This End-User License Agreement ("EULA") is a legal agreement between you ("User", "you", or "your") and the developer of AI Drink Cocktail Menu Maker ("we", "us", or "our").
Please read this EULA carefully before downloading, installing, or using the AI Drink Cocktail Menu Maker mobile application (the "App"). By downloading, installing, or using the App, you are agreeing to be bound by the terms and conditions of this EULA. If you do not agree to the terms of this EULA, do not download, install, or use the App.
We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly in accordance with the terms of this EULA. The App is licensed, not sold, to you.
All intellectual property rights, including copyrights, patents, trademarks, and trade secrets, in the App and its content, features, and functionality (including but not limited to all software, source code, text, displays, images, video, and audio) are owned by us. You agree not to copy, modify, distribute, sell, or lease any part of our App or included software, nor may you reverse engineer or attempt to extract the source code of that software.
The App utilizes Artificial Intelligence (AI) to generate digital content based on text inputs provided by you.
Ownership of Generated Content: You retain all rights to the text prompts you input into the App.
Appropriate Use: You agree not to use the App to generate content that is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise violates any party’s intellectual property or these Terms.
No Guarantee of Accuracy: Because the App uses AI technology, we do not guarantee the accuracy, reliability, or appropriateness of the generated images.
Certain features of the App are available only through premium auto-renewing subscriptions or in-app purchases.
Billing: If you choose to purchase a premium subscription, payment will be charged to your Apple ID / Google Play account at the confirmation of purchase.
Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation: You can manage and cancel your subscriptions by going to your App Store or Google Play account settings after purchase. We do not process refunds directly; all refund requests must be handled through the respective app store policies.
The App may display, include, or make available third-party content (including data, information, applications, and other products/services) or provide links to third-party websites or services (e.g., OpenAI, Replicate). You acknowledge and agree that we are not responsible for Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality, or any other aspect thereof.
Your use of the App is also subject to our Privacy Policy, which explains how we collect, use, and safeguard your information. By using the App, you consent to the data practices described in our Privacy Policy.
The App is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, we expressly disclaim all warranties, whether express, implied, statutory, or otherwise, with respect to the App, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
To the fullest extent permitted by applicable law, in no event will we be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data, or other information, for business interruption, for personal injury, loss of privacy) arising out of or in any way related to the use of or inability to use the App.
This EULA is effective until terminated by you or us. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination of the license, you shall cease all use of the App and delete all copies of the App from your mobile device.
This EULA and your use of the App shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, excluding its conflicts of law rules.
We reserve the right, at our sole discretion, to modify or replace this EULA at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.
