END USER LICENSE AGREEMENT

IMPORTANT: READ CAREFULLY BEFORE USING THIS APPLICATION
This End User License Agreement ("EULA") is a legal agreement between you and Eidolon for the use of the Eidolon mobile application ("the App").
1. LICENSE GRANT
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:
• Download and install the App on devices you own or control
• Use the App for personal or commercial purposes (with appropriate subscription)
• Access features and services according to your subscription level
2. LICENSE RESTRICTIONS
You may NOT:
• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Rent, lease, lend, sell, or sublicense the App
• Transfer the App to any third party
• Use the App for illegal purposes
• Circumvent any access restrictions or security features
• Use automated systems to access the App
3. SUBSCRIPTION TIERS
3.1 Free Tier
• Limited monthly credits
• Basic features
• Watermarked output
• Personal use only
3.2 Starter Premium ($9.99/month)
• 300 monthly credits
• Flash and Pro 2K models
• No watermarks
• Priority queue
• Personal use only
3.3 Pro Premium ($19.99/month)
• 800 monthly credits
• All models (Flash, Pro 2K, Pro 4K)
• Commercial license
• Exclusive features
• Priority support
4. PAYMENT TERMS
4.1 Billing
Subscriptions are billed through Apple's App Store. All charges are in US Dollars unless otherwise stated.
4.2 Auto-Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the period ends. You can manage subscriptions in your Apple ID settings.
4.3 Price Changes
We reserve the right to change subscription prices with 30 days notice. Changes apply to subsequent billing periods.
5. INTELLECTUAL PROPERTY
5.1 App Ownership
The App, including all code, designs, graphics, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws.
5.2 User-Generated Content
You retain ownership of images you create. However:
• Free tier: Personal use only
• Starter: Personal use only
• Pro: Commercial use permitted with active subscription
5.3 Third-Party Content
Some features use third-party AI models. Generated content must comply with their terms of service.
6. WARRANTY DISCLAIMER
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:
• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY
• UNINTERRUPTED OR ERROR-FREE OPERATION
We do not warrant that:
• The App will meet your requirements
• AI-generated content will be accurate
• Defects will be corrected
• The App is virus-free
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Personal injury or property damage
• Damages exceeding the amount you paid for the subscription
8. INDEMNIFICATION
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:
• Your use of the App
• Violation of this EULA
• Infringement of third-party rights
• Your generated content
9. TERMINATION
9.1 By You
You may terminate this license by deleting the App and cancelling your subscription.
9.2 By Us
We may terminate your license immediately if you:
• Violate this EULA
• Engage in fraudulent activity
• Abuse the service
• Fail to pay subscription fees
9.3 Effects of Termination
Upon termination:
• Your right to use the App ceases
• Outstanding fees remain due
• Certain provisions survive (intellectual property, warranties, liability)
10. UPDATES AND MODIFICATIONS
We may update the App to:
• Add new features
• Fix bugs and improve performance
• Comply with legal requirements
• Enhance security
Updates may require acceptance of new terms.
11. EXPORT COMPLIANCE
The App is subject to US export laws. You agree not to export or re-export the App to prohibited countries or entities.
12. GOVERNING LAW
This EULA is governed by the laws of the United States and the State of California, without regard to conflict of law principles.
13. DISPUTE RESOLUTION
13.1 Informal Resolution
Before filing a claim, you agree to contact us to attempt informal resolution.
13.2 Arbitration
Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
13.3 Class Action Waiver
You agree to resolve disputes individually and waive the right to participate in class actions.
14. SEVERABILITY
If any provision of this EULA is found unenforceable, the remaining provisions remain in effect.
15. ENTIRE AGREEMENT
This EULA, along with our Terms of Service and Privacy Policy, constitutes the entire agreement regarding the App.
