There's a 71004440 background I want to download but I can't see any download link. The only way to get the image is to right-click it and save as but it only saves as a 1131x707. I'm new to deviantart, does anyone know how to fix this?

Is there a working gallery downloader for deviantart. I would also like to stick to windows if possible. I had a working one a few days ago, -tips/download-gallery-favorites-and-scrapbook-of-any-deviantart-user/ but it no longer works.

I think that the argument in the claim is flawed because it does not accurately represent the technology, so I will attempt to make a very quick explanation of how tools such as Stable Diffusion or Midjourney produce images. What follows is using some excerpts from my forthcoming article, so stay tuned for a lengthier explanation.

But what is the model from a practical perspective? It is a common misconception that a machine learning model is just a storage of images that then generates a collage, the current lawsuit uses the word collage repeatedly, so it is perpetuating this myth. This is where another model comes in, this is known as CLIP, it is designed to improve the performance of AI models on a wide range of tasks involving both language and images. The model is trained using a large dataset of images and their corresponding text descriptions, and it learns to understand the relationship between language and images. This allows it to perform tasks such as image captioning and image classification with high accuracy. So, AI tools use a combination of a diffusion model trained on reconstructing images, as well as CLIP to understand words used to describe an image.

DreamUp creates novel AI-generated art based on text prompts. Due to its Stable Diffusion roots, DreamUp learned how to generate images by analyzing hundreds of millions of images scraped off sites like DeviantArt and collected into LAION datasets without artists' permission, a potential irony that some DeviantArt members find problematic.

As we've reported frequently on Ars in the past, Stable Diffusion's web-scraping nature ignited a huge debate earlier this year among artists that challenge the ethics of AI-generated artwork. Some art communities have taken hard stances against any AI-generated images, banning them completely.

Also, DeviantArt will let artists opt out of letting their images train DreamUp in the future, but each artist must fill out a form that requires human review first. This policy has led to significant pushback among DeviantArt members, some of whom have threatened to delete all of their work and deactivate their accounts.

Update: A few hours after press time, DeviantArt announced an update to its AI dataset policy stating that in response to community feedback, all DeviantArt-hosted images will be "automatically labeled as NOT authorized for use in AI datasets."

In January of 2023, three artists Sarah Andersen, Kelly McKernan, and Karla Ortiz filed a copyright infringement lawsuit against Stability AI, Midjourney, and DeviantArt, claiming that these companies have infringed the rights of millions of artists by training AI tools on five billion images scraped from the web without the consent of the original artists.[33]

The site has over 550 million images which have been uploaded by its over 75 million registered members.[35] By July 2011, DeviantArt was the largest online art community.[36] Members of DeviantArt may leave comments and critiques on individual deviation pages,[37][38] allowing the site to be called "a [free] peer evaluation application."[39] Along with textual critique, DeviantArt now offers the option to leave a small picture as a comment.[40] This can be achieved using an option of DeviantArt Muro, which is a browser-based drawing tool that DeviantArt has developed and hosts. However, only members of DeviantArt can save their work as deviations. Another feature of Muro is what is called "Redraw," it records the user as they draw their image, and then the user can post the entire process as a film deviation.[41] Some artists in late 2013 began experimenting with the use of breakfast cereal as the subject of their pieces, although this trend has only started spreading.[42]

Individual deviations are displayed on their own pages, with a list of statistical information about the image, as well as a place for comments by the artist and other members, and the option to share through other social media (Facebook, Twitter, etc.).[43] Prior to Version 9, Deviations were required to be organized into categories when a member uploaded an image and this allowed DeviantArt's search engine to find images concerning similar topics.[44]

Individual members can organize their own deviations into folders on their personal pages.[39] The member pages (profiles) show a member's personally uploaded deviations and journal postings.[45] Journals are like personal blogs for the member pages, and the choice of topic is up to each member; some use it to talk about their personal or art-related lives, others use it to spread awareness or marshal support for a cause.[46] Also displayed are a member's favorites, a collection of other users' images from DeviantArt that a member saves to its own folder.[47] Another thing found on the profile page is a member's watchers; a member adds another member to their watch list in order to be notified when that member uploads something.[46] The watcher notifications are gathered in a member's Message Center with other notices, like when other users comment on that member's deviations, or when the member's image has been put in someone's favorites.[46]

On June 17 and 18, 2005, DeviantArt held their first convention, the deviantART Summit, at the Palladium in the Hollywood area of Los Angeles, California, United States. The summit consisted of several exhibitions by numerous artists, including artscene groups old and new at about 200 different booths. Giant projection screens displayed artwork as it was being submitted live to DeviantArt, which was receiving 50,000 new images daily at the time.

For anyone looking for a DeviantArt downloader, this is a quick tutorial that shows how to download from DeviantArt galleries and favourites in bulk. The tool I will be using to demonstrate this is called WFDownloader App. All you need to do is copy and paste the link of any DeviantArt gallery or favourite page (that you want to download from) into the application and do a search. After that, you can begin downloading the images and videos found. Yes, this tool will download both images and videos from DeviantArt with everything neatly named and organized.

Her allegations against DeviantArt and Midjourney, however, were also thrown out. Judge Orrick said the cartoonist and illustrator had failed to show how those two defendants had directly infringed upon her rights, considering they didn't scrape any images nor train Stable Diffusion themselves.

Instead, the training dataset was collected by LAION, a non-profit organization that reportedly scraped public images from the internet at the direction of Stability, who then went on to develop Stable Diffusion using that data. For that reason, Judge Orrick threw out the case against DeviantArt and Midjourney but not Stability for Anderson.

Orrick advised the artists to clarify whether their cases against DeviantArt and Midjourney are based on both companies' use of Stable Diffusion, or their own custom products, or both. He also cast doubt on whether it was possible to claim that every image in LAION training dataset was copyrighted, and that all AI-generated outputs are unlawful derivatives of images.

"Even if that clarity is provided and even if plaintiffs narrow their allegations to limit them to output images that draw upon training images based upon copyrighted images, I am not convinced that copyright claims based [on] a derivative theory can survive absent 'substantial similarity' type allegations," he said.

In short, Orrick doesn't seem to be persuaded by their arguments that AI-generated outputs are merely derivatives of images, even if they are based on copyrighted works; they may not be similar enough to original images to meet the legal standard needed for infringement claims.

A group of artists is taking on AI generators Stability AI Ltd., Midjourney Inc., and DeviantArt Inc. in what would be a first-of-its-kind copyright infringement class action over using copyrighted images to train AI tools.

The filing of this case was noteworthy as it was one of the first lawsuits in an attempt by artists to curtail the use of generative AI during the initial boom of AI programs offered to consumers. Similar challenges have been lodged against AI training models and related programs that are used to create code, photographic images, and books. During the 10 months since this case was filed, it has been under careful scrutiny, with the court taking a nuanced and firm look at the allegations to hone in on the core legal issues potentially affecting artist rights in the new world of AI powered works of authorship

When using images for non-educational work, there are rules in place to protect the creator of the original image. The best thing to do is to find images through Creative Commons that allow modification.
