According to the new law, any person who has lived in the region for 15 years, or has studied in the region for seven years and passed his class 10 or class 12 examination is eligible for domicile certificate.

Speaking to Anadolu Agency on the condition of anonymity, a government official said, since May 18, when the rules were notified, 33,000 people had applied for the domicile certificates. Out of them, 25,000 people have been granted residency rights, he said.

As many as 32,000 applications were filed in 10 districts of the Hindu majority Jammu region in the south. The highest number of 8,500 certificates has been issued in the Doda district, which has a delicate demographic balance, with Muslims comprising 53.81 percent and Hindus 45.76 percent.

Up to 6,213 domicile certificates have been issued in Rajouri district, which has 62.71 percent Muslim population. Authorities have distributed 6,123 residency certificates in Poonch, a border district comprising 90.44 percent Muslim population.

Parvez, the human rights activist, said the local government, which takes orders from New Delhi, has threatened to penalise officials Rs 50,000 ($660) if a domicile certificate is not issued within stipulated 14 days, adding that it would be difficult to verify the claims of applicants within such a short period.

Srinagar- The Jammu and Kashmir administration on Thursday extended the deadline to offer domicile certificates to former residents who, or their ancestors, moved out of the erstwhile state years ago.

The government has reduced the time limit for issuing a domicile certificate to Permanent Resident Certificate (PRC) holders and migrants from 15 days to just five working days.

The move has come a day after Lt Governor Manoj Sinha had set a deadline for the delivery of domicile certificates to the applicants prompting the admin to speed up the process.

Taking to an official micro-belonging site, Twitter, the Department of Information and Public Relations of the Government of Jammu and Kashmir said that the decision would make the process "extremely simple".

"Govt fixes a time limit of 5 working days for issuing a domicile certificate to PRC holders and migrants. Reduces from earlier 15 days. Process made extremely simple (sic)," it said.

On Sunday, Lt Governor Manoj Sinha had directed the officers concerned to speed up the process of issuance and delivery of domicile certificates in a hassle-free way. He had also appreciated the enthusiasm shown by the applicants.

An official spokesman said the LG took notice of the 90 percent pendency of online applications for domicile certificates and directed the officers to speed up the process through online mode.

He also directed them to ensure seamless issuance of domicile certificates for Permanent Resident Certificate (PRC) holders without requiring additional documents.

So far, over 4 lakh people in Jammu and Kashmir have been issued domicile certificates. A total of 3,68,500 domicile certificates were issued in Jammu and 79,300 in Kashmir Valley.

In May this year, the J&K government notified the J&K grant of domicile certificate procedure rules 2020 and set a fast track process in motion to issue the certificates within a stipulated time of 15 days.

Under the amended rules, eligible non-locals can also apply for the certificate.

According to the new domicile laws, Central government officials, All India Service Officers, officials of Public Sector Undertakings, Autonomous bodies of the Central Government, Public Sector Banks, Statutory bodies, Central Universities and recognised research institutes of the Central Government, who have served in the Union Territory of Jammu and Kashmir for a total period of ten years, are eligible for the certificate.

Children who can produce Class 10 or Class 12 certificates from any J&K school will also be eligible for these certificates.

Union Minister Jitendra Singh on Sunday said Permanent Resident Certificate (PRC) holders will also need Jammu and Kashmir domicile certificate in order to apply for jobs and to get other benefits in the Union Territory.

On August 5, 2019, the Government of India ( GoI) revoked the special status of Jammu Kashmir thus making people from different states applicable to apply for the permanent citizenship of the region.

A domicile certificate is a legal document used as proof by a person that he/she belongs to a respective place. A J&K domicile certificate certifies that a person is a resident of Jammu and Kashmir state. The circle officer, Village Administrative Officer (VAO) or revenue inspector issues the domicile certificate in Jammu and Kashmir.

Eligible persons can apply offline for the Jammu and Kashmir domicile certificate by visiting the village administrative office, circle office or the revenue office. They need to get the domicile certificate application from the office, fill out the application form and submit it with the required documents. The respective officer will provide the application ID.

The Tribune reported that official records reveal that Government has received 33,157 applications for domicile certificates in J&K and over 25,000 people have been granted the citizenship certificate.

In Kashmir, The Tribune reported that the highest number of domicile certificates have been issued in Pulwama (153), followed by Anantnag (106), Kulgam (90), Baramulla (39), Shopian (20), Bandipora (10), Kupwara (10), Budgam (09), Ganderbal (1) and Srinagar (0).

Officials said hundreds of West Pakistan Refugees and Valmiki Samaj members, who were invited to Jammu in 1957 when local sanitation workers went on strike, have been granted certificates, The tribune reported.

The government notified the Jammu and Kashmir Grant of Domicile Certificate (Procedure) Rules, 2020, on May 18 and allowed different categories of non-locals, including non-local government employees, to register for domicile certificates

As of September 6, the department had issued more than one lakh domicile certificates to Kashmiri migrants and displaced persons, according to its website. However, according to a report in The Indian Express, till mid-September, few unregistered migrant families had taken up the offer to get themselves registered. In Delhi and Jammu, special camps had been organised to accept applications and hand out certificates. But out of 25,000 unregistered Kashmiri Pandit families in Delhi, the report said, only 3,000 had turned up at the camps.

According to Zutshi, those who were already registered as state subjects under the pre-2019 framework should not have had to apply afresh for domicile status. Most Kashmiri Pandits in the national capital were also registered as migrants with the Delhi government, he added. Nevertheless, he got a domicile certificate this April.

Jammu: Change of land use; issuance of domicile, character and marriage certificates; obtaining water connections; transfer of leasehold rights; merger of (industrial) units and services under wood based industries will now be the public services guaranteed within a fixed timeline.

For the services of issuance of Domicile certificate; Character certificate; Income certificate for Economically Weaker Section (EWS); Legal Heir certificate and Marriage certificate (The Special Marriages Act, 1954), the timelines of 15 days; 20 days; 45 days, 15 days and 30 days respectively have been notified.

The designated officer for all these services will be Tehsildar except in case of issuance of Marriage certificate wherein the Assistant Commissioner (General) in the office of DC Jammu/Srinagar (Marriage Officer vide S O 421 dated December 15, 2021 of Department of Law, Justice and Parliamentary Affairs) will be the designated officer.

However, the first and second appellate authority will be the Additional Deputy Commissioner (ADC) and Deputy Commissioner (DC) respectively in case of all these services. In case of Marriage certificates, ADC Jammu and Srinagar and DC Jammu and Srinagar will be the first and second appellate authorities respectively.

SRINAGAR: The UT administration in Jammu and Kashmir has issued 3.70 lakh domicile certificates in a month after the online facility for applications was launched a month back, Home Ministry sources told The Indian Express.
