The Backlog Scenario

Right now, there are 625,000 applications waiting to be processed with 394,000 that are in the pending state. The United States Citizenship and Immigration Services (USCIS) will send a Request for additional Evidence to an applicant in the event that they require more information about their I-765 (RFE) application. There are currently 19,000 RFEs that USCIS is awaiting responses on. Before their application is adjudicated, applicants are required to submit all documentation requested in the RFE.

Automatic Renewals Policy

Once the completed I-765 Form is submitted, USCIS aims to process EAD applications within 90 days, however, they consistently miss this deadline. But in the event that an individual needs more time to complete his application, he must submit a request for renewal before his EAD expires. More than 80 percent of I-765 renewals that have been pending for 90 to 180 days are expected to be eligible for a 180-day extension automatically. Of this 80% of requests, 19,204 have been in the pending status for more than 160 days while another 18,917 have been pending for more than 180 days. The USCIS encourages applicants to file applications in full to limit the number of REFs and longer wait periods.

Getting Your EAD and Documents Delivered

A candidate submitting their application will get regular online case status updates. Customers who find that the USCIS online system does not recognize the receipt number have been given the option of notifying the USCIS through email on myuscissupport@uscis.dhs.gov. Following this, the EAD card will be prepared within 96 hours of receipt of the order and sent to the applicant's address on the USPS file. If a change of address is required, it must be initiated within 10 days of your move and you are to file a Change of Address Form AR-11. If an applicant needs to change their address with USCIS, they must do so within 10 days of moving.

If an applicant intimates the post office of their relocation, the USPS may not deliver the customer's documents and will instead issue a notice that says "Return Service required". The customer's new mailing address will be included on the shipping label that will be attached to any item being returned to USCIS. In the event that USPS is unable to send the card for any reason, they will explain the situation to the USCIS and provide an explanation. If an applicant is going to be away from their address for up to 30 days, the post office can decide to hold their mail until they return.

The United States Postal Service (USPS) offers a service known as "informed delivery," which notifies consumers about a letter-size envelope on the day in question. Even if the customer does not subscribe to the informed delivery service, they should be able to track the delivery of their card through the online account below the "Status of my case" heading. In the event that an applicant receives an EAD card with an error caused by USCIS, they will be provided instructions on how to receive a replacement. If the card problem was caused by the customer, then the customer must submit a new Form I-765. In the event that the EAD card never reached the consumer, they must use the AR-11 facility online to change their address, and a replacement will be shipped within the next sixty days.
