Welcome to Portrait Morph AI. This Terms of Service (“Terms”) is a legal agreement between you and Zhao Ruixia (“we”, “us”, or “our”) governing your use of the Portrait Morph AI mobile application (the “Service”).
1. Acceptance of Terms
By downloading or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must immediately stop using the Service and uninstall the application.
2. Eligibility
You must be at least 17 years old (or the minimum legal age in your country) to use this Service. If you are a minor, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
3. AI Services and Content
3.1 Input and Output: You may upload images/videos (“Input”) to generate transformed videos (“Output”) using our AI technology.
3.2 User Ownership: You retain ownership of your Input and, to the maximum extent permitted by law, you own the Output.
3.3 License to Us: To provide the Service, you grant us a worldwide, non-exclusive, royalty-free license to process your Input solely for the purpose of generating the Output. All facial data processing is conducted in real-time according to our Privacy Policy, and we do not retain your original Input or any extracted facial feature data once the Output is generated.
4. User Representation and Warranties
By uploading any photo or video containing a human face, you represent and warrant that:
* You have obtained explicit consent and all necessary rights from the individual(s) appearing in the content.
* Your use of the Service does not violate the privacy, publicity, or intellectual property rights of any third party.
* You assume full legal responsibility for any claims, damages, or liabilities arising from the use of Output that features the likeness of others.
* You acknowledge that the Service is for entertainment purposes only and you will not use the Service to attempt to circumvent any biometric security or identity verification systems.
5. Prohibited Uses
You agree NOT to use Portrait Morph AI to:
* Create unauthorized synthetic, deceptively altered, or digitally manipulated media for harassment, defamation, or sexual exploitation.
* Impersonate public figures or create deceptive political content.
* Generate content that is illegal, violent, or promotes hate speech.
* Reverse engineer or attempt to extract the source code of our AI models.
* Create content that violates any local or international laws regarding biometric privacy (such as BIPA or GDPR).
6. Subscription and Billing
6.1 In-App Purchases: Portrait Morph AI offers premium features via subscription. There are no third-party advertisements in the Service.
6.2 Payment Processing: All payments are processed by the Apple App Store or Google Play Store. You are subject to their respective terms and conditions.
6.3 No Refunds: Since AI video generation incurs immediate computing costs, subscriptions are non-refundable once any AI generation has been initiated, except as required by local law or platform policies.
7. Disclaimers
* "As Is": The Service is provided on an “AS IS” basis. We do not guarantee that the AI Output will meet your expectations or be error-free.
* Third-Party AI: We utilize third-party AI interfaces (e.g., OpenAI, Gemini). We are not responsible for service interruptions caused by these providers.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZHAO RUIXIA SHALL NOT BE LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE LAST 12 MONTHS OR $50.00 USD, WHICHEVER IS GREATER.
9. Governing Law
These Terms are governed by the laws of the jurisdiction where the provider (Zhao Ruixia) is located. You agree to submit to the personal jurisdiction of the courts located within that region for any legal disputes.
