out of Fax App’s acts or omissions, the damages, if any, caused to you are not irreparable or sufficient to entitle you to an injunction preventing any exploitation of any web site, service, property, product or other content owned or controlled by the Fax App Parties, and you will have no rights to enjoin or restrain the development, production, distribution, advertising, exhibition or exploitation of any web site, property, product, service, or other content owned or controlled by the Fax App Parties.
By accessing the Service, you understand that you may be waiving rights with respect to claims that are at this time unknown or unsuspected, and in accordance with such waiver, you acknowledge that you have read and understand, and hereby expressly waive, the benefits of section 1542 of the civil code of California, and any similar law of any state or territory, which provides as follows: “a general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”
Fax App is not responsible for the actions, content, information, or data of third parties, and you release us, our directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any such third parties.
We do not control, endorse or take responsibility for any third-party content linked to Fax App. You acknowledge sole responsibility for and assume all risks arising from your use of any third-party websites or resources. YOUR CORRESPONDENCE AND BUSINESS DEALINGS WITH THIRD PARTIES FOUND THROUGH THE SERVICE ARE SOLELY BETWEEN YOU AND THE THIRD PARTY.
Your use of Fax App is at your sole risk. Fax App is provided “as is” and “as available” without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. In addition, we do not represent or warrant that Fax App is accurate, complete, reliable, current or error-free, free of viruses or other harmful components. You assume the entire risk as to the quality and performance of Fax App within your use.
WHITE CODE TEKNOLOJI LIMITED SIRKETI is not liable if the Service fails to meet the customer’s expectations or if there are issues with third-party network coverage or speed.
You are solely responsible for your interaction with other users of the Service, whether online or offline. You agree that Fax App is not responsible or liable for the conduct of any user. Fax App reserves the right, but has no obligation, to monitor or become involved in disputes between you and other users. Exercise common sense and your best judgment when interacting with others, including when you submit or post Content or any personal or other information.
You may choose, at your sole and absolute discretion and risk, to use applications that connect the Service or your profile on the Service with a third-party service (each, a “Third-Party Application”) and such Third-Party Application may interact with, connect to or gather and/or pull information from and to your Service profile. By using such Third-Party Applications, you acknowledge and agree to the following:
if you use a Third-Party Application to share information, you are consenting to information about your profile on the Service being shared;
your use of a Third-Party Application may cause your personal data to be publicly disclosed and/or associated with you, even if Fax App has not itself provided such information; and
your use of a Third-Party Application is at your own option and risk, and you will hold the Fax App Parties (defined below) harmless for activity related to the Third-Party Application.
FOR UNITED STATES RESIDENTS ONLY: Please read the following Section carefully because it requires you to arbitrate certain disputes and claims with the Company and limits the manner in which you can seek relief from us.
Except for small claims disputes in which you or the Company seek to bring an individual action in small claims court located in the county of your billing address or disputes in which you or the Company seeks injunctive or other equitable relief for the alleged unlawful use of intellectual property, you and the Company waive your rights to a jury trial and to have any dispute arising out of or related to these Terms of Use or the Company resolved in court. Instead, all disputes arising out of or relating to these Terms of Use or the Company will be resolved through confidential binding arbitration held in Santa Clara County, California in accordance with the Streamlined Arbitration Rules and Procedures (“Rules”) of the Judicial Arbitration and Mediation Services (“JAMS”), which are available on the JAMS website and hereby incorporated by reference. You either acknowledge and agree that you have read and understand the rules of JAMS or waive your opportunity to read the rules of JAMS and any claim that the rules of JAMS are unfair or should not apply for any reason.
You and the Company agree that any dispute arising out of or related to these Terms of Use or the Company is personal to you and the Company and that any dispute will be resolved solely through individual arbitration and will not be brought as a class arbitration, class action or any other type of representative proceeding.
You and the Company agree that these Terms of Use affect interstate commerce and that the enforceability of this Section will be substantively and procedurally governed by the Federal Arbitration Act, 9 U.S.C. § 1, et seq. (“FAA”), to the maximum extent permitted by applicable law. As limited by the FAA, these Terms of Use and the Rules, the arbitrator will have exclusive authority to make all procedural and substantive decisions regarding any dispute and to grant any remedy that would otherwise be available in court; provided, however, that the arbitrator does not have the authority to conduct a class arbitration or a representative action, which is prohibited by these Terms. The arbitrator may only conduct an individual arbitration and may not consolidate more than one individual’s claims, preside over any type of class or representative proceeding or preside over any proceeding involving more than one individual. You and the Company agree that for any arbitration you initiate, you will pay the filing fee and the Company will pay the remaining JAMS fees and costs. For any arbitration initiated by the Company, the Company will pay all JAMS fees and costs. You and the Company agree that the state or federal courts of the State of California and the United States sitting in Santa Clara County, California have exclusive jurisdiction over any appeals and the enforcement of an arbitration award.
ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE COMPANY MUST BE FILED WITHIN ONE YEAR AFTER SUCH CLAIM AROSE; OTHERWISE, THE CLAIM IS PERMANENTLY BARRED, WHICH MEANS THAT YOU AND THE COMPANY WILL NOT HAVE THE RIGHT TO ASSERT THE CLAIM.
You have the right to opt out of binding arbitration within 30 days of the date you first accepted the terms of this Section by notifying the Company in writing. The notification must be sent to faxmac@whitecode.com.tr under the subject “Arbitration Opt-out”.
In order to be effective, the opt-out notice must include your full name and clearly indicate your intent to opt out of binding arbitration. By opting out of binding arbitration, you are agreeing to resolve Disputes in accordance with Section 14 (Governing Law) below.
These Terms of Use and any claim, controversy or dispute arising out of or related to these Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Cyprus without giving effect to any conflicts of law provision. The courts of the Republic of Cyprus shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms of Use (including any non-contractual disputes or claims), unless settlement by means of arbitration under Section 15 applies. To the extent permissible, the United Nations Convention on Contracts for the International Sale of Goods will not apply.
If any provision of these Terms of Use is held to be unlawful, void, or for any reason unenforceable during arbitration or by a court of competent jurisdiction, then that provision will be deemed severable from these Terms of Use and will not affect the validity and enforceability of any remaining provisions. Fax App’s failure to insist upon or enforce strict performance of any provision of these Terms will not be construed as a waiver of any provision or right. No waiver of any of these Terms will be deemed a further or continuing waiver of such term or condition or any other term or condition. This dispute resolution provision will survive the termination of any or all of your transactions with Fax App.
The following terms apply if you use Fax App on any device that contains the iOS mobile operating system (“iOS App”) developed by Apple Inc. (“Apple”).
Acknowledgement. You acknowledge that these Terms of Use are concluded solely between you, and not with Apple, and us, not Apple. We are solely responsible for the App and the content thereof. You further acknowledge that the usage rules for the iOS App are subject to any additional restrictions set forth in the usage rules for the Apple App Store terms of service as of the date you download the iOS App, and in the event of any conflict, the usage rules in the Apple App Store shall govern if they are more restrictive. You acknowledge and agree that you have had the opportunity to review the Apple usage rules.
Scope of License. The license granted to you is limited to a non-transferable license to use the iOS App on any iPhone, iPod touch or iPad that you own or control as permitted by the Apple usage rules set forth in the Apple App Store terms of service.
Maintenance and Support. You and us acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the iOS App.
Warranty. You acknowledge that Apple is not responsible for any product warranties, whether express or implied by law, with respect to the iOS App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, paid to Apple for the iOS App by you; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the iOS App. You and the Company acknowledge that to the extent that there are any applicable warranties, any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any such applicable warranty would be the sole responsibility of the Company. However, you understand and agree that in accordance with these Terms of Use, the Company has disclaimed all warranties of any kind with respect to the iOS App, and therefore, there are no warranties applicable to the iOS App.
Product Claims. You and the Company acknowledge that as between Apple and the Company, the Company, not Apple, is responsible for addressing any claims relating to the iOS App or your possession and/or use of the iOS App, including, but not limited to (i) product liability claims, (ii) any claim that the iOS App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection or similar legislation.
Intellectual Property Rights. You and the Company acknowledge that, in the event of any third party claim that the App or your possession and use of the iOS App infringe third party’s intellectual property rights, the Company, and not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim to the extent required under these Terms.
Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted persons.

Third-Party Terms of Agreement. You agree to comply with any applicable third-party terms when using the iOS App.
Third-Party Beneficiary. You and the Company acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms of Use, and that, upon your acceptance of these Terms of Use, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use against you as a third-party beneficiary thereof).
These Terms of Use constitute the entire agreement between you and us relating to Fax App and your use of Fax App, and these Terms of Use supersede and replace any and all prior oral or written understandings or agreements between the Company and you relating to Fax App and your use of Fax App.
The language of these Terms of Use is English language only.
You hereby irrevocably waive any law applicable to you requiring that these Terms of Use shall be localized to meet your language (as well as any other localization requirements), or requiring a delivery or retention of non-electronic records.
The failure of us to exercise or enforce any right or provision of these Terms of Use will not operate as a waiver of such right or provision. The waiver of such right or provision will be effective only if in writing and signed by a duly authorized representative of the Company.
Except as expressly set forth in these Terms of Use, the exercise by either party of any of its remedies under these Terms of Use will be without prejudice to its other remedies under these Terms of Use or otherwise.
If any provision of these Terms of Use is held invalid and unenforceable (either by an arbitrator appointed pursuant to the terms of Section 15 (Arbitration) above or by court of competent jurisdiction), that provision will be enforceable to the maximum extent permissible, and the other provisions of these Terms of Use will remain in full force and effect. The Section titles in these Terms of Use are for convenience only and have no legal or contractual effect.
Except as otherwise provided herein, these Terms of Use are intended solely for the benefit of you and the Company and are not intended to confer third-party beneficiary rights upon any other person or entity.
You may not assign or transfer your rights under these Terms of Use, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer your rights under these Terms of Use, without such consent, will be null and of no effect. We may freely assign or transfer our rights and obligations under these Terms without restriction. Subject to the foregoing, these Terms of Use will bind and inure to the benefit of the parties, their successors, and permitted assigns.
We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, embargoes, strikes, power or internet outages, or failures of third-party providers.
These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the Service and supersede all prior or contemporaneous agreements, communications, and understandings, whether oral or written.

This Fax App Privacy Policy (“Privacy Policy”) is delivered on behalf of Municorn Limited (“Municorn,” “we”, “us”, and “our”) and governs the Personal Data (as defined below) collected from or processed about you when you use the Fax App website available at the Fax App mobile application, which provides a professional and easy way to send faxes all over the world from phone or tablet on the go (“Fax App”), including by downloading, installing, registering with, accessing or otherwise using the application (collectively referred to herein as “Use”).

Photos and documents that you upload to Fax App. Any of the documents, files, images or other data that you upload to the Fax App from Photo Library, Cloud Services, or that you create, scan, edit, fax or otherwise share using the Fax App. If you grant us permission to access your camera or your device’s photo library, we will process the photos you select to upload to Fax App to provide features of the app that you choose to Use.
Recipient’s fax number. You provide it to us to enable fax sending.
If you contact us or communicate with us, we will collect and receive records and copies of your correspondence with us and contact details that you have provided us while making your inquiries (such as your name, postal addresses, email addresses and phone numbers or any other identifier by which you may be contacted).
Sensitive data. We do not intentionally use or process sensitive data beyond what is necessary to provide the core functionality of the app. Sensitive data may include, but is not limited to:
Personally Identifiable Information (PII), such as names, addresses, phone numbers, or financial information.
Medical, biometric, or other confidential information.
Sensitive information is provided solely at the user’s discretion and under their control. If sensitive data is uploaded voluntarily, it is done at the user’s own responsibility, and we encourage users to avoid including such data in their documents.

When you Use Fax App, we or third parties we permit to do so, may automatically collect certain information, including Personal Data, from you (this is subject to your consent where this is required by law). The information collected from you automatically when you Use Fax App may include:
Log file information. Log file information is automatically reported by your browser each time you make a request to access (ie, visit) a web page or app. It can also be provided when the content of the webpage or app is downloaded to your browser or device. When you use Fax App, our servers automatically record certain log file information, including your web request, IP address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Fax App, domain names, landing pages, pages viewed, and other such information. We may also collect similar information from emails sent to our Users which then help us track which emails are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of our services.
Subscription and device data. Information related to your subscription and device used for technical authorization.
Marketing and cookies data: Collected through cookies and analytics services integrated into the app.
Device information: Information about your mobile device and internet connection, including your IP address, the device’s unique device identifier, operating system and version, mobile network information, device type and device language.
App and country information: Information regarding the version of the app that you are using and the country version of the app store from which you downloaded Fax App.
Geolocation data: the state or country associated with your IP address.
In-app events. When you use our Fax App, analytics tools automatically record your activity information (tutorial steps, levelling up, payments, in-app purchases, custom events, progression events, method of limiting the processing of user data).
Usage details: Details of your Use of Fax App, including frequency of Use, areas and features of the application that you access and information regarding engagement with particular features of the app.
Details about your in-app purchases: For example, details regarding the time you made certain purchases.
Uploaded documents: Files provided by users, such as contracts, tax forms, or images in JPG or PDF format.
Third-party emails and fax numbers: Email addresses or fax numbers of third parties provided for document signing or sharing.
Permissions for Camera, Photos and videos, Files. After you grant us the relevant permission, we may have technical access to your camera that is required to be able to scan documents via the Fax App and/or to take photos you want to add to your documents. Additionally, if you try to upload any image, photo or file from your Photo Library/Gallery or Files to the Fax App, the relevant technical access of the Fax App to your Photos and videos or Files is required. The technical access you provide to your Photos and videos (either limited or full), Files is necessary for us solely to enable you to upload photos, images, files from your device to the Fax App, use them to create and edit documents in the Fax App, i.e. to operate the Fax App Services and provide you with the Fax App functionality. You can manage, change access permissions to your Camera, Photos and videos, Files at any time via the Settings app on your device.
User signatures: Stored locally on user devices unless explicitly shared for processing.
(If you have provided your consent) IDFA or Android Advertising ID, whichever is applicable to your device. If you want to disable the collection of IDFA and/or Android Advertising ID by Fax App, please follow the instructions below.

We may use your Personal Data for a variety of purposes depending on the category of Personal Data and the way you Use and interact with the Fax App, including the following:
To present to you and others with Fax App and its contents and any other information, products or services that you request from us, including to provide various features of the app and its functionality. We do so to provide you with the services according to our contractual obligation.
To carry out our obligations and enforce our rights arising from any contracts entered into between you and us in relation to Fax App (e.g., the Terms of Use). This is for the performance of our contract with you and for our legitimate interests in performing and enforcing our contracts with you.
To provide you with customer and technical support, investigate your concerns, respond to your inquiries and to monitor and improve our responses to your and other users’ inquiries in relation to Fax App. It is our legitimate interest to provide you with high-quality support.
To communicate with you, such as to notify you about changes to Fax App or any products or services we offer or provide through Fax App, including by sending you technical notices, notices about your account/subscription, including expiration and renewal notices, updates, security alerts and support and administrative messages, which we may send through an in-app or a push notification (you may opt-out of push notifications by changing the settings on your mobile device). It is our legal obligation to keep you informed about your subscription and your account and otherwise in our legitimate interests of keeping you informed about your Fax App account.
To conduct research, analytics and monitor performance and other metrics regarding Fax App and your Use of Fax App. This may include data regarding the total number of users of our app, traffic, and demographic patterns related to the use of our app. Where this data is collected through the technologies described in Section 6 and where required by law, we rely on your consent; otherwise, it is our legitimate interest to conduct analytics as it helps us understand our business metrics and improve our product.
To improve, test, and monitor the effectiveness of Fax App. It is our legitimate interest to conduct such analyses to understand our product and business metrics.
To provide personalized content and information to you in relation to Fax App and so that we, and third parties on which we rely, can advertise to you. This may include using your Personal Data to build advertising audiences that we believe are similar to our user base, serving online ads to you, or engaging in other forms of advertising. In such cases, your Personal Data and any other collected information may be among the items sold, transferred, or otherwise disclosed as part of that transaction or proceeding.
We may disclose your Personal Data in response to legal requests and for purposes of preventing harm. We may access, preserve and share your information in response to a legal (like a search warrant, court order or subpoena), government or regulatory request if we have a good faith belief that the law requires us to do so. When you Use Fax App, we and our service providers, vendors, and partners, including third parties, may use technologies to collect or receive certain information about you and/or your Use of Fax App. We also use third-party analytics tools like Google Firebase, AppsFlyer, and Amplitude to help us measure traffic and usage trends for Fax App and for other purposes. Such analytics tools collect information via third-party SDKs incorporated into Fax App, which includes information about features of Fax App you visit or Use, your actions in Fax App, and information about your subscription. Such information may be used to provide content, advertising, or functionality or to measure and analyze ad performance on Fax App or other websites or platforms. Third parties may also use such information for their own purposes. For the avoidance of doubt, we do not use Image Data for advertising purposes.
Interest-based Advertising. We may partner with ad networks and other ad-serving providers that serve ads on behalf of us and others on non-affiliated platforms. Some of those ads may be personalized, meaning that they are intended to be relevant to you based on information ad networks and ad serving providers collect about your Use of the app over time, including information about relationships among different browsers and devices. This type of advertising is known as interest-based advertising.

Account Tenure: the duration of your account’s existence;
App Account Token: an anonymous account identifier used for the transaction;
Consumption Status: the extent to which the in-app purchase was used or consumed;
Delivery Status: confirmation of whether the purchased content was successfully delivered;
Lifetime Dollars Purchased: the total amount spent on in-app purchases in our app, in USD;
Lifetime Dollars Refunded: the total amount refunded to you for in-app purchases, in USD;
Platform: the platform where the in-app purchase was consumed;
Play Time: the total time spent using our app;
Sample Content Provided: whether a free trial or sample of the in-app purchase was available before purchase;
User Status: the current status of your account.
We process this data solely to assist Apple in evaluating refund requests, ensuring compliance with applicable laws and regulations, including GDPR and CCPA. Users can withdraw their consent to this processing at any time through the app settings or by contacting us.

GPC is a browser or device setting that allows you to control the sale or sharing of your personal data. Access, modification, correction and erasure. You can send us an email at faxmac@whitecode.com.tr to request access to, modification, correction, update, erasure or portability of any Personal Data that you have provided to us and that we have about you. You can also request deletion of your account inside the app, both for iOS and Android users. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
EEA/UK individuals. Individuals in the European Economic Area (“EEA”) and the United Kingdom (“UK”) have certain statutory rights in relation to their Personal Data including under the General Data Protection Regulation (Regulation (EU) 2016/679) (“EEA GDPR”) and the UK version of the EEA GDPR (“UK GDPR”) (collectively, the “GDPR”), including the rights specified below. You can exercise these rights by contacting us (for contact information, please see Section 14: How to Contact Us). We will do our best to accommodate your request or objection but please note that not all rights are absolute.
Access to your Personal Data: You have a right to request information about whether we have any Personal Data about you, and to receive a copy of such Personal Data.
Rectification of your Personal Data: You are responsible for ensuring the accuracy of your Personal Data that you provide to us. Inaccurate information may affect your experience when Using Fax App features and our ability to contact you as described in this Privacy Policy. If you believe that your Personal Data is incomplete or inaccurate, you have a right to contact us and ask us to correct such Personal Data.
Restriction of processing: You also have the right to demand restriction of processing of your Personal Data, for example, if you contest the accuracy of the Personal Data which inaccuracy is verified by us.
Erasure of your Personal Data: In certain circumstances, you may ask us to erase your Personal Data. Please be aware that erasing some Personal Data may affect your ability to Use Fax App.
Right to portability of your Personal Data: In certain circumstances, you have the right to request us to receive any Personal Data you provided us in a structured, commonly used and machine-readable format. You may further ask us to give that Personal Data to another party.
Right to object to processing or otherwise using your Personal Data: Where we are processing your Personal Data based on our legitimate interest, you may object to the processing or otherwise using your Personal Data. Please be aware that our inability to process or otherwise use some of your Personal Data may affect your ability to Use Fax App. If you have opted in to receiving marketing communications, you have the right to opt out of those at any time.
Right to withdraw your consent at any time: Where you may have provided your consent to the processing of your Personal Data for a specific purpose, you have the right to withdraw your consent for that specific processing at any time. The withdrawal of your consent does not affect the lawfulness of the processing based on your consent before its withdrawal.
Right to lodge a complaint with a supervisory authority: Subject to the GDPR, you have the right to lodge a complaint with a local data protection authority in the country of your residence, where you work or where an alleged infringement of the applicable data protection law took place. Please see a list of EU member states’ supervisory authority here, and the UK’s supervisory authority (ICO) here.
Please keep in mind that in case of a vague request to exercise any of the aforementioned rights we may engage with you in a dialogue to ask for more details if so needed to complete your request. In case this is impossible, we reserve the right to refuse granting your request.
Following the provisions of the applicable law, we might also ask you to prove your identity (for example, by requesting your username or some other proof of your identity) in order for you to invoke the mentioned rights. This is made to ensure that no right of third parties is violated by your request, and the mentioned rights are exercised by an actual Personal Data subject or an authorized person.
Consent for Third-Party Data. If you include third-party personal data in your uploaded documents, you are responsible for obtaining the necessary consent from those individuals before sharing such data with us.
Prohibited Content and User Responsibility
By using this app, you agree not to upload any illegal, harmful, or unlawful content, including but not limited to:
Personal data of third parties without their consent,
Sensitive personal data of third parties, such as medical, financial, or biometric data, unless you have explicit consent,
Infringing content, including but not limited to copyrighted material, trademark violations, or any content that breaches intellectual property rights,
Defamatory or offensive material, including hate speech, threats, or discriminatory content,
Pornographic, sexually explicit, or obscene content,
Fraudulent or deceptive content, such as phishing attempts, scams, or misleading information.
Uploading such content is done at your own risk and responsibility. You are solely responsible for ensuring that the documents you upload do not contain illegal or unlawful material or content you do not have the right to share.
In the event that we detect unlawful content in the documents uploaded by users, we reserve the right to report such content to the relevant authorities for further investigation. This may include providing user-uploaded content or other relevant information to law enforcement or other regulatory bodies, as required by law.
We do not bear responsibility for any legal consequences arising from the uploading of prohibited content.

Requests related to personal or other data. We will process your requests related to personal data within 45 days from the date we receive them. If additional time is required due to complexity or volume of requests, we may extend this period by an additional 45 days. In such cases, we will notify you within the initial 45-day period.
You may submit your request by contacting us at faxmac@whitecode.com.tr or through the app’s privacy settings.
If you are using Fax App you may receive electronic communications from us (e.g., by posting in-app notices in Fax App, push notifications or emails). We send some of these communications to you, such as those related to your subscriptions, technical and security notices and updates to the Privacy Policy and Terms of Use, where necessary to perform our contract with you to provide Fax App or otherwise based on our legitimate interest in contacting you.
If required by law, we will ask for your consent to send you promotional and marketing emails, in-app communications and push notifications about new products, features or offers from Fax App.
Marketing & Promotional Emails. If you wish to opt-out of our promotional and marketing emails, you can do so by following the opt-out links in any marketing email sent to you or by contacting us at faxmac@whitecode.com.tr.
Push Notifications. If you wish to opt-out of push notifications, you can do so through your mobile device settings by tapping “Settings” -> “Notifications” -> Choose Fax App – > press the toggle to allow or forbid push notifications from the app.
We use reasonable and appropriate information security safeguards to help keep your Personal Data secure and in an effort to protect it from accidental loss and unauthorized access, use, alteration and disclosure. Unfortunately, the transmission of information via the internet is not completely secure. Although we take measures to do our best to protect your Personal Data, we cannot guarantee the security of the collected information transmitted to or through Fax App or an absolute guarantee that such information may not be accessed, disclosed, altered, or destroyed.
Any transmission of your Personal Data is at your own risk. We are not responsible for the circumvention of security measures contained in Fax App. Please understand that there is no ideal technology or measure to maintain 100% security.
The safety and security of your information also depends on you. For instance, we are not responsible for how you choose to share the photos or other information processed in your Fax App account, such as via social media services. We are not responsible for the functionality, privacy, or security measures of any other organization.
While Municorn Limited is not a covered entity or a business associate under the U.S. Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), we voluntarily adopt safeguards and security practices aligned with the HIPAA Security Rule to help protect personal and sensitive health-related data that may be faxed through the app.

We generally retain most of your Personal Data until you delete your Fax App account or as otherwise required by law.
Specific retention periods include:
User account data: Retained until account deletion.
Payment and transactional data: Retained for seven (7) years for compliance with financial and tax regulations.
Uploaded documents: Retained on our servers for as long as needed to provide requested services. Users may delete documents at any time via the app’s settings.
Analytics and usage data: Retained in anonymized form for business purposes.
Signatures: Stored locally on user devices and never uploaded unless explicitly shared.
You may request account deletion by contacting faxmac@whitecode.com.tr or using the in-app functionality.
Even if we delete some or all of your Personal Data, we may continue to retain and use anonymized data previously collected that can no longer be used for personal identification.
Certain of our service providers are incorporated in the United States. Accordingly, your Personal Data may be transferred to and stored in the United States.
Where required under the EEA GDPR, in case of transfers of personal data from the EEA to countries outside the EEA, where we cannot rely on adequacy decisions adopted by the European Commission (for more information, please see here) we ensure appropriate safeguards are in place to guarantee the continued protection of your personal data, particularly by signing the Standard Contractual Clauses of the European Commission (article 46(2)(c) GDPR). Where required under the UK GDPR, in case of transfers of personal data to countries outside the United Kingdom, we ensure appropriate safeguards are in place to guarantee the continued protection of your personal data, particularly by signing the UK Addendum to the EU Standard Contractual Clauses or the UK International Data Transfer Agreement, whichever is more appropriate in the given situation. We may also guarantee the protection of your personal data by relying on adequacy decisions adopted or approved by the authorities in the United Kingdom.
Azure servers’ usage. As to the location of our servers, we use Azure servers located in the USA for Fax App operation and Google LLC multiregional servers locations, while our analytics operations are processed both on the servers provided by Azure and by Google LLC.
OpenAI usage. We may use AI services and OpenAI’s services to process and analyze user data to improve our app’s functionality and user experience. This involves sharing certain anonymized text data from scanned documents with OpenAI, acting as our data processor. OpenAI processes this data in accordance with our instructions and a Data Processing Agreement (DPA) that complies with GDPR requirements. We ensure that appropriate security measures are in place to protect your data during transmission and processing. You have the right to access, correct, or delete your data processed by OpenAI through our app. For more information on how OpenAI handles data, please refer to their privacy policy.

General age limitation. Fax App is not intended for or directed at children under 13, and we do not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to Use Fax App. If you are under 13, do not: (i) Use or provide any information in Fax App or through any of its features, or (ii) provide any information about yourself to us, including your name, address, telephone number or email address. If you are a parent or guardian and believe we have collected information from your child who is under the age of 13, please contact us at faxmac@whitecode.com.tr.
If we discover that we have collected data from a child under the applicable age without verifiable parental consent, we will promptly delete that information and take steps to prevent further access to the Fax App.
Age limitation for EEA and/or UK individuals. You must be at least 16 years old in order to Use Fax App. We do not allow Use of Fax App by EEA and/or UK individuals younger than 16 years old. If you are aware of anyone younger than 16 Using Fax App, please contact us (for contact information, please see Section 14: How to Contact Us), and we will take the required steps to delete the information provided by such persons.
We are not responsible for the practices employed by any websites or services linked to or from Fax App, including the information or content contained within them. Where we have a link to a website or service, linked to or from Fax App, we encourage you to read the privacy policy stated on that website or service before providing information on or through it.
