Commercial Fishing Gear

Non-game gross fish can be harvested using traditional sport fishing gear, but they can also be caught using commercial fishing gear, such as, gill nets, trammel nets, hoop nets (also called barrel nets, fiddler nets, and lead nets), slat boxes, and trotlines. A person must have a freshwater commercial fishing license to fish commercial fishing gear. Although a trotline can be fished on a sport license, a freshwater commercial license is needed when fishing a trotline with more than 100 hooks.

The state-licensed commercial fishery looks very different than it did 50 years ago. There was a time when Great Lakes commercial fishing was a huge industry with thousands of licenses employing tens of thousands of people. The modern commercial fishery has been consolidated and streamlined. Currently there are around 50 state issued commercial fishing licenses in Michigan spread out over all four of the Great Lakes and only a portion of them harvest fish each year. The others simply maintain their licenses out of a sense that the license alone may have value due to the limited-entry system.

If you are out fishing or boating on the Great Lakes, you may encounter commercial trap nets, gill nets and hook lines in most Michigan waters. All state-licensed or Native American commercial equipment are required to be marked with floats or staff/flag combinations. You should stay at least 250 feet away from buoys, since anchor lines may extend several hundred feet in any direction from the floats or flags and along the length of the gear.

Tampering with commercial fishing gear is illegal. Removal or destruction of marker buoys and flags or other disturbance of gear often results in the waste of a valuable resource, since the nets continue to catch fish. They also can create safety problems for others on the water.

Commercial fishing and the maritime industry are traditional and important components of New York State's culture and economy. New York State works closely with its stakeholders to protect the sustainability of the commercial fishing industry as well as the living marine resources of New York's marine and coastal district.

Annual commercial quota allocations for certain commercially harvested species are provided by NOAA Fisheries, and the Atlantic States Marine Fisheries Commission (ASMFC). As required by fishery management plans (FMPs) and through coordination with the commercial fishing industry, commercial fishing trip limits and quota management plans are developed annually for quota managed species.

Trip limits and fishery status (opened or closed) are updated to manage the allocated quota distribution throughout the fishing year. Check the Commercial Harvest Limits for updated trip limits, fishery status, size limit, and seasons for all managed species of New York's marine and coastal district. Official regulations for all commercially harvested marine fish are located in Part 40 6 NYCRR.

New York State develops distribution plans annually for quota managed species based on the allocations received from NOAA Fisheries and ASMFC, review of fishery management plans, and meetings and discussions with the commercial fishing industry. Quota distribution plans are subject to change during the year based on the rate of harvest.

In the United States, recreational fishing is big business. Fishing contributes $148 billion in economic output and supports 945,500 jobs nationally, according to the American Sportfishing Association. Lake and river experience is certainly required for professionals, but so is savvy business acumen.

NOAA Fisheries does not issue permits to vessels for recreational lobster fishing. Charter boats, head boats, and commercial fishing boats are not considered recreational fishing vessels for the purposes of the lobster fishery.

Any federal lobster permit holder with a trap designation on their permit, may not fish with traps in an area not designated on the permit. You may choose more than one designated area when applying or reapplying for a fishing permit.

The gear restricted areas were established with input from both mobile and trap gear lobster fishermen and are intended to avoid gear conflicts during certain times of the year. These areas restrict access to either trap or mobile gear on an alternating seasonal basis as described below:

With each transfer transaction, there is a 10% conservation tax to the buyer, further removing effort from the fishery. Each year, from August 1 to September 30, trap transfer applications are accepted and NOAA Fisheries works with state agencies to coordinate and approve valid trap transfers. Trap transfers go into effect the following fishing year. Use this application.

The commercial lobster fishery is not managed by quota limitations; instead trap caps are used to control fishing effort. The Commission has implemented a Limited Access Program in all 7 Lobster Management Areas. All Areas, with the exception of Area 1, have also gone through an individual trap allocation process, where vessels are allocated individual trap allocations based on their prior fishing history in the Area.

The measures above apply to permit holders fishing with lobster trap gear. A "lobster trap" refers to any structure or other device, other than a net, that is placed, or designed to be placed, on the ocean bottom and is designed for or is capable of, catching lobsters, fished by a federal lobster vessel.
