Welcome to Emovia! These terms govern your use of the application and its services. By using Emovia, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using Emovia, you confirm that you have read, understood, and agreed to these Terms & Conditions. If you do not agree, you must stop using the app.

2. Eligibility

To use Emovia, you must be at least 13 years old. By using the app, you confirm that you meet this requirement.

3. Account Registration

• You are required to create an account to use the app.

• You are responsible for maintaining the confidentiality of your credentials.

• Notify us immediately of any unauthorized access to your account.

4. Use of the App

You agree to use Emovia for lawful purposes and comply with these Terms. Prohibited activities include:

• Sharing harmful, abusive, or illegal content.

• Attempting to hack, reverse-engineer, or disrupt the app.

• Violating the rights of others or applicable laws.

5. Credits, Plans, and Subscriptions

• Emovia offers free and paid plans. Creating images consumes credits or counts toward your plan's usage allowance, and the amount may vary depending on the type and quality of the creation.

• Free: free users may create images at no cost, subject to the Fair Use Policy below. We may additionally offer complimentary bonus credits (such as daily credits) at our discretion; these offers may be changed or discontinued at any time.

• Plus: subscribers receive a monthly credit allowance that renews with each billing cycle.

• Pro: subscribers may create freely without counting credits, subject to the Fair Use Policy below.

• Unused credits may expire according to their type and are non-refundable.

• Subscriptions are managed through Apple's payment system and renew automatically unless cancelled.

• All transactions are securely processed through Apple's payment system in compliance with their policies.

Fair Use Policy

To keep Emovia fast, reliable, and sustainable for everyone, all plans — including Pro — are subject to reasonable usage limits. These limits are set well above typical usage and are designed to prevent abuse, not to restrict genuine self-expression. If you reach a limit, image creation pauses and the app will let you know; limits reset automatically with your next billing cycle (or periodically for free accounts). Emovia reserves the right to adjust these limits at any time. Automated, scripted, or multi-account usage intended to circumvent limits is prohibited and may result in throttling, suspension, or termination of your account.

6. AI-Generated Content

• Images generated within Emovia are created using AI and may vary in quality and accuracy.

• We do not guarantee that generated images will meet your specific expectations.

7. Intellectual Property

The app and its content, such as text, graphics, logos, and software, are the intellectual property of Emovia. You may not copy, modify, or distribute any part of the app without prior written consent.

8. User Content

By submitting content to Emovia:

• You grant us a non-exclusive, royalty-free license to use and distribute your content for service purposes.

• You retain ownership but must not submit illegal or harmful materials.

9. Termination

We may suspend or terminate your account or access if you violate these Terms or engage in unlawful activities.

10. Disclaimers

Emovia is provided "as is," without warranties of any kind. We do not guarantee uninterrupted service or that the app will meet your specific needs.

11. Limitation of Liability

We are not liable for any direct, indirect, incidental, or consequential damages from your use of Emovia, to the fullest extent permitted by law.

We may update these Terms & Conditions periodically. Your continued use of Emovia after changes signifies acceptance of the updated terms.
