Regulatory Taking
Regulatory Taking
Overview:
Regulatory takings is when property is "taken" or its value is greatly diminished. It refers to the government establishing a piece of land that dictactes they have the right to that property, no matter the cost it takes to get it.
Wise Use stance (according to writer Phil Brick); "The Fifth Amendment to the U.S Constitution guarantees compensation for property taken by eminent domain. Property rights advocates want compensation extended to property 'taken' by government regulations, even if the 'taking' is only partial."
Example of regulatory takings:
A cable box physically placed on someone's property
The government says I can only build a tee-pee on a piece of land
