Terms of Service for Fate Says

These Terms of Service govern your use of the Fate Says app. Fate Says is created by Egils Broks (Broks Tech).

1. Acceptance of terms

By downloading, accessing, or using Fate Says, you agree to these Terms. If you do not agree, do not use the app.

Your use of the app is also subject to Apple's applicable terms and standard end-user license agreement.

2. About Fate Says

Fate Says is a casual decision helper. It offers a classic random yes-or-no result, an animated yes-or-no wheel, a Home Screen widget for a quick result, and a custom chooser that randomly selects from the options you enter.

The app is intended for entertainment and general personal convenience. It is not a professional advisory service, medical service, emergency service, financial or investment service, legal service, safety system, gambling platform, or source of verified facts.

3. Random results and your decisions

App results are generated randomly. A result does not evaluate your circumstances, predict an outcome, verify that an option is safe or lawful, or represent advice from Egils Broks or Broks Tech.

You remain solely responsible for your choices and their consequences. Do not rely on the app for decisions involving health, safety, emergencies, legal rights, finances, employment, travel risk, or other matters where professional judgment or verified information is appropriate.

4. Eligibility

You must be legally permitted to use the app under the laws that apply to you. If you are below the age at which you can agree to these Terms, a parent or legal guardian must review and agree to them on your behalf.

5. Your responsibilities

You are responsible for:

• Deciding whether the app is appropriate for a particular choice.

• Reviewing options before acting on a generated result.

• Avoiding sensitive, unlawful, abusive, defamatory, or infringing text.

• Keeping your device secure.

• Following applicable laws and respecting other people's privacy and rights.

• Seeking qualified help when a decision requires professional advice or urgent assistance.

6. User-entered content

You retain responsibility for questions and options you enter. You permit the app to process that content locally as necessary to provide its features.

The current version does not transmit your entered content to a developer-controlled backend. You should nevertheless avoid entering confidential, highly sensitive, or third-party personal information that is unnecessary for using the app.

7. Acceptable use

You agree not to:

• Use the app in violation of applicable law or another person's rights.

• Use generated results to justify harm, harassment, discrimination, deception, or unsafe conduct.

• Attempt to interfere with the app, bypass security measures, or introduce harmful code.

• Reverse engineer, copy, modify, or distribute the app except where applicable law expressly permits it.

• Misrepresent random app output as verified advice, an official determination, or a guaranteed outcome.

8. Intellectual property

Fate Says, including its software, design, name, graphics, and app content, is owned by Egils Broks or the applicable licensors and is protected by intellectual property laws. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the app in accordance with these Terms and applicable Apple terms.

Apple system fonts, SF Symbols, iOS, and other Apple materials remain owned by Apple or the applicable licensors and are used under their respective terms.

9. Free access and Fate Says Pro

Fate Says provides five free in-app decisions shared across the classic yes-or-no chooser, the wheel, and the custom chooser. After those free decisions are used, Fate Says Pro is required to generate additional results in those in-app modes. The Home Screen widget and Apple system surfaces may have separate availability or technical limitations.

Fate Says Pro may be offered as:

• A weekly auto-renewable subscription.

• A lifetime, one-time non-consumable purchase.

The exact price shown in the app and Apple's purchase confirmation sheet applies to your storefront and currency. Payment is charged to your Apple Account after you confirm the purchase.

The weekly subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period. Your Apple Account is charged for renewal within 24 hours before the current period ends. You can manage or cancel the subscription in your Apple Account subscription settings. Deleting the app does not cancel a subscription.

The lifetime purchase unlocks Pro for the lifetime of the app and product, subject to these Terms, platform availability, and mandatory consumer rights. Purchases can be restored through Restore Purchases using the Apple Account that made the purchase. Refund requests and billing disputes are handled by Apple under Apple's policies and applicable law.

Purchase availability, pricing, taxes, currency conversion, family sharing, refunds, and billing are controlled by Apple and may vary by country or region. RevenueCat is used to validate purchases and provide Pro entitlement status but does not process your payment-card details.

10. Apple services

The app relies on Apple platform services, including iOS, SwiftUI, system fonts, SF Symbols, and haptic feedback. Availability and operation of those services are controlled by Apple and are subject to Apple's terms and privacy policies.

Apple is not responsible for support or maintenance of Fate Says except as required by applicable Apple terms or law.

11. Privacy

Your use of the app is also governed by the Privacy Policy for Fate Says, which explains what information the app handles and the choices available to you.

12. App availability and changes

We may update, change, suspend, or discontinue the app or individual features. We do not guarantee that every feature will remain available, work with every device or operating system version, or operate without interruption.

Updates may be required to continue using the app. We are not responsible for failures caused by unsupported devices, outdated operating systems, Apple service outages, or circumstances outside our reasonable control.

13. Disclaimer of warranties

To the maximum extent permitted by law, Fate Says is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We do not guarantee that the app will be uninterrupted, error-free, completely accurate, secure against every threat, or suitable for every purpose.

Random results are not guaranteed to meet your expectations or produce a useful, fair, safe, or desirable real-world decision. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

14. Limitation of liability

To the maximum extent permitted by law, Egils Broks will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. This includes loss of data, profits, opportunities, goodwill, or reputation resulting from use of or inability to use the app or from reliance on a generated result.

To the maximum extent permitted by law, total liability for any claim relating to the app will not exceed the amount you paid for the app, if any, during the twelve months before the claim arose.

These limitations do not apply where liability cannot lawfully be limited, including mandatory consumer protection rights available to you.

15. Termination

You may stop using the app at any time. Your rights under these Terms end if you materially breach them. We may suspend or discontinue the app where permitted by law. Provisions that by their nature should continue after termination, including intellectual property, disclaimers, and liability limitations, will remain in effect.

16. Changes to these Terms

We may revise these Terms when the app, our practices, or legal requirements change. Updated Terms will show a new "Last updated" date. Continued use after revised Terms become available means you accept them, except where applicable law requires another form of notice or consent.

17. Governing law

These Terms are governed by the laws of Latvia, without regard to conflict-of-law rules, unless mandatory consumer protection laws in your country require otherwise. Any mandatory rights available where you live remain unaffected.
