This Terms of Service (“Agreement”) is a binding legal contract between you (“User”) and us, developer of the iOS mobile application Dr.Plant:Identify & Care (the “App”), distributed via Apple App Store for United States users.
By downloading, installing, opening, or using the App, you confirm you are 13 years of age or older per COPPA. If you are under 18, you warrant you have parental legal consent to use this App. If you disagree with any clause, you must delete the App immediately and cease all use.
Your use of the App is also governed by Apple’s Licensed Application End User License Agreement and Apple Media Services Terms; this Agreement supplements Apple’s store terms. In conflict, Apple’s official store terms take priority.
We grant you a non-exclusive, non-transferable, non-sublicensable, revocable limited license to install and run the App on Apple iOS devices you own or control, solely for personal, non-commercial plant care use.
You may NOT:
Reverse engineer, decompile, modify, hack, or extract App AI identification models, light meter algorithms, plant database content
Copy, redistribute, resell, rent, or share the App to third parties
Use the App for commercial farming diagnosis, professional paid consulting without written developer approval
Automate, scrape, bulk download plant species data, pest recognition data, or light measurement logic
The App provides five core tools:
AI plant identification via camera photo upload
Plant pest, fungus, disease visual scan & diagnosis
Custom plant watering/fertilizer/light care reminder scheduler
On-device light meter (lux illuminance calculator via iPhone camera)
Personal plant growth journal to store photos, notes, light history data
Optional location access can be granted to generate location-adapted plant care plans; location permission is fully optional and not required to use core functions.
You agree:
All photos you capture/upload for ID/pest scan are your original content, no copyrighted third-party images
Plant diagnosis, light lux readings, care suggestions and location-based guidance are reference-only; we do not provide professional botany, agricultural or medical advice for edible/toxic plants
You will not rely solely on App data to consume wild plants, berries, or foliage – all toxicity data is general reference, not 100% accurate
You take full responsibility for camera, photo library, location, notification permissions you grant to the App
This App has no social community features and does not require users to register an account for full basic functionality.
No mandatory account creation is required to use the App. All plant journal photos, plant logs, reminder notes (“User Content”) you create are stored locally on your device by default.
You own all User Content you create.
We grant us a worldwide, royalty-free temporary license to process your photos only to run plant/pest AI recognition; images are deleted post-analysis unless you manually save them to your personal journal.
No user profiles or public sharing feeds exist within the App.
Premium membership unlocks unlimited plant scans, ad-free experience, advanced light meter history tracking, bulk care reminders, full species flower/fruit taxonomy database access. All purchases process through Apple In-App Purchase:
Available Subscription Plans:
Weekly Plan: $19.99 per week with a 3-day free trial; auto-renews weekly
Monthly Plan: $39.99 per month, auto-renews monthly
Annual Plan: $99.99 per year, auto-renews annually
Payment charged to your Apple ID account upon subscription confirmation after trial expiration (if applicable)
All subscriptions auto-renew unless you disable auto-renewal a minimum of 24 hours before the end of current billing cycle
Your Apple ID will be charged renewal fees within 24 hours prior to expiration
You manage, cancel subscriptions entirely via iOS Settings > Apple ID > Subscriptions; we cannot process refunds directly – all refund requests must be submitted to Apple Support per Apple’s refund policy
The 3-day free trial automatically converts to weekly paid subscription if auto-renewal is not canceled before trial ends
Subscription pricing changes will be notified in advance via in-app pop-up; continued use after price change notification equals acceptance of new pricing
You shall not:
Upload violent, toxic, copyrighted, or inappropriate imagery to the plant identification tool
Use the App to identify illegal controlled plants, narcotics, invasive prohibited species for unlawful cultivation
Interfere with App servers, light meter sensor logic, or AI recognition services
Submit false plant/pest data to disrupt our species database
Attempt to bypass Premium subscription paywalls or trial restrictions
All plant taxonomy data (Family/Genus/Species), care guides, light meter algorithms, pest diagnosis models, App UI, text, graphics are exclusive intellectual property of us. No rights to our IP are transferred to you through App use.
THE APP, PLANT ID RESULTS, LUX LIGHT READINGS, PEST DIAGNOSES, LOCATION-BASED CARE RECOMMENDATIONS, CARE REMINDERS, AND ALL DATABASE CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
We do not warrant:
100% accuracy of plant species matching, pest disease identification, toxicity marking, camera-based light meter measurements or location-adjusted care plans
Uninterrupted, error-free App operation; server downtime, camera hardware limitations, iOS system updates may break feature functionality
Compatibility with all iPhone models for the light meter camera measurement function
To the fullest extent allowed by applicable United States federal consumer law, we shall not be liable for indirect, incidental, consequential damages including plant death, crop loss, personal injury from misidentified toxic vegetation, errors in lux light readings, lost journal data, or third-party device defects. Our total aggregate liability shall not exceed the total subscription fees you paid to us within 12 months prior to claim.
We may update this Terms of Service for legal compliance or feature changes. Material updates will be notified via in-app pop-up. Your continued App use after effective update date constitutes full acceptance of revised terms.
