This academic study entitled "Police Oversight: International Debates & Exploration of An Appropriate Mechanism for Hong Kong" is conducted by Dr. Ka-ki Lawrence Ho from the Department of Social Sciences, The Education University of Hong Kong. It is funded by the Policy Innovation and Co-ordination Office, Hong Kong SAR Government under the public policy research funding scheme to review the debates on police oversight mechanism overseas and explore the possible practices in Hong Kong.
It attempts to provide an in-depth review to police oversight mechanisms of the selected common law jurisdictions and fellow Asian cities, aiming at exploring the key practices and their merits/ limitations in achieving the two most important purposes of police oversight- ensuring internal hierarchical accountability and enhancing external public accountability of the police force. Three major areas of controversies addressed in literature will be particularly investigated- representation, empowerment and professionalism of the oversight mechanism. On the top of overseas experience, the study would also include a comprehensive assessment on the opinion orientation of different stakeholders, including the police, oversight agency members, complainants, or citizens who have pleasant, unpleasant and also no experience from the current police oversight mechanism, probing their thoughts about the oversight arrangement of their respective countries. At the conclusion of the study, it expects to provide comprehensive data and recommendations for introducing possible reforms on the current review board oversight model in Hong Kong.
本學術研究計劃由香港教育大學社會科學系何家騏博士主持，並由香港特別行政區政府政策創新與統籌辦事處資助。其目的是促進世界各地警政研究學者交流，透過比較世界各地不同司法系統下監警制度的異同，為香港現時監警制度提供學術意見，進一步提升到其效能。
本研究團隊骨幹成員來自香港，同時邀請數位來自台灣日本等鄰近國家及地區的學者作學術合作伙伴。香港作為亞州少數採用普通法系司法管轄區，本研究將從現代學者對監警制度提出三個爭議點 （代表丶賦權丶專業）出發，希望能深入認識鄰近以歐陸法系主導的地區，探討此法系下監警制度運作的情況與利弊，能在多大程度上做到對內問責，對外盡責的願景。除了海外學者學術材料外，本研究更希望深入接觸不同國家及地區與監警制度相關持分者，如警務人員丶非政府監警組織丶曾就警務人員工作表現作出投訴的公眾人士，了解他們對現行監警制度的看法和建議，從而為香港監警制度提供可靠的海外學術研究成果作參考，為下一歩香港監警制度深化改革作更全面的準備。
本研究計画は香港教育大学社会科学学部のホーカーキー（何家騏）博士によって主導され、香港特別行政区政府の「政策革新と計画部」の経済的援助を受けております。
この研究は世界各国の警察に対する監察メカニズムを解明、分析し、コモンロー国家や隣接するアジア国家が使用しているメカニズムにおいて現在香港が使用している警察監察制度を最適化することを目的とする。それと同時に、それぞれの制度が警察監察において最も重要な二つの目標：内部の階級的問責制を建設する、外部から警察に対する問責制を建設する、における要点、優劣を比較することをも目的とする。方法として、文献より代表性、責任性、専門性の三つの角度を取り上げ、各国の問題点について当てることにする。また、全面的な学術研究成果を出すため、海外での学術的材料の他に、警察、監察人員、苦情申出人などのステークホルダーたちの意見も取り入れ、各自自分の国の警察監察制度に対する考えも合わせている。最終的にこの研究は、現在香港の警察監察制度に対して有力なデータを提供し、かつ実現可能の改革案を出せることを目指しております。
