All character design's (from 09/25/2025 to present day) I create remain MY intellectual property untill ownership is officially transferred over to the buyer. Ownership is ONLY granted once payment is completed AND the buyer agrees to and follow's ALL of my Term's Of Service (TOS) Should the buyer violate theses terms (my TOS), ownership of the character design automatically reverts back to me, and the buyer forfeits any claim to the character. NO refund will be provided in cases where ownership is revoked due to a breach in Terms Of Service (TOS). My TOS consist of: General Rule's, Sale's Rule's, and Breeding Rule's.

Any interaction with minors will be strictly business-related. I will not engage in personal friendships or conversations beyond what is necessary for commission or business purposes.
I reserve the right to refuse services, communication, or interactions with anyone at my own discretion. While I aim to be polite and professional, continued access to my time and work depends on maintaining respectful communication.
Please do not involve me in personal disputes, arguments, or unrelated drama. Matters that may concern me include:
Violations of my Terms of Service or Rules.
Instances of impersonation (of me or others).
Individuals misrepresenting their age.
Theft of my art, characters, or foals not backed by legitimate certificates.
I maintain a public blacklist. This is not for gossip or harassment, but for clarity regarding who is not permitted to purchase, own, or use my art, characters, horses, or lines. Only names will be listed. Specific reasons will not be disclosed, as I do not support public shaming. The list exists solely to protect my work and community. Do not privatly message me asking who did what I will NOT privatly shame people regardless of what they do/have done
Unless otherwise agreed in writing, I retain 100% of all copyright, ownership, title, and intellectual property rights to every piece of artwork, design, base, character, complex coat pattern, and custom creation I produce.
Purchasing artwork does not transfer copyright ownership.
Upon receipt of full payment, the Buyer receives a non-exclusive, non-transferable, perpetual, worldwide license for personal use only, subject to compliance with this Terms of Service.
The Buyer may:
Use purchased artwork for personal characters.
Display artwork online.
Use artwork for roleplay, games, references, and personal collections.
Resell said artwork for the same amount or less then they have paid UNLESS they have added 2+ aditional artwork
The Buyer may not:
Use artwork for AI datasets or AI training.
Claim the artwork as their own.
Remove my signature.
Copy, trace, recreate, or imitate my unique designs or complex markings.
All art created by me must be credited to me wherever it is posted or displayed, Buyers may NOT claim my artwork as there own under any circumstances.
If you wish to sell art, characters, or horses purchased from me, you must contact me privately first. I reserve the Right Of First Refusal (ROFR), meaning I have the option to buy them back before they are publicly listed for sale.
Horses or design's purchased from me may NOT be resold for a higher price then originally paid unless additional art has been legitimately added. Additional art MUST be of reasonable quality and effort. Using large number of bases made by others solely to increase value does not qualify
Any information provided about a horse (such as lineage, stats, or other recorded details) must remain accurate and may not be altered without my express permission.
I do NOT consent to ANY of my bases to be resold what so ever. I keep a record of who and what I sell so I will know who breaks this rule! You pay for it meaning ONLY you can use it
All of my bases I make, Limited or not are 100% able to be used for adopts (1/2 of what you paid for the base is the MAX price you may sell each adopt for) or you can use it for personal usage
DO NOT under ANY circumstances, remove or move my signature. You may add your's in a diffrent spot if you are selling adopt's but DO NOT remove mine.
The Artist reserves the right to adjust breeding availability at their discretion. To prevent over production mares are allowed 8 breeding's, and stallions allowed 10.
All foals must have at least two unique pieces of artwork before they may age up, If using bases created by others, foals must have at least four pieces of artwork before ageing up.
All horses produced by Fairfield must retain their original branding at all times. Buyers or owners may not add their own branding, as the horse was not originally produced by them. Horses that have art automatically are branded by me and will not be allowed to remove the brand or have yours's added. Only acception is blank slate horses that only come with there intended design and no extra art. IF the foal is by one of my studs but your mare, BOTH mine and your brand's may be displayed.
The artist reserves the right to ONE free covering from from any stallion or mare produced by them | This means any foal produced by a Stud or Mare I own I gain ONE free covering to them
Only stallions listed as "Available" may be used for breeding, do not Dm artist requesting a covering from unavailable studs.
All breeding's will include a signed plaque from the artist confirming the breeding, making the foal officially legitimate. Buyer will reserve a list of possible foal colors/offspring coat outcomes, all foal coats must follow the provided list when using none ghost mare. When using ghost mare Extreme or unrealistic coat modifications will not be permitted
The artist maintains updated information such as: Registries, Show's and Placings, Points, and Foals Produced.
Buyers and breeders must follow these rules at all times, Any Violation (with proof) including, Overbreeding, removing/changing branding, or creating an overly unrealistic offspring(this one specifically will result in a personal DM reminder before any actions are taken) may result in: Loss of breeding rights, Removal from artists registries + blocklist, Repossession rights (if applicable under the artists TOS)
These horses are my pride and joy, they are the horses I cherish each and every day. For this reason I have these horsehorses not only at a higher price and standard, but my Rules for them ARE harsher then other horses due to them meaning so much. These are the rules for my high Value horses ALONG with a list of said high Value horses!

High Value horses are mostly going to produce fillies rather than colts. The only time I will let colts born from HV horses are either from paying extra, a High Value trade, Leasing Benefits, or Close Friends
I get one designated covering from any foal produced by high Value horses
If I feel like you buy and sell fast I reserve the right to refuse you from using my high Value horses
If sold you must remove my high Value horses from the lineage to keep my horses from being overused lineage wise. IF it is a great grand offspring this rule does not apply.
Foals produced directly from my high Value horses are to not be overbred publicly max 10 public foals. apply
High Value offspring must be aged reasonably, Ex: 2 foal images, bare minimum of x2 yearling shows, then bare minimum x1 adult training image.
I appreciate those who follow these rules as these horses mean a lot to me.
These rules apply to both premade tack AND custom tack made by Fairfield
Normally with Adopts or Custom horses Resell Right's ARE included with the buying price you pay for, but Horse Adopts have the ability to increase value. Tack however are NOT able to increase or decrease in value as they are just nice thing's you draw on your horse. Therefore we/I do NOT offer any resell right's on any of the tack made by myself, this means once you pay for it, its yours BUT you are NOT allowed to sell it or give it to other people for "free" it is sold to you and ONLY you.
Minor violations (such as failing to provide credit) may be handled through a Three-Strike Policy at my discretion.
Serious violations—including but not limited to:
unauthorized resale
copyright infringement
tracing
design theft
removal of signatures
may result in immediate termination of all licenses without warning.
Upon termination:
all licenses granted to the Buyer immediately end;
no refunds will be issued for violations of these Terms;
the Buyer may be permanently blacklisted.
I reserve the right to issue DMCA takedown notices and pursue any legal remedies available under applicable copyright law.
This means you will no longer retain ANY access to any charecter's you have purchased and said charecter's will once again return and belong to me.
These Terms shall be governed by the laws of the State of Oregon, United States.
Any legal dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Oregon, unless otherwise required by applicable law.
