Welcome to Explain This To Me. These Terms of Use govern your use of the Explain This To Me mobile application for iOS devices, operated by New Version Limited, a company incorporated in New Zealand.

By downloading, installing, or using Explain This To Me, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Application.

Acceptance of Terms

By accessing and using Explain This To Me, you accept and agree to be bound by the terms and provision of this agreement. Additionally, when using this Application, you shall be subject to any posted guidelines or rules applicable to such services.

Description of Service

Explain This To Me is a mobile application that uses artificial intelligence to generate educational explanations tailored to any audience. The Application offers both free and premium subscription tiers with varying features and usage limits.

Free Tier Features (No Authentication Required):

- App Store Compliance: No sign-in required to access features or make purchases (Apple App Store Guideline 5.1.1)

- 1 explanation per day

- Adult audience only

- Standard tone only

- Short length explanations only

- Full access to any topic

- Can save unlimited favorites (view first/latest only)

- Local-only storage (or optional CloudKit sync with sign-in)

- Can subscribe to Premium via Apple ID (no app authentication required)

Premium Tier Features (Subscription via Apple ID):

- Unlimited daily explanations (generous 100-explanation threshold with friendly cooldowns)

- All 4 audience types (Child, Teen, Adult, Expert-level)

- All 4 tone options (Standard, Friendly, Funny, Professional)

- All 3 length options (Short, Medium, Long)

- Voice Input for hands-free topic entry

- Interactive Follow-Up Tabs (5 intelligent follow-up options per explanation)

- Text-to-Speech with customizable voice selection

- Unlimited favorites library with full access

- Cross-device CloudKit sync (optional, requires sign-in)

Age Requirements and Restrictions

Explain This To Me age rating is 13+. The Application generates educational content that is appropriate for general audiences. By using this Application, you represent and warrant that:

- The app can be used by children of any age

- If you are under 13, your parent or guardian must provide consent for features that collect personal data (such as signing in with Apple, cloud sync, etc.)

- You have the legal capacity to enter into this agreement (or your parent/guardian consents on your behalf)

- Your use of the Application complies with all applicable laws and regulations

If you are under the age of digital consent in your region and do not have parental consent for data collection, you may use the app but should not sign in or use features that collect personal information.

User Accounts and Registration

You may use Explain This To Me without creating an account. The Application works immediately without any sign-in required (compliant with Apple App Store Guideline 5.1.1). However, to access cloud synchronization features, you may optionally sign in using Sign in with Apple.

When you create an account, you agree to:

- Provide accurate and complete information

- Maintain the security of your account credentials

- Notify us immediately of any unauthorized use of your account

- Accept responsibility for all activities that occur under your account

Subscription Terms - App Store Compliant

Premium Subscriptions

Explain This To Me offers premium subscriptions on a monthly or yearly basis. Subscription prices are set in your local currency and may vary by region.

- Monthly Subscription: Base price $6.99/month (varies by region with localized pricing)

- Yearly Subscription: Base price $59.00/year (varies by region with significant savings)

No Authentication Required for Purchases

In compliance with Apple App Store Guideline 5.1.1, you can subscribe to Premium using your Apple ID through StoreKit without any app-level authentication. Simply:

1. Tap any premium feature or the upgrade button

2. Choose your subscription plan

3. Complete purchase through Apple's payment system

4. Enjoy Premium features immediately

Free Trial

New users may be eligible for a 7-day free trial of premium features. The free trial is available only once per Apple ID. Your subscription will automatically begin at the end of the trial period unless cancelled before the trial expires.

Auto-Renewal

All subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You may cancel your subscription at any time through your iOS Settings → Subscriptions. Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial subscription periods.

Billing and Refunds

All purchases are processed through the Apple App Store and are subject to Apple's Terms of Service. We do not have access to your payment information. All billing inquiries should be directed to Apple Support.

Refunds are handled exclusively by Apple according to their refund policy. We cannot process refunds directly.

Usage Guidelines and Restrictions

Acceptable Use

You agree to use Explain This To Me only for lawful purposes and in accordance with these Terms. You agree not to:

- Use the Application for any unlawful purpose or to solicit others to perform unlawful acts

- Violate any international, federal, provincial, or state regulations, rules, or laws

- Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate

- Submit false or misleading information

- Upload or transmit viruses or any other type of malicious code

- Collect or track personal information of other users

- Spam, phish, pharm, pretext, spider, crawl, or scrape

- Interfere with or circumvent the security features of the Application

- Reverse engineer, decompile, or disassemble the Application

- Attempt to abuse the AI generation service through automated or excessive requests

Content Guidelines

The explanations generated by Explain This To Me are created by artificial intelligence based on your selected preferences. While we strive to provide appropriate content, you acknowledge that:

- Generated content may occasionally contain inaccuracies

- You are responsible for reviewing content before using it

- You should use generated explanations appropriately and responsibly

- The Application is intended for educational and informational purposes

We reserve the right to monitor usage patterns and implement safeguards to prevent misuse of the Application.

Abuse Prevention and Fair Use

To ensure fair usage and prevent abuse of our AI services, we implement usage monitoring and limits:

Free Users:

- Limited to 1 explanation per day

- No additional restrictions due to built-in limits

Premium Users:

- Generous usage allowances with 100-explanation threshold

- Friendly cooldown periods (10 minutes) may apply after very heavy usage

- Usage patterns are monitored to prevent abuse of AI services

We reserve the right to suspend or terminate accounts that engage in abusive usage patterns that may negatively impact service quality for other users.

Intellectual Property Rights

Application Ownership

Explain This To Me, including all content, features, and functionality, is owned by New Version Limited and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Generated Content

Explanations generated by the Application are provided for your personal educational use. You may use generated explanations for their intended purpose of learning and understanding. This includes:

- Personal study and reference

- Sharing via text or image formats for educational purposes

- Social media posting with proper attribution

- Educational and non-commercial use

However, you may not:

- Commercially redistribute generated content without permission

- Use generated content for automated or bulk messaging systems

- Attempt to reverse engineer the AI generation process

- Remove watermarks from free tier image exports

- Claim exclusive ownership of AI-generated explanations

User Content

Any content you provide to the Application (topics, edited explanations) remains your property. By providing such content, you grant us a limited license to use it solely for the purpose of generating explanations for you.

Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using Explain This To Me, you agree to the collection and use of information in accordance with our Privacy Policy.

Key privacy commitments:

- We do not sell your personal information

- Explanations are not stored permanently on external servers

- We only use the topics you provide for explanation generation

- All data is encrypted and securely stored

- Optional CloudKit sync requires sign-in

Account Deletion

Signed-in users can delete their account at any time through Settings → Danger Zone within the Application. This will:

- Delete all CloudKit data (explanations, statistics, subscription records)

- Remove all local data from your device

- Automatically sign you out

Note: Active subscriptions must be managed separately through iOS Settings → Subscriptions.

Disclaimers and Limitations

Service Availability

We strive to maintain continuous service availability but do not guarantee uninterrupted access. The Application may be temporarily unavailable due to:

- Scheduled maintenance

- Technical difficulties

- Third-party service interruptions

- Force majeure events

AI-Generated Content Disclaimer

Explanations generated by Explain This To Me are created by artificial intelligence and are provided for educational and informational purposes. We do not guarantee:

- The complete accuracy of all generated content

- The appropriateness of explanations for all use cases

- That generated content will be suitable for all educational contexts

You are solely responsible for how you use generated explanations and any consequences of their use.

Limitation of Liability

To the maximum extent permitted by applicable law, New Version Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

- Loss of profits

- Loss of data

- Loss of use

- Loss of goodwill

- Business interruption

- Any other commercial damages or losses

Our total liability to you for all damages shall not exceed the amount paid by you for the Application in the 12 months preceding the claim.

Warranty Disclaimer

Explain This To Me is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to:

- Merchantability

- Fitness for a particular purpose

- Non-infringement

- Accuracy of information

- Uninterrupted service

Indemnification

You agree to indemnify and hold harmless New Version Limited, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

- Your use of the Application

- Your violation of these Terms

- Your violation of any rights of another person or entity

- Any content you provide to the Application

Termination

We may terminate or suspend your account and access to the Application immediately, without prior notice, for any reason, including:

- Breach of these Terms of Use

- Violation of applicable laws

- Abuse of the service

- Non-payment of subscription fees

- Extended periods of inactivity

Upon termination:

- Your right to use the Application ceases immediately

- You must delete the Application from your devices

- Subscription benefits end immediately

- Stored data may be deleted from our servers

You may terminate your account at any time by:

- Uninstalling the Application

- Cancelling your subscription through iOS Settings

- Using the account deletion feature in Settings → Danger Zone

Governing Law and Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms or your use of the Application shall be subject to the exclusive jurisdiction of the courts of New Zealand.

If you are located outside New Zealand, local laws may also apply to your use of the Application.

Changes to Terms

We reserve the right to modify these Terms of Use at any time. We will notify users of material changes through:

- In-app notifications

- Email notifications (if you have provided an email address)

- Updated terms posted within the Application

Continued use of the Application after changes constitutes acceptance of the new Terms. If you do not agree to modified terms, you must stop using the Application.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:

- Acts of God

- Natural disasters

- War or terrorism

- Government actions

- Internet service interruptions

- Third-party service failures

Customer Support

Support and Technical Assistance

When you contact us for customer support through the Application, you acknowledge and agree that we may automatically collect and use technical information from your device to provide better assistance. This includes:

- Application version and build number

- Device model and operating system version

- Subscription status and account information

- Usage statistics and app performance data

- User identifier for account-related inquiries

This information is collected solely for the purpose of providing technical support, troubleshooting issues, and improving our customer service. We use this data only to assist you with your inquiry and do not share it with third parties except as described in our Privacy Policy.

Apple App Store

Explain This To Me is distributed through the Apple App Store and is subject to Apple's Terms of Service. In case of conflict between these Terms and Apple's Terms of Service, Apple's terms shall prevail for matters related to the App Store.

Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and New Version Limited regarding the use of Explain This To Me and supersede all prior agreements and understandings.
